Understanding Pre-Settlement Cash Options

Pre-settlement cash options are financial products that provide money to people involved in ongoing legal cases. When someone files a lawsuit, the legal process often takes months or even years to reach a conclusion. During this waiting period, a person may face financial hardship from medical bills, lost wages, or daily living expenses. Pre-settlement cash options attempt to address this gap by offering funds before the case settles or reaches a verdict.

Learn About Settlement Payments and How They Work →

These options work differently than traditional loans. When someone takes out a pre-settlement cash option, they receive money upfront. The repayment of that money comes directly from the final settlement or court award. If the case does not result in a settlement or award in the person's favor, the company providing the cash typically does not require repayment. This structure makes pre-settlement cash fundamentally different from a standard loan where monthly payments are expected regardless of the case outcome.

Several names describe these products. Some companies call them "settlement advances," while others use terms like "case funding" or "lawsuit cash." The basic concept remains the same: a cash infusion during the waiting period of a legal case. The amount of money offered and the terms vary significantly based on the type of case, the estimated settlement value, and the company providing the funds.

Understanding how these options work is the first step in evaluating whether they might be useful for someone's situation. The guide explores what information is available about these products, how they operate, what costs are involved, and what questions someone should consider before pursuing this option.

Practical Takeaway: Pre-settlement cash options are not loans in the traditional sense. They are financial products where repayment depends on the outcome of a legal case, making them a distinct category of funding.

How Pre-Settlement Funding Companies Evaluate Cases

Pre-settlement funding companies do not evaluate cases the way a law firm does. They are not assessing whether someone has a strong legal claim. Instead, they focus on whether the case is likely to result in a settlement or award large enough to repay the advance and cover their fees.

When someone inquires about pre-settlement funding, the company typically asks for basic information about the lawsuit. They want to know the type of case—whether it involves a car accident, workplace injury, medical malpractice, product liability, or another category. They ask about the injuries or damages involved. They request information about the defendant and whether the defendant is insured. Insurance coverage matters significantly because it affects the likelihood and size of a potential settlement.

The company may ask for documentation such as medical records, police reports, or correspondence from the person's attorney. This information helps them estimate the potential value of the case. Their goal is to determine whether the probable settlement or award will be substantial enough to justify providing an advance and paying their own costs.

Companies also consider the timeline of the case. Cases that are likely to settle quickly are less risky for the funding company than cases expected to drag on for years. An accident case with clear liability and documented injuries may be viewed more favorably than a complex commercial dispute where liability is contested.

It is important to understand that a company's decision to offer pre-settlement funding is not a statement about the strength of a legal case. A company might decline to fund a case simply because they estimate the settlement will be too small to make the business worthwhile for them, even if the case has merit. Conversely, a company might fund a case with a high estimated value even if liability or damages are genuinely disputed.

Practical Takeaway: Funding companies evaluate cases based on potential settlement value and repayment likelihood, not on the legal strength of a claim. Their decision to fund or decline is a business decision, not a legal assessment.

Understanding Costs and Fees Associated with Pre-Settlement Funding

Pre-settlement funding involves several costs that reduce the amount a person ultimately receives from their settlement or award. Understanding these costs is crucial for making an informed decision about whether this option makes financial sense in a particular situation.

The primary cost is the funding company's fee. This fee is typically structured as a percentage of the total amount advanced. Fees generally range from 9 percent to 20 percent or more, depending on the company, the type of case, the estimated duration of the case, and market conditions. Some companies charge lower fees for shorter-term funding and higher fees for cases expected to take longer to resolve. A few companies have standard flat fees regardless of case type, but percentage-based fees are more common.

To illustrate how this works with an example: If someone receives a $10,000 advance and the company's fee is 15 percent, they would owe $1,500 to the company when the case settles. If the settlement is $100,000, they would receive $100,000 minus $1,500 (the fee), minus any attorney contingency fee (typically 33 percent to 40 percent), minus medical liens or other obligations. The amount remaining goes to the person who received the funding.

Some companies charge monthly interest or growth fees in addition to the initial funding fee. These additional costs accumulate over time, meaning the total amount owed increases the longer the case remains open. This structure creates an incentive for the company to pursue settlement, since their fees grow with time. However, it also means the total cost to the person receiving funding increases substantially if the case extends for years.

A person considering pre-settlement funding should request a written disclosure of all costs before proceeding. This document should clearly state the initial fee percentage, any ongoing fees or interest, and how the total amount to be repaid is calculated. Some states have regulations requiring clear disclosure of these terms, while others do not. Regardless of state law, requesting this information in writing is a standard practice.

It is also important to understand how the funding company is repaid. In most cases, the person's attorney agrees that the funding company will be repaid directly from the settlement proceeds, before the person receives their portion. This arrangement is called a "direct assignment" or "assignment of proceeds." The person should verify with their attorney that this arrangement has been properly documented and that the attorney understands the funding company's claim amount.

Practical Takeaway: Pre-settlement funding fees typically range from 9 percent to 20 percent or higher, with some products charging additional monthly interest. These costs should be clearly disclosed in writing before accepting any funding.

Types of Cases That May Be Considered for Pre-Settlement Funding

Pre-settlement funding companies focus on certain categories of cases because these cases tend to have insurable defendants and more predictable settlement values. While individual companies vary in what they fund, some case types are more commonly considered than others.

Personal injury cases are among the most frequently funded. These include car accidents, truck accidents, motorcycle accidents, and other motor vehicle collision cases. Because vehicles are required to carry liability insurance in most states, these cases often have a clear source of settlement funds. Medical records document the injuries, and the damages are often straightforward to calculate.

Workplace injury cases, sometimes called workers' compensation cases, may also be funded. These cases involve injuries that occur on the job. In most states, employers are required to carry workers' compensation insurance. When a worker is injured, they file a workers' compensation claim, which typically results in coverage for medical treatment and a portion of lost wages. Some pre-settlement funding companies specifically focus on this category.

Medical malpractice cases represent another category that funding companies may consider. These cases allege that a doctor, hospital, or other medical provider caused harm through negligent care. Because medical malpractice cases are complex and take considerable time to resolve, they may involve substantial damages. However, because these cases are also more difficult to value and may be contested more heavily, some funding companies view them as higher risk.

Product liability cases involve injuries caused by defective or dangerous products. These cases might involve pharmaceutical products, consumer goods, machinery, or other items. Cases involving widely recognized defects or recalls may be viewed more favorably by funding companies.

Other case types that may be considered include premises liability (injuries on someone else's property), assault or battery cases, wrongful death cases, and sexual abuse cases. However, individual funding companies maintain their own criteria for what they will and will not fund. Some companies specialize in specific case types, while others fund a broader range of cases.

Cases that are less commonly funded include those involving individual defendants with limited assets or insurance, cases where liability is heavily disputed, divorce or family law cases, criminal cases, and cases involving government defendants where immunity issues may apply. Each funding company maintains its own underwriting standards.
