Learn How Split Sleeper Berth Rules Work for Drivers

What the Split Sleeper Berth Rule Actually Is

The split sleeper berth rule is a federal regulation that changes how truck drivers can count their required off-duty time. Under normal Hours of Service (HOS) rules, drivers must take one continuous 10-hour off-duty break before they can drive again. The split sleeper berth rule offers an alternative: drivers can break that 10-hour requirement into two separate periods, as long as both periods meet specific time requirements.

The Federal Motor Carrier Safety Administration (FMCSA) created this rule to give drivers flexibility while maintaining safety standards. A sleeper berth is the sleeping compartment in a commercial truck. To use this rule, one of the off-duty periods must happen in the sleeper berth, and both periods must be at least 2 hours long. For example, a driver could take a 5-hour break in the sleeper berth during the afternoon, then take another 5-hour break later (either in the sleeper berth or off-duty elsewhere), and both periods would count toward the required 10 hours off.

This regulation applies to drivers of commercial motor vehicles (CMVs) weighing more than 10,001 pounds. It does not apply to all trucking situations. For instance, agricultural transport drivers, certain short-haul operations, and drivers of smaller vehicles may have different rules. The rule specifically addresses what the FMCSA considers a major safety concern: driver fatigue and the need for rest between long driving periods.

The split sleeper berth option is voluntary. Drivers do not have to use it. They can continue taking one continuous 10-hour break if that works better for their schedule or their employer's operations. However, understanding how it works is important because using it incorrectly can result in violations, fines for the driver's company, and potential safety issues.

Practical Takeaway: The split sleeper berth rule is one option for meeting required off-duty time. It allows two separate rest periods instead of one continuous period, provided both are at least 2 hours and one occurs in the truck's sleeper berth. This is a rule, not a benefit program, and drivers should verify their company's policies before using it.

How the Rule Breaks Down: Time Requirements and Combinations

To understand when a driver can legally use the split sleeper berth rule, the specific time combinations matter. The total of both rest periods must equal at least 10 hours. Each individual period must be at least 2 hours. One period must take place in the sleeper berth. The other period can be taken off-duty (outside the truck, not driving) or in the sleeper berth as well.

Here are realistic examples of how this works:

• Scenario 1: A driver takes a 5-hour break in the sleeper berth in the afternoon, then later takes a 5-hour off-duty break at a truck stop restaurant. Both periods count toward the 10-hour requirement.
• Scenario 2: A driver takes a 3-hour break in the sleeper berth, then a 7-hour break in the sleeper berth later. Both periods count, totaling 10 hours.
• Scenario 3: A driver takes a 2-hour break in the sleeper berth (the minimum), then a 8-hour off-duty break at a hotel. The 10-hour requirement is met.
• Scenario 4: A driver cannot use the rule if one period is only 90 minutes, even if the other period is 8.5 hours, because each period must be at least 2 hours.

The rule also specifies what "off-duty" means. Off-duty time is when the driver is not on-duty (driving or doing logbook-recorded work) and is not on-call. Time spent at a truck stop, in a hotel, at a restaurant, or at home all count as off-duty time. Compliance with the split sleeper berth rule depends on accurate record-keeping. Drivers must document these periods in their electronic logging devices (ELDs) or logbooks, clearly showing the times each period started and ended.

The rule also interacts with the 14-hour rule, another key HOS regulation. The 14-hour rule states that a driver has a 14-hour window to complete driving activities; once those 14 hours are used, the driver must take 10 hours off before driving again. The split sleeper berth periods can help reset this window, depending on how the periods are timed and recorded in the ELD.

Practical Takeaway: Both rest periods must be at least 2 hours, total at least 10 hours, and at least one must be in the sleeper berth. Accurately logging these times is critical for regulatory compliance and protecting both the driver and the employer.

State-by-State Differences and Special Cases

While the split sleeper berth rule is a federal regulation that applies across the United States, some states have additional rules or restrictions that drivers need to know about. Federal rules set a baseline, but states may impose stricter requirements. This creates complexity for drivers who operate in multiple states or cross state lines regularly.

Most states follow the federal FMCSA regulations as written. However, a few states have adopted their own HOS rules for intrastate commerce (driving entirely within one state). For example, some states specify different requirements for when sleeper berth time counts or add additional requirements for mandatory rest. Drivers who stay within a single state should research that state's specific regulations, as they may differ from federal rules.

Agricultural and seasonal operations sometimes have exemptions from the split sleeper berth rule, though they must still follow HOS rules in general. Drivers hauling agricultural products during harvest season, for instance, may operate under different rest requirements. Similarly, certain short-haul operations—where drivers return to their base within a short distance and time—may not be able to use the split sleeper berth rule because they operate under different HOS frameworks.

Hazardous materials (HAZMAT) drivers follow the standard split sleeper berth rule, but their trucks have additional safety and documentation requirements. School bus drivers and other specialized commercial drivers may have their own regulations that do not include the split sleeper berth option.

International drivers crossing into Canada or Mexico should note that those countries have their own HOS rules, and the split sleeper berth rule does not automatically apply. A driver who operates internationally must understand and comply with the rules of each country where they drive.

Practical Takeaway: Check both federal and state-specific HOS regulations if you operate in multiple states or under a specialized license category. What works federally may have additional restrictions at the state level. Company safety departments or dispatcher teams often maintain updated information about regional rule differences.

Electronic Logging Devices and Proper Documentation

Since December 2017, the FMCSA has required most commercial truck drivers to use electronic logging devices (ELDs) instead of paper logbooks. ELDs automatically record driving time and must accurately document split sleeper berth periods. Proper use of the ELD is non-negotiable for compliance with the split sleeper berth rule.

When a driver takes a split sleeper berth break, the ELD must clearly show two separate off-duty periods. The device records the start and end time of each period and categorizes it as either sleeper berth or off-duty. Some ELDs have a specific function labeled "split sleeper berth" that makes recording easier and reduces the risk of error. Drivers should learn how their company's ELD system handles this function and use it correctly each time.

Common documentation mistakes that create compliance problems include:

• Recording sleeper berth time as general off-duty time, which may not count correctly toward the HOS requirement
• Failing to log a second period as separate, making it look like one continuous break instead of two distinct periods
• Miscounting the duration of a period, resulting in one period being under 2 hours when combined with the other
• Not recording which period took place in the sleeper berth when both periods involved the sleeper berth
• Recording off-duty time in the wrong order or with
