Understanding Your First DWI Arrest in Texas

What Happens During a DWI Arrest in Texas

A DWI (Driving While Intoxicated) arrest in Texas begins the moment a police officer pulls you over and suspects you may be driving under the influence. The officer will typically approach your vehicle and ask for your license, registration, and proof of insurance. During this initial contact, the officer is observing your behavior, speech, and physical appearance for signs of impairment such as slurred speech, bloodshot eyes, or the smell of alcohol.

If the officer suspects impairment, they will ask you to perform field sobriety tests (FSTs). These standardized tests include the horizontal gaze nystagmus test (following a pen with your eyes), the walk-and-turn test (walking a straight line), and the one-leg stand test. You should understand that these tests are designed to be difficult, and poor performance can be used as evidence. Importantly, you have the right to decline these tests, though refusing may result in additional suspicion.

If the officer believes there is probable cause for impairment, they will arrest you. During arrest, you will be read your Miranda rights, which inform you of your right to remain silent and your right to an attorney. Your vehicle will be towed, and you will be taken to a police station or jail for processing. At the station, the officer will likely request that you take a breath test (breathalyzer) or blood test to measure your blood alcohol concentration (BAC).

In Texas, the legal limit for drivers 21 and older is 0.08% BAC. For drivers under 21, any detectable amount of alcohol can result in a DWI charge. Commercial drivers have a limit of 0.04% BAC. According to the Texas Department of Transportation, there were approximately 22,000 DWI arrests in Texas in 2022, making this a common criminal charge in the state.

Practical Takeaway: Understanding the arrest process helps you know what to expect. Remember that you can decline field sobriety tests, and you have the right to speak with an attorney before answering questions or taking chemical tests. Anything you say to police can be used against you in court.

Understanding Your Rights and Responsibilities After Arrest

After a DWI arrest in Texas, you have several important rights that protect you throughout the legal process. The right to remain silent is one of your most valuable protections. This means you are not required to answer questions about where you were going, how much you had to drink, or any other details related to your case. You can politely tell the officer, "I would like to speak with an attorney before answering any questions."

You also have the right to request an attorney. If you cannot afford an attorney, you may request that the court appoint one for you at no cost. This is called a public defender. Making this request as early as possible—ideally during the arrest process or at your first appearance before a judge—is important. An attorney can help protect your rights and work toward the best possible outcome in your case.

Regarding chemical testing, Texas has an "implied consent" law. This means that by driving on Texas roads, you have implicitly agreed to submit to a breath or blood test if stopped on suspicion of DWI. However, you can still refuse the test. Refusing has serious consequences: your driver's license will be automatically suspended for 180 days if it is your first refusal, and for two years if you have a prior refusal or DWI conviction within the past 10 years. Additionally, the refusal itself can be used as evidence against you in court.

At your first court appearance, called an "arraignment," you will be informed of the charges against you and your rights. The judge will determine whether you should be released on bail and under what conditions. You may be released on your own recognizance (your promise to return), released on bail (money paid to the court), or held without bail if the judge believes you pose a danger or flight risk. Understanding these rights allows you to make informed decisions about your case from the very beginning.

Practical Takeaway: Exercise your rights from the start. Request an attorney immediately, do not answer questions without legal representation, and understand that refusing a chemical test has automatic legal consequences but may also have strategic value in your defense. Your attorney can explain the best approach for your specific situation.

The Criminal Charges and Possible Penalties in Texas

DWI charges in Texas vary based on your BAC level, whether passengers were in the vehicle, and your prior criminal history. A first-time DWI offense with a BAC of 0.08% to 0.15% is typically charged as a Class B misdemeanor. This carries a potential jail sentence of up to 180 days and a fine of up to $2,000. If your BAC was 0.15% or higher, or if you refused the chemical test, you may face enhanced charges as a Class A misdemeanor, with up to one year in jail and fines up to $4,000.

If you had a child passenger under 15 years old in your vehicle, the charge becomes a felony, regardless of BAC level. This is called intoxication assault with child passenger, and it carries up to two years in prison and fines up to $10,000. Similarly, if your DWI caused injury to another person, you may be charged with intoxication assault, a felony with up to five years in prison. If someone died as a result of your intoxicated driving, you could face intoxication manslaughter charges, carrying up to 20 years in prison.

Beyond criminal penalties, a DWI conviction in Texas results in mandatory driver's license suspension. For a first offense, your license is suspended for 90 days to one year. You may become eligible for a restricted license (occupational license) that allows you to drive for work, school, or medical purposes during the suspension period, though you must file a petition with the court and meet certain requirements. A second DWI within 10 years results in a 180-day to two-year suspension, and a third DWI results in a two-year suspension.

You will also be required to complete a DWI education program, which typically costs between $250 and $500. Installation of an ignition interlock device (IID) may be required, which costs between $1,000 and $2,500 for installation and $50 to $100 monthly for monitoring. A DWI conviction will appear on your criminal record and can affect employment, housing, professional licensing, and insurance rates. According to the Texas Department of Public Safety, a DWI conviction can increase your auto insurance rates by 50% to 100% or more.

Practical Takeaway: The consequences of a DWI conviction extend far beyond court-ordered penalties. Understanding the potential charges and their long-term impact on your life—including employment and financial consequences—emphasizes the importance of taking your case seriously and working with legal representation to explore all possible options.

The DWI Legal Process in Texas: From Arrest to Resolution

The Texas DWI legal process follows several distinct stages. The first stage is the arrest and initial appearance, which must occur within 72 hours of arrest. During this appearance, the judge informs you of your charges, your rights, and the conditions of your release. You will be asked to enter a plea of guilty, not guilty, or no contest. Most defendants enter a not guilty plea at this stage to preserve their rights while they gather information about their case.

The second stage is the discovery phase, during which your attorney receives evidence from the prosecution. This includes police reports, dashcam and body camera footage, breathalyzer calibration records, blood test results, and witness statements. Your attorney will review this evidence to identify any weaknesses in the prosecution's case. Common issues include improper administration of field sobriety tests, faulty breathalyzer equipment, or violation of your rights during the arrest.

The third stage may involve pretrial motions and hearings. Your attorney may file motions to suppress evidence if it was obtained illegally, to dismiss charges if there is insufficient probable cause, or to request other relief. These motions can be critical in a DWI case because they may result in key evidence being excluded from trial, which could lead to the charges being dismissed or reduced.

Many DWI cases are resolved through negotiation between your attorney and the prosecution, resulting in a plea agreement or deferred adjudication. In a plea agreement, you may plead guilty to a
