Learn About Your Options After a Car Accident

Understanding Your Immediate Steps After a Car Accident

The first moments after a car accident are critical. What you do in the immediate aftermath can affect your health, safety, legal standing, and insurance claims. Many people don't know where to begin when they're shaken up from a collision, and that confusion can lead to missed opportunities to document what happened.

Your first priority should always be safety. If you're able to move and it's safe to do so, turn on your hazard lights and move your vehicle out of traffic if possible. If you can't move your vehicle or if doing so would cause further injury, stay where you are and wait for help. Call 911 if anyone appears injured, even if injuries seem minor. According to the National Highway Traffic Safety Administration, about 42,514 traffic fatalities occurred in 2022 in the United States, with many accidents resulting in serious injuries that aren't immediately obvious.

Once you've ensured safety, you should document the scene. Use your phone to take photographs of all vehicle damage, the accident scene, road conditions, traffic signs, and the positions of the vehicles involved. These photos become important evidence if disputes arise later. Take photos from multiple angles and include wide shots that show the overall scene. If there were witnesses, get their names and phone numbers before they leave—witnesses often disappear, and their accounts can be valuable later.

Exchange information with the other driver(s) involved. Get their full name, phone number, address, driver's license number, license plate number, vehicle make and model, and insurance company information. Write down the police report number if an officer files one at the scene. If the accident involved property damage only and no injuries, you may not need to call police in some states, but checking your local laws is important.

Practical takeaway: Create a checklist on your phone or keep a small notepad in your glove compartment that lists information to gather after an accident. Staying organized during a stressful moment helps ensure you don't forget important details.

How Insurance Claims Work After an Accident

After a car accident, your insurance company plays a central role in handling damages and liability. Understanding how this process works can help you navigate it more effectively. Most people have either liability insurance, which covers damage you cause to others, or comprehensive coverage, which covers damage to your own vehicle from various causes including collisions.

When you file a claim, your insurance company assigns an adjuster to investigate the accident. The adjuster's job is to determine what happened, assess the damage, and decide how much the insurance company will pay. According to the Insurance Information Institute, the average auto insurance claim takes between 15 to 30 days to process, though complex claims may take longer. During this time, the adjuster may contact you, the other driver, police, and witnesses to gather information.

You'll need to provide your insurance company with several pieces of information to file a claim. Have ready your policy number, the accident date and time, the location, a description of what happened, photos of the damage, the other driver's information if applicable, the police report number, and contact information for any witnesses. Many insurance companies now allow you to file claims through their mobile apps, which can be faster than calling.

Understanding your deductible is important. Your deductible is the amount you pay toward repairs before insurance coverage kicks in. If you have a $500 deductible and your repairs cost $3,000, you pay $500 and insurance pays $2,500. Higher deductibles mean lower monthly premiums, but they cost you more out-of-pocket when accidents happen. Some states also have specific requirements about how insurance handles accident claims, so knowing your state's regulations helps.

If the accident was someone else's fault, their liability insurance should cover your damages. However, getting payment from another person's insurance company can take longer than filing with your own. This is called a third-party claim. Your own insurance company may pay for repairs and then pursue reimbursement from the at-fault party's insurer, or you may need to work directly with their adjuster.

Practical takeaway: Keep your insurance policy documents and agent's contact information in an easily accessible place. When filing a claim, be factual and detailed in your description of what happened, and keep records of all communications with your insurance company.

Medical Care and Injury Documentation

Many people don't realize they're injured immediately after an accident. Adrenaline can mask pain, and some injuries develop hours or even days later. According to the Centers for Disease Control and Prevention, motor vehicle crashes are a leading cause of nonfatal injury in the United States, with some injuries causing long-term complications. Seeking medical attention promptly is important both for your health and for any potential claims.

Even if you feel fine, getting a medical evaluation after an accident is wise. Visit an urgent care center or emergency room if you have any concerns about injuries. Some common accident-related injuries include whiplash, back injuries, internal injuries, and head trauma. A doctor's records create an official document linking your injuries to the accident, which becomes important if you later pursue compensation for medical expenses.

Keep detailed records of all medical care related to the accident. Save bills, prescriptions, test results, and doctor's notes. Document any ongoing symptoms, pain levels, or limitations you experience. If you're prescribed physical therapy, keep attendance records and note any progress or setbacks. Take photos of visible injuries like bruises or cuts, as these can fade and become difficult to prove later.

If your injuries prevent you from working, keep records of lost wages. Get a letter from your employer stating the dates you missed work and your normal pay. These lost wages may be recoverable in a settlement or court case. The same applies if you need to hire someone to do household tasks you normally do yourself due to injuries—keep receipts and documentation.

Be cautious about posting on social media regarding your accident or injuries. Insurance companies and opposing parties monitor social media, and posts can be used to argue that your injuries are less severe than claimed. Similarly, be careful what you say to others about the accident; stick to facts and avoid admitting fault or making statements that could be misinterpreted.

Practical takeaway: Create a medical file with all accident-related documents organized by date. Record your symptoms and pain levels in a journal, as this documentation becomes valuable if you later need to demonstrate the accident's impact on your life.

Understanding Liability and Fault Determination

One of the most important questions after an accident is: who was at fault? Fault determination affects which insurance company pays and whether you might face personal liability. Understanding how fault works can help you navigate conversations with insurance companies and law enforcement.

In most states, fault is determined based on traffic laws and the actions of the drivers involved. For example, if a driver ran a red light and hit you, they're generally at fault because they violated traffic law. If you were texting and drifted into another lane, causing a collision, you would likely be found at fault. Some accidents involve shared fault, where both drivers contributed to the accident. These are handled under "comparative negligence" or "comparative fault" laws.

Different states have different rules about shared fault. In "pure comparative negligence" states, you can recover damages even if you're 99% at fault, though your recovery is reduced by your percentage of fault. In "modified comparative negligence" states, you can only recover if you're less at fault than the other party (usually 50% or less). Some states follow "contributory negligence," meaning if you're found any percentage at fault, you cannot recover damages. Knowing your state's rules matters if you're pursuing a claim for your injuries or damages.

Police accident reports typically include an officer's assessment of fault, but this is not always binding. Insurance companies conduct their own investigations. They review the accident scene, look at photos and damage patterns, review police reports, interview witnesses, and analyze statements from both drivers. This investigation takes time, which is why insurance companies sometimes initially say they're "investigating" rather than immediately determining fault.

If you disagree with the fault determination, you have options. You can provide additional evidence to your insurance company, such as witness statements or additional photos. If the other party's insurance company denies your claim based on fault, you can file a complaint with your state's insurance commissioner. You can also explore legal action, though this typically involves consulting with an attorney.

Practical takeaway: When reporting an accident to police or insurance, stick to facts without assigning blame. Say "I was stopped at a red light when the other vehicle struck me
