What Texas Small Claims Court Is and How It Works

Texas small claims court is a division of the Justice Court system designed to handle disputes involving smaller amounts of money. These courts exist in every county across Texas and process thousands of cases each year. Unlike regular civil court, small claims court has a simpler process, fewer rules, and lower costs, making it possible for regular people to resolve disputes without hiring a lawyer.

The monetary limit for small claims cases in Texas is $20,000 for most disputes. However, if both parties agree, a case can be heard in small claims court even if the amount exceeds this limit. The court handles various types of disputes including unpaid debts, security deposit disagreements, property damage claims, contract breaches, and disputes over personal property.

Small claims court operates differently from regular civil court in several important ways. The process moves faster—cases typically resolve within a few months rather than years. The rules of evidence are relaxed, meaning certain documents and testimony that wouldn't normally be allowed in regular court can be presented. Judges often take a more active role in questioning witnesses and understanding the facts rather than simply listening to each side present their case.

In Texas, small claims courts are called "Justice Courts" and handle cases in precinct 1, 2, 3, 4, 5, 6, 7, or 8 depending on your county's size. The justice of the peace, often called a judge, presides over these cases. While lawyers are allowed in small claims court, many people choose to represent themselves because the process is meant to be understandable without legal training.

The entire process from filing to judgment typically takes between 30 and 90 days, though some cases resolve faster through settlement. Understanding how small claims court works is your first step toward resolving a dispute that might otherwise cost thousands of dollars to pursue through the regular court system.

Practical Takeaway: Small claims court offers an affordable way to resolve money disputes under $20,000 in Texas without needing to hire a lawyer or navigate complex court procedures.

Understanding Filing Fees and Court Costs

Filing a case in Texas Justice Court involves paying a filing fee. As of 2024, these fees vary by county but typically range from $50 to $100 for cases under $5,000. Cases between $5,000 and $20,000 generally cost between $75 and $150 in filing fees. Some counties may charge slightly different amounts, so checking your specific county's Justice Court website before filing is important.

Beyond the initial filing fee, there are other costs to consider. If you need to serve the defendant (the person you're suing) with court papers, you'll need to pay a service fee. In Texas, you can serve papers by certified mail for a modest fee, typically $5 to $10. If you need a constable or process server to deliver papers in person, costs range from $25 to $75 depending on the method and distance. Some defendants can be served at their workplace or home, which may cost less than other methods.

Filing and court costs are generally the plaintiff's (the person filing) responsibility upfront. However, if you win your case, the judge may require the defendant to pay these costs. This means your filing fee and service costs could potentially be recovered as part of your judgment. This possibility should be factored into your decision about whether pursuing the case makes financial sense.

Additional costs may arise if you need court transcripts, certified copies of judgments, or if you must travel to court multiple times. Some counties offer payment plans or fee waivers for people with low income. To explore this option, you can contact your local Justice Court and ask about filing a "statement of inability to pay" or similar form. Counties handle these requests differently, but many will work with you if costs present a genuine hardship.

Understanding all potential costs before filing helps you make an informed decision about whether small claims court is the right option for your situation. Keep receipts and documentation of all expenses related to your case, as these may be recoverable if you win.

Practical Takeaway: Budget between $75 and $200 for basic court costs, and remember that these costs can often be recovered from the defendant if you win your case.

How to File Your Case in Small Claims Court

Filing a case in Texas small claims court begins with completing the appropriate court forms. The main document you'll file is called a "Petition" or "Small Claim." This document tells the court what your dispute is about, who you're suing, how much money you're asking for, and why you believe the defendant owes you this money. Most Justice Courts provide blank petition forms on their websites or at their offices.

Your petition should include specific factual details about your dispute. Instead of saying "The defendant damaged my property," explain the exact circumstances: "On March 15, 2024, the defendant backed into my parked car in the parking lot at 123 Main Street, causing $3,500 in damage to the rear bumper and frame." Include dates, locations, amounts, and names of any witnesses. The more specific your petition, the better the judge can understand your case.

You'll need to identify the defendant correctly on your petition. If you're suing an individual, use their full legal name. If you're suing a business, identify whether it's a sole proprietorship, LLC, partnership, or corporation, as this affects where and how you serve papers. You'll need the defendant's address or, for a business, their registered address. This information is necessary for serving the papers.

Once you've completed your petition, you'll take it to your local Justice Court office to file it. Bring the original and at least one copy—most courts require two or three copies total. Pay your filing fee at this time. The court clerk will stamp your papers and provide you with a case number and hearing date. Most courts schedule hearings 20 to 45 days after filing.

After filing, you must serve the defendant with a copy of your petition and notice of the hearing. You cannot simply hand papers to the defendant yourself; service must follow specific rules. Certified mail is the most affordable option in many cases. You can mail a copy of your filed petition and the court's notice of hearing to the defendant's address. Keep the certified mail receipt as proof of service. File this proof with the court before your hearing date.

Practical Takeaway: Prepare a detailed, factual petition; file it with the court; and ensure the defendant receives proper notice through certified mail or another approved service method before your hearing date.

Gathering Evidence and Building Your Case

The strength of your small claims case depends entirely on the evidence you present. Evidence is anything that proves your claims are true. In small claims court, you can present several types of evidence, and the judge will consider what seems most reliable and relevant to your dispute.

Written documents are among the strongest evidence in small claims cases. Contracts, text messages, emails, receipts, invoices, and photographs all carry significant weight. If you loaned someone money, a written agreement showing the loan amount and repayment terms is powerful evidence. If you're disputing a repair job, before-and-after photos and the written estimate you received make your case clear. If the defendant promised something in writing, that written promise is far more convincing than your testimony about what they said.

For financial disputes, gather bank statements, canceled checks, credit card statements, or payment records showing money moving between you and the defendant. These documents create a clear record that's difficult to dispute. If you paid someone in cash, try to find any documentation—a receipt, a note, even text messages where they acknowledge receiving the payment. Create a timeline showing payment dates, amounts, and any communications about the money.

Photographs and videos are valuable evidence for property damage claims, housing disputes, or cases involving the condition of items. If you're claiming property damage, take clear photos from multiple angles showing the damage. If you're disputing the condition of rental property when returning it, photos taken before move-in and after move-out tell the story visually. Videos can show how something doesn't work or document damage you're claiming.

Witness testimony carries weight in small claims court. If someone saw what happened or knows facts relevant to your case, bring them to court. They can testify about what they observed. Give them a copy of the petition and hearing notice ahead of time so they understand the case. In some situations, you can request the court to subpoena a witness—this is a formal order requiring them to appear.
