Learn About Connecticut DMV License Suspension

Understanding Connecticut License Suspension: The Basics

A Connecticut driver's license suspension is a temporary removal of your driving privileges issued by the Connecticut Department of Motor Vehicles (DMV). When your license is suspended, you lose the legal right to operate a motor vehicle on Connecticut roads. This differs from a license revocation, which is permanent and requires you to go through a full reinstatement process to drive again. A suspension is meant to be temporary, though the length varies depending on the reason for the suspension.

Connecticut's DMV can suspend your license for many different reasons. The most common cause is accumulating too many points on your driving record from traffic violations. Other reasons include failing to pay traffic fines, not paying child support, failing a drug test, driving under the influence (DUI), or being convicted of certain crimes. Some suspensions are mandatory under state law, while others are discretionary based on the DMV's judgment.

Understanding the reason for your suspension matters because it determines how long the suspension lasts and what steps you must take to restore your driving privileges. Different violations carry different suspension lengths. For example, a suspension for unpaid fines might last until you pay, while a suspension for accumulating points might last several months or longer.

Connecticut takes license suspensions seriously because they serve as a public safety tool. The state uses suspensions to encourage safer driving behavior, ensure payment of traffic fines and court fees, and enforce child support obligations. Driving on a suspended license in Connecticut is a criminal offense that can result in fines, jail time, and additional license suspensions.

Practical Takeaway: If you receive notice that your Connecticut license is suspended, the first step is to understand why. The DMV notice you receive will explain the reason for the suspension and provide information about how long it will last. Keep this notice in a safe place, as you may need it when you work toward restoring your license.

Common Reasons for Connecticut License Suspension

One of the most frequent reasons for license suspension in Connecticut is accumulating points on your driving record. Connecticut uses a point system where different traffic violations result in a specific number of points. Common violations include speeding (ranging from 2 to 5 points depending on how much over the limit), failure to obey a traffic signal (3 points), following too closely (3 points), and improper passing (4 points). When a driver accumulates 10 or more points within a two-year period, the DMV typically suspends the license.

Driving under the influence (DUI) is another major reason for license suspension. Connecticut law imposes mandatory license suspensions for DUI convictions. A first-time DUI conviction typically results in a one-year license suspension. Second and subsequent DUI convictions carry longer suspension periods. Additionally, if you refuse to take a breathalyzer test or fail a chemical test, Connecticut's implied consent law may result in an automatic administrative suspension even before any court conviction occurs.

Failure to pay traffic fines and court-ordered fees is a common but preventable reason for suspension. When you receive a traffic ticket in Connecticut, you have the option to pay the fine or contest the ticket in court. If you don't pay the fine by the deadline or fail to appear in court, the DMV can suspend your license. This suspension continues until you pay the outstanding amount plus any additional fees or penalties.

Connecticut also suspends licenses for failure to pay child support. If you are behind on child support payments, the state's child support enforcement agency can request that the DMV suspend your license. This is a tool used to encourage payment of court-ordered child support obligations. Your license remains suspended until you bring your payments current or make arrangements with the child support agency.

Medical and administrative reasons can also trigger suspension. For example, if you fail a required medical examination, do not renew your license on time, or provide false information on your license application, your license may be suspended. Additionally, some suspensions relate to your Social Security number verification or citizenship status if there are discrepancies in your records.

Practical Takeaway: Review your driving record regularly to monitor your points. You can request a copy of your Connecticut driving record from the DMV. If you receive a traffic ticket, make a note of the fine amount and due date to avoid suspension for non-payment. If you owe child support, contact the child support agency to discuss payment arrangements.

How Connecticut's Point System Works

Connecticut's point system is designed to track unsafe driving behavior and encourage compliance with traffic laws. Each traffic violation carries a specific point value, and points accumulate on your driving record over time. The DMV maintains this record and uses it to determine whether to suspend your license. Understanding how many points each violation carries can help you make safer driving decisions.

Minor violations typically carry 2 to 4 points. These include violations like operating with an obstructed view, failure to signal, improper backing, or equipment violations. More serious moving violations, such as excessive speeding or reckless driving, carry 4 to 5 points. For example, speeding 20 miles per hour or more over the posted limit results in 5 points, while speeding 1-10 miles per hour over the limit results in 2 points. Violations involving accidents or unsafe passing may result in 4 points.

The critical threshold in Connecticut is 10 points within a two-year period. When your accumulated points reach 10 or more, the DMV sends you a notice of suspension. However, you have the opportunity to request a hearing before the suspension becomes effective. At this hearing, you can present evidence or arguments about why your license should not be suspended. Some drivers successfully argue that they have corrected their driving behavior or that circumstances warrant an exception.

Points remain on your record for a specific period. In Connecticut, points generally stay on your driving record for two years from the date of conviction. However, if you receive multiple violations, the two-year window is calculated separately for each violation. For example, if you received a violation on January 1, 2023, and another on January 1, 2024, the first violation would drop off on January 1, 2025, while the second would remain until January 1, 2026.

Some violations do not add points but still result in suspension or other penalties. For example, DUI convictions do not use the point system but instead trigger automatic suspension. Similarly, certain violations related to drug convictions or hazardous materials violations may result in suspension outside the point accumulation system. When you receive a traffic ticket, the citation should indicate how many points, if any, the violation carries.

Practical Takeaway: Check your driving record annually through the Connecticut DMV website or by requesting a copy in person. If you have 6 or more points, focus on safe driving to avoid reaching the 10-point threshold. If you receive a notice that your license will be suspended due to points, request the hearing that the DMV offers—you have the right to challenge the suspension before it takes effect.

License Suspension Notices and What They Mean

When the Connecticut DMV determines that you are subject to license suspension, they send you an official notice in the mail. This notice is a critical document that contains important information about your suspension. Understanding what the notice says and the timeframe it provides is essential for protecting your rights and knowing what steps to take next.

A typical Connecticut license suspension notice includes several key pieces of information. First, it states the specific reason for the suspension, whether it's accumulated points, failure to pay fines, DUI conviction, child support arrears, or another cause. Second, the notice indicates the date the suspension will take effect. Third, it explains how long the suspension will last. Fourth, the notice may include information about your right to request a hearing to contest the suspension before it becomes effective.

The timeframe between receiving the notice and the suspension taking effect is important. If you have the right to a pre-suspension hearing, Connecticut law typically gives you 10 days from the date the notice is mailed to request one. This hearing is your opportunity to present arguments or evidence for why your license should not be suspended. For example, if your suspension is based on points, you might argue that you have taken a defensive driving course, or you might provide evidence of changed circumstances. If your suspension is for unpaid fines, you might explain that you have already paid the fine or that you need time to make payment.

Different types of suspensions have different notice requirements. For administrative suspensions related to DUI or chemical test refusal, the notice may come from the DMV's administrative division rather than from the Motor Vehicle Violations Bureau. This type
