Free Guide to Senior Guardianship and Conservatorship Roles

Understanding Guardianship and Conservatorship Basics

Guardianship and conservatorship are legal arrangements where a court appoints one person to make decisions on behalf of another person who cannot make those decisions themselves. These are separate but sometimes overlapping roles, and understanding the difference matters when considering what might work for a particular situation.

A guardian typically makes personal and medical decisions for someone who is incapacitated. This means the guardian decides where the person lives, what medical treatment they receive, what school they attend (if applicable), and other day-to-day life choices. A conservator, by contrast, handles financial and property matters. The conservator manages bank accounts, pays bills, collects income, and makes investment decisions. Some states use different terminology—for example, some call a financial guardian a "conservator" while others use "guardian of the estate."

According to the American Bar Association, an estimated 1.3 million adults in the United States live under guardianship or conservatorship orders. The National Center on Law and Elder Rights reports that many of these arrangements are put in place for seniors with dementia, Alzheimer's disease, or other conditions affecting decision-making capacity. Others involve younger adults with intellectual or developmental disabilities, brain injuries, or mental illness.

These arrangements exist because the law recognizes that some people reach a point where they cannot manage their own affairs safely or effectively. Without a guardian or conservator, an incapacitated person's medical decisions might go unmade, bills might go unpaid, and financial predators might take advantage. The court system provides a formal structure to protect vulnerable people.

Practical takeaway: Before exploring guardianship or conservatorship, gather information about the specific situation. Is the concern primarily about medical decisions, financial management, or both? Understanding what decisions need to be made helps clarify which type of arrangement might be appropriate to discuss with an attorney.

The Legal Process for Establishing Guardianship or Conservatorship

The process for establishing guardianship or conservatorship begins with filing a petition in probate court or family court, depending on the state. The person seeking to become a guardian (called the "petitioner") files documents explaining why they believe the other person (called the "respondent" or "alleged incapacitated person") cannot make decisions in a particular area. The petitioner must include specific facts and often medical evidence supporting this claim.

Most states require that the respondent be notified of the petition. The respondent has the right to attend a hearing, to be represented by an attorney, and to contest the guardianship or conservatorship. Some states provide that the court must appoint an attorney for the respondent if they cannot afford one. The respondent can present evidence showing they are still capable of making decisions in the area in question.

At the hearing, the petitioner presents evidence—often including medical records, doctor testimony, or other documentation—showing that the person lacks capacity. The judge considers this evidence and decides whether to grant the guardianship or conservatorship. If granted, the court issues an order specifying what powers the guardian or conservator has. For example, a guardianship order might state that the guardian can make medical decisions but not financial decisions.

The timeline varies by state and court backlog, but many guardianship hearings take place within 2-4 months of filing. Some states allow expedited hearings in emergency situations. After the order is issued, the guardian or conservator must often take an oath and may be required to post a bond—a kind of insurance policy protecting the incapacitated person.

Many courts require ongoing monitoring. A guardian or conservator might need to file annual reports showing what decisions they made and, in the case of a conservator, accounting for all money handled. Some states are moving toward less restrictive alternatives before full guardianship, such as supported decision-making or limited guardianship, where the person retains more control over their own choices.

Practical takeaway: Before filing for guardianship or conservatorship, consult with an elder law or family law attorney in your state. Laws vary significantly by location, and an attorney can explain the specific process, timeline, and requirements where you live. Many bar associations offer referrals to attorneys who provide initial consultations at reduced cost or without charge.

Responsibilities and Duties of a Guardian

A guardian assumes significant legal responsibility for another person's welfare. The guardian's duties typically include making sure the ward (the person under guardianship) receives proper food, housing, clothing, and medical care. The guardian must also make healthcare decisions—choosing doctors, consenting to surgery, deciding on medications, and in some cases, making end-of-life choices.

Guardians must act in the "best interest" of the ward. This is a legal standard meaning the guardian should make decisions they believe are best for the ward's wellbeing, not decisions that benefit the guardian. Courts take this seriously. If a guardian uses the ward's money for personal purposes, fails to provide adequate care, or makes decisions that harm the ward, the court can remove the guardian and hold them financially accountable.

The specific responsibilities vary depending on the guardianship order. A full guardianship gives the guardian broad power over personal and medical decisions. A limited guardianship restricts the guardian's power to specific areas—for example, a guardian might make medical decisions but not housing decisions, allowing the ward to retain control over some life choices. Some guardianships are temporary, lasting only as long as the incapacity, while others are permanent.

Day-to-day guardianship duties might include: attending medical appointments, reviewing treatment plans, deciding on living arrangements, managing daily schedules, handling personal property, maintaining relationships with family members, and ensuring the ward's social and recreational needs are met. If the ward has capacity to participate in decisions, a good guardian will involve them in the process, explaining choices and listening to their preferences.

Guardians may also have administrative duties. They might need to attend court hearings, provide reports to the court about the ward's condition, or work with conservators if someone else manages finances. In cases of institutional guardianship—where a nursing home or state agency is guardian—these duties are formalized and documented.

Practical takeaway: If you are considering becoming a guardian, honestly assess whether you have the time and emotional capacity for the role. Guardianship can involve significant ongoing responsibility. Many families find it helpful to discuss expectations with other family members beforehand and to understand that the court may require periodic reporting on how the ward is doing.

Responsibilities and Duties of a Conservator

A conservator manages money and property on behalf of someone who cannot do so themselves. This is a financial role, distinct from guardianship. A conservator's primary duty is to preserve and properly manage the assets of the person under conservatorship (called the "conservatee" or "ward"). The conservator must act honestly and carefully with the conservatee's money, similar to how a trustee manages funds in a trust.

Conservators typically handle bank accounts, investment accounts, real estate, retirement benefits, insurance policies, and other financial assets. The conservator pays bills from the conservatee's funds, manages property, collects income, files tax returns when appropriate, and may make decisions about selling property or investing money. The conservator cannot keep money for themselves—funds must be spent on the conservatee's needs or preserved for their future.

Most states require conservators to provide detailed accounting to the court, often annually. This accounting shows all money received, all money spent, and the remaining balance. The conservator must document every transaction and be prepared to justify each expenditure. Courts take conservatorships seriously because financial exploitation of vulnerable adults is a genuine risk. According to the National Adult Protective Services Association, financial exploitation of seniors costs billions of dollars annually.

A conservator's duties might include: paying medical bills and insurance premiums from conservatee funds, managing rent or mortgage payments, maintaining property, collecting Social Security or pension payments, filing income tax returns, managing investment accounts, and ensuring bills are paid on time. If the conservatee needs money for special care or medical treatment, the conservator may need to seek court approval for significant expenditures.

Conservators have a fiduciary duty to the conservatee. This means they must put the conservatee's interests first. A conservator cannot use conservatee money to pay their own bills, cannot take loans from the conservatee's account, and cannot give gifts of conservatee money to family members without court approval. Violations of these duties can result in the conservator being removed
