Understanding Social Security and Immigration Status

How Social Security Works and Who Can Receive It

Social Security is a federal insurance program run by the Social Security Administration (SSA). The program provides monthly payments to workers who reach retirement age, workers who become disabled, and to family members of workers who have passed away. Understanding how Social Security functions is important for anyone planning for retirement or facing unexpected circumstances.

The program operates on a simple concept: workers pay taxes into Social Security during their working years, and these funds support current beneficiaries. When you work and earn wages, your employer takes Social Security tax from your paycheck—currently 6.2% of your earnings. Self-employed individuals pay 12.4%. This money goes into the Social Security Trust Fund, which is used to pay benefits to people currently receiving them.

Social Security provides three main types of benefits. Retirement benefits go to workers age 62 or older who have paid into the system. Disability benefits go to workers under full retirement age who cannot work due to a serious medical condition expected to last at least 12 months. Survivor benefits go to family members of workers who have passed away, including spouses, children, and parents in some cases.

To receive any Social Security benefit, you must have worked and paid Social Security taxes for a certain period. Most people need 40 credits of work history, which usually takes about 10 years to earn. You earn one credit for every $1,770 of wages in 2023 (this amount changes yearly). Some workers may meet requirements through credits earned in different jobs throughout their career.

The amount of your benefit depends on your average earnings over your lifetime. The SSA looks at your highest 35 years of earnings and calculates an average. Workers who earned more money during their careers generally receive higher benefits than those who earned less. Your benefit also depends on the age at which you begin receiving payments—waiting until a later age results in a higher monthly benefit.

Takeaway: Social Security is based on work history and lifetime earnings. Learning how your own work record affects future benefits can help you make informed decisions about retirement timing.

Immigration Status and Social Security: The Basic Rules

Immigration status plays a significant role in Social Security matters. The Social Security Administration has specific rules about who can receive benefits based on citizenship and immigration status. These rules can be complex because they involve both federal immigration law and Social Security regulations.

U.S. citizens are generally the most straightforward category for Social Security purposes. If you were born in the United States or became a citizen through naturalization, you can receive Social Security benefits for which you meet other requirements. You simply need to provide proof of citizenship, such as a birth certificate or naturalization certificate, to the SSA.

Lawful permanent residents—commonly called green card holders—can also receive Social Security benefits if they meet work history requirements. They must show their permanent resident status through a valid green card or other SSA-approved documents. Many green card holders have worked and paid Social Security taxes for years, earning the same credits as citizens.

Noncitizen spouses and family members of Social Security beneficiaries face more restrictions. A noncitizen spouse of a retired or disabled worker may receive spousal benefits, but the rules vary significantly based on the country of residence and specific circumstances. Children of beneficiaries who are not citizens may still receive benefits in some situations.

Some noncitizens with temporary immigration status, such as those with Temporary Protected Status (TPS) or Deferred Action for Childhood Arrivals (DACA) status, may have work authorization and can pay Social Security taxes. However, benefit eligibility depends on specific circumstances and immigration classification. These situations often require individual review by the SSA.

Undocumented immigrants cannot receive most Social Security benefits, even if they have paid taxes. However, the law contains narrow exceptions: a person without legal status can receive benefits under certain family member provisions in specific circumstances, such as being the unmarried child of a deceased worker who had substantial work history.

Takeaway: Immigration status directly affects Social Security benefit options. Understanding your specific status category helps clarify which benefit programs may apply to your situation.

Work Authorization, Taxes, and Benefit Eligibility

Work authorization and Social Security are closely connected. When you have permission to work in the United States—whether as a citizen, permanent resident, or someone with temporary work authorization—you typically must pay Social Security taxes on your wages. Understanding this relationship is important because taxes paid contribute to your work record and future benefit options.

All workers with valid Social Security numbers who earn income must pay Social Security taxes, regardless of immigration status, with very limited exceptions. When you work with proper authorization, your employer reports your wages to the Social Security Administration under your Social Security number. This creates an official record of your earnings and work history.

DACA recipients (young people with Deferred Action for Childhood Arrivals status) represent an important example. They receive work authorization and a valid Social Security number. They pay Social Security taxes like other workers. However, because DACA status is not a permanent immigration status and could theoretically be terminated, questions sometimes arise about their long-term benefit eligibility. Currently, DACA recipients who have paid taxes and meet other requirements may be entitled to certain benefits, but this area involves complex legal questions.

Temporary visa holders in categories like H-1B (specialty workers), L-1 (intracompany transfers), and O-1 (individuals with extraordinary ability) also pay Social Security taxes. If they have worked long enough to earn sufficient credits and later become permanent residents or citizens, they can claim these benefits. The key principle is that taxes paid into the system while work-authorized count toward benefit requirements.

Refugees and asylees represent another group with special considerations. Once granted refugee or asylee status, individuals receive work authorization and can work legally. They pay Social Security taxes like any other worker. After five years as a refugee or one year as an asylee, they may also become eligible for certain federal benefits based on their immigration status, separate from their work history.

Documentation matters significantly. The SSA requires that all Social Security numbers be matched with proper work authorization at the time employment begins. If discrepancies appear between your work record and immigration documentation, the SSA may investigate. This is why keeping accurate records and correcting errors promptly is important.

Takeaway: Taxes paid while work-authorized count toward Social Security eligibility. Documenting your work history accurately protects your future benefit options.

The Social Security Number, Documentation, and Verification

A Social Security number (SSN) is central to how Social Security tracks your work record and manages benefits. Understanding how SSNs work with immigration status can clarify many common questions about benefits and eligibility.

Not everyone receives a Social Security number at birth. U.S. citizens born in the hospital usually receive one automatically, but some citizens born at home did not historically receive automatic SSNs. Noncitizens may receive SSNs only if they have work authorization or other federal benefit eligibility. The Social Security Administration issues SSNs based on documentation proving identity and immigration status.

The SSA requires specific documents when you first request a Social Security number. For U.S. citizens, this typically includes a birth certificate and proof of identity. For noncitizens, requirements depend on immigration status. A permanent resident would provide their green card and passport or travel document. A person on a temporary visa would provide their visa and passport. The SSA verifies these documents with the Department of Homeland Security before issuing a number.

Your Social Security number becomes your identifier for all earnings records. When you work, your employer reports your wages under your SSN. Over time, the SSA builds a record showing how much you earned each year, how many work credits you accumulated, and when you paid into the system. This record determines your future benefit amount and what programs you might access.

Errors in SSA records can affect your benefits. Sometimes names, dates of birth, or immigration status information in SSA databases does not match other government records. The SSA must verify work authorization status for people who want to receive benefits. If there are discrepancies, the SSA may contact you for updated documentation. Correcting these issues quickly protects your ability to receive benefits when you need them.

Marriage, divorce, name changes, and immigration status changes all require updating your SSA record. If you become a permanent resident or citizen, you should notify the SSA so your file reflects your current status. The SSA uses this information when processing benefit requests and determining
