Understanding Different Types of Court Records Available

Louisiana Clerk of Court offices maintain several categories of records, and understanding the differences helps you find what you need. Civil records include lawsuits between people or businesses over money, contracts, injuries, or disputes. These cases do not involve criminal charges. Family law records include divorces, custody battles, adoptions, and child support cases. Criminal records contain information about cases where someone was charged with breaking the law.

Property records are another major category. These are sometimes called mortgage records or conveyance records and include deeds, mortgages, liens, and other documents that show who owns property and what debts are attached to it. Property records are public information that anyone can search.

Court orders and judgments are specific documents issued by a judge in a case. These orders might require someone to pay money, return property, change their behavior, or appear in court. Certified copies of these orders can be obtained through the Clerk of Court office for a fee.

Not all records are equally easy to access. Recent criminal records may have restrictions to protect privacy or safety. Sealed records are hidden from public view by court order. Records involving juveniles are often restricted. Family law records involving children may have privacy protections. The Clerk of Court office can explain whether a specific record is available to the public or restricted.

Some records older than 50 to 100 years may be stored in archives or on microfilm rather than in the main office. These older records can usually still be obtained, but it may take longer and require special requests.

Practical Takeaway: Know which category your record falls into before searching. If you are looking for information about a property, go to property records. If you need information about a court case, search the civil or criminal records depending on the nature of the case.
