Learn How DMV Driving Points Affect Your License

Understanding the Point System: How Violations Get Assigned

Every state with a point system tracks driving violations by assigning points to your license when you receive tickets or are convicted of certain traffic offenses. The number of points varies depending on the severity of the violation and your state's specific rules. For example, a minor speeding violation might result in 1-2 points, while reckless driving could mean 4-6 points. A DUI conviction typically carries the heaviest penalties, often 6-15 points depending on the state.

The purpose of the point system is to monitor and discourage unsafe driving behavior. Insurance companies also use point information to calculate your rates, and law enforcement uses it to identify repeat violators who may pose a safety risk on the road. When you receive a traffic citation, the officer documents the violation type. If you pay the fine or are found guilty in court, that violation is reported to your state's Department of Motor Vehicles, which then adds the corresponding points to your driving record.

Different violations carry different point values based on how dangerous they're considered. Here are common violations and their typical point ranges across most states:

• Speeding (1-15 mph over limit): 1-3 points
• Speeding (16-30 mph over limit): 3-6 points
• Speeding (over 30 mph): 6-8 points
• Running a red light or stop sign: 2-4 points
• Improper passing: 3-4 points
• Reckless driving: 4-6 points
• Following too closely: 2-3 points
• Hit and run: 6-8 points
• DUI (first offense): 6-15 points
• Driving with a suspended license: 6-12 points

It's important to understand that points stay on your record for a specific period. Most states keep points for 3-7 years, though serious violations like DUI may remain for 10 years or longer. This means that even after you pay a fine, the violation continues to affect your driving record during this time period.

Practical Takeaway: Review your state's specific point chart on your DMV website to know exactly how many points different violations carry. Check your current driving record regularly through your state's DMV to see what violations are listed against you.

License Suspension and Revocation Thresholds

Once you accumulate a certain number of points, your license becomes subject to suspension or revocation. The threshold varies by state and sometimes by age group. Most states suspend your license when you reach 12-15 points within a specific timeframe, usually one year. For example, California suspends licenses at 4 points in 12 months, while New York uses a threshold of 11 points in 18 months. Younger drivers often face stricter thresholds because they have less driving experience.

There's an important distinction between suspension and revocation. A suspended license means you temporarily lose your driving rights for a set period—often 30 days to 6 months for a first suspension. After that suspension period ends, your license is automatically restored if you meet any requirements (like paying a reinstatement fee). A revoked license is more serious. Revocation means your license is permanently cancelled and you must go through a lengthy process, sometimes waiting years before you can even request a new one. Revocation typically happens after multiple suspensions or for serious violations like multiple DUIs.

Different states have different suspension schedules based on how many points you accumulate:

• First suspension (typically at 12-15 points): 30-90 days
• Second suspension (within 1-3 years of first): 3-6 months
• Third suspension (within 1-3 years): 6 months to 1 year
• After multiple suspensions: License revocation for 1-5+ years

The suspension notice is typically mailed to your address on file. You'll receive information about when your suspension begins and ends, what the requirements are to reinstate your license, and what fees you owe. During a suspension period, you cannot legally drive. Driving with a suspended license is a separate criminal offense that carries steep fines and can result in additional points on your record.

Some states offer a "hardship license" or "restricted license" option during a suspension period. This limited license may allow you to drive to work, school, or medical appointments only. You would need to request this through your DMV and demonstrate genuine hardship. Not all states offer this option, and not all reasons for suspension qualify.

Practical Takeaway: Calculate your current point total and find your state's suspension threshold. If you're approaching that threshold, focus on not adding any more points. Know that you can check your point balance online through most state DMV websites or by contacting them directly.

How Points Impact Insurance Rates and Coverage

Insurance companies view points on your driving record as evidence that you're a higher-risk driver. When you have accumulated points, your insurance rates will typically increase significantly. Research shows that a single 3-point violation can increase your car insurance premium by an average of 10-25%, while a 6-point violation might raise it by 25-50%. A serious violation like a DUI can increase your rates by 100-400% or more.

Insurance companies access your driving record through the Motor Vehicle Record (MVR) system, which is separate from your official DMV record but contains similar information about violations. When you apply for new insurance or renew your policy, the company reviews this record. They assign a risk rating based on what they find, and this rating determines your premium. Some insurers also use an algorithm that factors in the recency of violations—a violation from last month will hurt your rate more than one from three years ago.

The impact on your rates varies by violation type. Here's what typical rate increases look like:

• Minor speeding (1-5 mph over): 5-15% increase
• Moderate speeding (6-15 mph over): 15-25% increase
• Major speeding (16+ mph over): 25-50% increase
• Reckless driving: 40-75% increase
• Running red light/stop sign: 20-40% increase
• At-fault accident: 20-50% increase
• DUI (first offense): 100-400% increase
• Multiple violations: Cumulative or additional increases

Some insurance companies may actually drop you entirely if your record becomes too risky. You would then need to shop for insurance in the "high-risk" or "assigned risk" market, where premiums are substantially higher. If you're dropped by your current insurer, they're required to provide you with a written reason and information about other insurance options.

Points stay on your driving record for several years, which means your insurance rates remain elevated during that entire period. However, once the points age and eventually fall off your record, you should see your rates drop. Some insurers offer accident forgiveness programs or safe driving discounts if you go a certain period without violations, but these programs have specific terms and aren't available everywhere.

Practical Takeaway: After receiving a violation, contact your insurance company to understand how it will affect your specific premium. Shop around with multiple insurers, as they rate violations differently—one company's 30% increase might be another's 50% increase. Ask about discounts for safe driving courses or defensive driving classes.

Point Reduction Through Defensive Driving Courses

Many states allow drivers to reduce points on their record by completing an approved defensive driving course (also called traffic school or driver improvement course). The number of points you can remove varies by state—some allow removal of 2-4 points, while others permit removal of up to half of your accumulated points. You can typically remove points only once every 12-18
