Understanding Section 8 Housing in New York

What Section 8 Housing Is and How It Works in New York

Section 8 is a federal housing program that helps low-income families, elderly people, and people with disabilities afford rental housing. The program gets its name from Section 8 of the Housing Act of 1937. Instead of providing housing directly, Section 8 gives vouchers to people who then use those vouchers to rent apartments or houses from private landlords.

In New York, Section 8 operates through public housing agencies. The largest is the New York City Housing Authority (NYCHA), which manages the program for New York City. Outside the city, regional housing authorities handle the program for their areas. When someone receives a Section 8 voucher, they can search for housing on the private rental market. The voucher covers part of the rent, and the tenant pays the rest.

The way the money flows is important to understand. A tenant with a Section 8 voucher pays 30 percent of their adjusted gross income toward rent. The voucher program then pays the landlord the difference between what the tenant pays and the actual rent, up to a limit set by the program. This limit is called the fair market rent (FMR). In New York City, fair market rents vary by neighborhood and apartment size. For example, as of 2024, a one-bedroom apartment's FMR in Manhattan might be $1,800, while in the Bronx it might be $1,500.

New York has a significant Section 8 presence. As of 2023, there were approximately 200,000 households using Section 8 vouchers across New York State. New York City alone accounts for roughly 100,000 of those households. This makes New York one of the states with the largest Section 8 populations in the country.

The program has specific rules that both tenants and landlords must follow. Landlords cannot discriminate based on race, color, religion, sex, national origin, family status, or disability. The rental property must pass an inspection to ensure it meets housing quality standards. Tenants must follow lease agreements and use the voucher only for the rented unit. Understanding these basic mechanics helps explain why the program has been so widely used in New York for decades.

Practical Takeaway: Section 8 is a rent subsidy program where the government helps pay part of a tenant's rent. The tenant pays 30 percent of their income, and the voucher covers the rest up to a limit. Both tenants and landlords have responsibilities and rights under the program.

Income Limits and Who May Participate

Section 8 has income limits that determine who may participate. These limits change each year and vary by location and family size. In general, the program serves households with income at or below 50 percent of the area median income (AMI). However, most housing authorities prioritize households at or below 30 percent of AMI because funding is limited.

What counts as income includes wages, salaries, Social Security, disability benefits, unemployment benefits, child support, and other regular income sources. Some things do not count, such as food stamps, housing assistance already received, or payments from certain assistance programs. The way income is calculated can affect whether someone's household income falls within the limits.

As of 2024 in New York City, here are approximate area median income figures. These numbers help illustrate the limits for a family of four. The area median income for New York City is roughly $91,000 per year. Fifty percent of that would be around $45,500. Thirty percent would be around $27,300. A family of four earning $45,000 per year might fall within the 50 percent AMI threshold, depending on the specific calculation method used.

Different family sizes have different income limits. A single person has a lower limit than a family of four. A family of eight has a higher limit than a family of four. Housing authorities publish exact income limits for their areas each year. For example, in 2024, a single-person household in New York City might have a limit around $32,000 per year at 50 percent AMI, while a four-person household might have a limit around $51,000.

The program also considers assets in some cases. Most housing authorities have asset limits, though these limits are usually quite high. If a household has more than $100,000 in countable assets (which can include savings, stocks, and other liquid resources), this may affect their participation. However, some assets are excluded, such as the value of a car or a primary residence.

Citizenship and immigration status matter for Section 8. U.S. citizens and certain categories of immigrants may participate. Non-citizens must have eligible immigration status. Undocumented immigrants are not able to participate in the federal Section 8 program, though New York State has created separate housing assistance programs for some immigrants.

Practical Takeaway: Section 8 serves households below 50 percent of the area median income, though most vouchers go to those below 30 percent. Income limits vary by family size and location. The housing authority calculates whether a household's income meets the limits using specific formulas.

The Voucher System and How Rent Payments Work

Understanding how the voucher system works is essential for anyone considering or using Section 8. When someone receives a Section 8 voucher, they do not get cash. Instead, they get authorization to use the voucher with a participating landlord. The voucher document itself describes the terms of the assistance and the rent limits in the household's area.

The tenant's payment obligation is based on 30 percent of their adjusted gross income. The housing authority calculates adjusted income by starting with gross income and subtracting certain deductions. Standard deductions include $400 for each dependent, $400 for elderly or disabled household members, and costs for childcare, medical care, and disability assistance. The result is the adjusted income, and 30 percent of that is what the tenant pays toward rent.

Here is a concrete example. A single parent earns $2,000 per month gross income. The housing authority allows $400 for a dependent child and $200 for childcare costs. The adjusted income is $2,000 minus $600, which equals $1,400. Thirty percent of $1,400 is $420. This tenant would pay $420 per month toward rent. If the fair market rent for a one-bedroom apartment in their area is $1,200, the voucher would pay $780 per month to the landlord (the difference between $1,200 and $420).

The fair market rent (FMR) is the maximum rent that the voucher will cover. The U.S. Department of Housing and Urban Development (HUD) sets these rates based on surveys of actual rent in different areas and for different apartment sizes. In New York City, FMR changes based on the specific community board. A one-bedroom in Community Board 8 in Manhattan has a different FMR than a one-bedroom in Community Board 16 in the Bronx. If a tenant finds an apartment that rents for less than the FMR, they pay 30 percent of their income and the voucher covers the rest. If the apartment rent equals the FMR, they still pay only 30 percent of their income. If the apartment costs more than the FMR, the tenant pays the difference out of pocket, in addition to their 30 percent share.

The voucher is issued for a specific term, typically two years in New York. During this time, the tenant can search for housing. Once they find a unit, the landlord must agree to participate in the program. The housing authority inspects the unit to make sure it meets housing quality standards. If it does, a lease is signed and the assistance begins. At the end of the voucher term, the household may reapply to continue receiving assistance.

Rent increases also have limits under Section 8. If a tenant remains in the same unit, the landlord cannot raise the rent beyond what the lease allows or what the voucher program permits. However, after the lease term ends, the landlord may request a new rent amount, though it must stay within certain guidelines related to fair market rent increases.

Practical Takeaway: Tenants pay 30 percent of their adjusted income toward rent. The voucher pays the rest up to the fair market rent limit. If rent exceeds the limit, the tenant pays the extra amount themselves. Vouchers are typically valid for two years and then households may need to reap
