Learn How the Social Security Fairness Act May Affect Pensions

Understanding the Social Security Fairness Act and How It Works

The Social Security Fairness Act is a proposed change to how Social Security benefits are calculated for people who receive pensions from work that was not covered by Social Security taxes. To understand this potential change, it helps to know what the current rules are and why they affect certain workers.

Currently, two rules reduce Social Security benefits for people who have pensions from government jobs or certain other employment: the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO). These rules have been in place since the 1980s and were created because lawmakers were concerned that people with pensions might receive higher combined benefits than intended. The Social Security Fairness Act would repeal both of these rules, meaning people would no longer face reductions based on their pension income.

As of 2024, an estimated 2.9 million people are affected by WEP, and approximately 750,000 people are affected by GPO. These are workers and their families who have been waiting for potential changes to these rules for decades. Many worked in positions such as teachers, police officers, firefighters, federal employees, and foreign service workers — jobs that did not require Social Security contributions.

The proposed act has been introduced in Congress multiple times. While it has gained bipartisan support, it has not yet become law. Understanding how these current rules work helps explain why this change matters to so many people and their families.

Practical Takeaway: Learn about your own work history to determine whether WEP or GPO might affect you. Review any pension statements you receive from non-Social Security employment to understand your full retirement picture.

The Windfall Elimination Provision (WEP): What It Does to Your Benefits

The Windfall Elimination Provision is a formula that reduces the Social Security benefit amount for people who also receive a pension from work not covered by Social Security. To understand WEP, it's important to know that Social Security replaces a higher percentage of income for lower earners than for higher earners. This is by design — Social Security is meant to provide a stronger safety net for people with lower lifetime earnings.

When someone has a pension from non-covered work (work where they did not pay Social Security taxes), the government assumes they had "hidden" earnings and reduces their Social Security benefit accordingly. The reduction is applied to the "bend point" formula that Social Security uses. In practical terms, this typically means the primary insurance amount — the base amount your benefit is calculated from — is reduced.

The maximum WEP reduction is 50% of the non-covered pension amount. For example, if someone receives a $1,000 monthly pension from a government job where they did not pay Social Security taxes, WEP could reduce their Social Security benefit by up to $500 per month. However, the reduction cannot reduce the benefit below what it would be if Social Security contributions had been made throughout their working years.

WEP affects not just the worker but also family members who receive benefits based on that worker's record. If a parent or spouse is receiving a benefit based on someone's Social Security record, and that person is subject to WEP, the reduction applies to all those family benefits as well. This means the total household impact can be significant.

The Social Security Fairness Act proposes to eliminate WEP entirely. This would mean that people with pensions from non-covered work would receive the full Social Security benefit they earned through their other covered employment, without any reduction based on the pension amount.

Practical Takeaway: If you worked in a job where you did not pay Social Security taxes and now receive a pension from that work, obtain a Social Security benefit estimate from the Social Security Administration to see your current projected benefit amount and understand how WEP may reduce it.

The Government Pension Offset (GPO): Impact on Spousal and Survivor Benefits

The Government Pension Offset is a separate rule that affects spousal and survivor benefits for people who receive pensions from non-covered employment. While WEP affects the worker's own benefit, GPO affects benefits paid to spouses and widows or widowers based on someone else's Social Security record.

Under current GPO rules, if you receive a pension from non-covered government work and you are also entitled to a spousal or survivor benefit from someone else's Social Security record, your spousal or survivor benefit is reduced by two-thirds of your non-covered pension amount. This can result in a dramatic reduction — sometimes to zero.

For example, consider a teacher who never paid Social Security taxes and receives a $2,400 monthly pension. The teacher's spouse is a Social Security worker who will receive a $3,000 monthly benefit. Normally, the non-working spouse might receive a spousal benefit of about $1,500 (50% of the worker's benefit). However, under GPO, the teacher's entitlement to a spousal benefit based on their spouse's work is reduced by two-thirds of their $2,400 pension, or $1,600. Since the spousal benefit would have been $1,500, the reduction would eliminate it completely, leaving the teacher with no spousal benefit.

This situation is particularly difficult for people who worked as teachers, many of whom have a spouse in a different profession who worked under Social Security. When both people retire, the household loses the spousal benefit that would normally be available, significantly reducing household retirement income.

Survivor benefits are affected in the same way. If a person receiving a non-covered pension passes away, their widow or widower may be entitled to survivor benefits based on the deceased's Social Security record. However, if the survivor receives a pension from non-covered work, the survivor benefit is reduced by two-thirds of that pension amount.

The Social Security Fairness Act would repeal GPO, meaning spouses and survivors of workers with non-covered pensions would no longer face benefit reductions based on pension income.

Practical Takeaway: If you are married to someone with a non-covered pension, or if you are a widow or widower in this situation, request a benefit estimate from Social Security that shows both your own benefits and any spousal or survivor benefits you might receive, to understand your complete retirement picture.

Who Is Most Affected by These Pension Rules

Certain groups of workers are disproportionately affected by WEP and GPO because they worked in positions that did not require Social Security contributions. Understanding which workers are affected helps explain why this issue has drawn attention for so long.

Teachers make up a large portion of those affected. Many states, particularly in the Northeast and Midwest, have pension systems for teachers that are separate from Social Security. Teachers in these states spend their entire careers paying into their state pension system rather than Social Security. When they reach retirement, they receive a teacher's pension but have limited or no Social Security record from their teaching work. Some teachers did work other jobs covered by Social Security, but their teaching years — often the majority of their career — do not count toward Social Security.

Federal employees hired before 1984 are also significantly affected. These workers were under the Civil Service Retirement System (CSRS) rather than Social Security. They paid into their federal pension but not into Social Security during their federal employment. While some may have worked other jobs covered by Social Security, the federal years often represent substantial portions of their career.

Police officers and firefighters in certain jurisdictions fall into this category as well. Some municipalities and states have separate pension systems that do not participate in Social Security. These workers pay into local or state pensions instead.

Foreign Service workers, including diplomats and embassy staff, also faced non-covered employment for portions of their careers. Some city and county employees in specific regions worked under pension systems not coordinated with Social Security.

The impact is not evenly distributed geographically. States like Illinois, Massachusetts, Ohio, and Missouri have particularly high numbers of workers affected because of their separate teacher and public employee pension systems. However, nearly every state has some workers affected, and the issue extends to federal employees nationwide.

Additionally, women have been disproportionately affected by GPO because they are more likely to be the spouses receiving reduced benefits based on someone else's work record. In many marriages where one person worked in a non-covered job with a pension, the other spouse worked under Social Security but may not have worked continuously, making them more likely to depend on spousal benefits.
