Understanding the Second Chance Act: What It Is and Why It Matters

The Second Chance Act is a federal law passed in 2007 that focuses on helping people who have been incarcerated return to their communities successfully. The law recognizes that reentry—the process of leaving prison or jail and rebuilding life on the outside—is complicated and challenging. Without proper support, people face higher risks of returning to crime and going back to prison.

The act created funding programs and policies designed to reduce recidivism, which is the rate at which formerly incarcerated people commit new crimes and return to the criminal justice system. According to the U.S. Bureau of Justice Statistics, about 68% of state prisoners released in 2005 were arrested again within three years. This statistic shows why reentry support matters: helping people avoid criminal activity benefits individuals, families, and communities.

The Second Chance Act operates through grants that fund organizations and programs across the country. These grants go to nonprofit organizations, government agencies, and community groups that provide services to people reentering society. The law also established a new federal agency position—the Deputy Attorney General for Reentry—to coordinate reentry efforts at the national level.

The core idea behind the act is that successful reentry requires multiple types of support working together. A person leaving prison might need housing, job training, mental health treatment, substance abuse counseling, and family support all at the same time. The Second Chance Act encourages programs to coordinate these services rather than treating them as separate issues.

Practical takeaway: Understanding the Second Chance Act helps explain why various reentry programs exist in communities nationwide. These programs are not random charity efforts but part of a coordinated federal strategy to support successful community reentry.

The Main Programs Funded Under the Second Chance Act

The Second Chance Act created several distinct grant programs that fund different types of reentry services. Each program targets specific needs or populations, and understanding these categories helps clarify what types of organizations receive federal funding for reentry work.

The Reentry Research and Demonstration Grants program funds organizations that test new approaches to reentry. These grants support pilot programs that try innovative methods, measure whether they work, and share results with other communities. For example, some programs test whether intensive case management—having one person coordinate all services for an individual—works better than having people navigate multiple agencies on their own. Others experiment with peer mentoring, where formerly incarcerated individuals help newly released people.

The Comprehensive Offender Reentry and Recidivism Reduction Grants fund programs that provide direct services to people reentering communities. These programs might offer job training, substance abuse treatment, mental health counseling, housing support, or family reunification services. Organizations applying for these grants must show how they will measure success and demonstrate that their services target people most likely to reoffend.

The Mentoring Grants for Offenders Released from Incarceration program specifically funds mentoring relationships between formerly incarcerated individuals and people reentering society. Research shows that mentors who have lived through reentry themselves often provide valuable guidance. A mentor might help someone navigate job applications, explain how to handle discrimination, or provide emotional support during difficult transitions.

Additional programs fund family services, housing support, employment initiatives, and programs specifically for women, juveniles, and veterans. The Reentry Employment Opportunities program, for instance, helps people gain job skills and connects them with employers willing to hire individuals with criminal records.

Practical takeaway: The Second Chance Act funds multiple program types addressing different reentry needs. A person reentering society in any community might potentially connect with these federally funded services through local organizations.

Employment and Job Training Programs

Employment is one of the strongest predictors of successful reentry. People who find stable jobs are significantly less likely to return to prison. However, people with criminal records face substantial barriers to employment. Many employers will not hire individuals with records, and some jobs are legally closed to people with certain convictions.

Second Chance Act employment programs work to overcome these barriers. These programs typically offer job training in high-demand fields—areas where employers are actively hiring and where wages support self-sufficiency. Common training areas include construction trades, healthcare support, information technology, and manufacturing. Programs provide classroom instruction, hands-on training, and sometimes industry certification that makes graduates more marketable to employers.

Beyond skill training, these programs provide job placement support. Case managers work with individuals to develop resumes, practice job interviews, and identify employers known to hire people with records. Some programs create direct connections between trainees and hiring companies. For example, a construction training program might partner with local contractors who have committed to hiring program graduates.

The programs also address what's called "banworking"—the practice of employers automatically rejecting applications from people with criminal records. Some Second Chance Act programs work directly with employers to change these practices. They provide training to hiring managers about giving people with records fair consideration and demonstrate how individuals can become reliable, productive employees.

Data from reentry employment programs shows measurable results. Programs that combine job training with supportive services report employment rates between 50% and 75% for program participants within six months of program completion. Participants who find employment report higher earnings and greater stability than those who do not engage in employment services.

Practical takeaway: Employment programs funded through the Second Chance Act exist in many communities and focus on practical job skills in fields that are actively hiring. These programs recognize that stable employment is central to successful reentry.

Housing, Mental Health, and Substance Abuse Support

Stable housing is essential for successful reentry. People who leave prison without housing are at much higher risk of returning to incarceration. Yet finding housing is extremely difficult for people with criminal records. Many landlords refuse to rent to individuals with records, and housing costs in many communities consume much of the limited income available to someone just released from prison.

Second Chance Act housing programs take several approaches. Some programs provide direct financial support to help people pay deposits, first month's rent, or emergency housing costs. Others operate transitional housing facilities where people can stay while they stabilize their lives and find permanent housing. These transitional facilities typically provide supportive services along with housing—case management, job training, and life skills education.

Mental health and substance abuse issues are closely linked to both incarceration and reoffending. According to the Department of Justice, more than half of state and federal prisoners have a mental health condition, and many also struggle with substance abuse. However, access to treatment for these conditions is often limited. Many communities lack enough mental health and addiction treatment providers, and people with limited income struggle to afford care.

Second Chance Act programs addressing mental health and substance abuse provide treatment services—including therapy, medication management, and peer support groups—often at reduced cost or free. Integrated treatment approaches address both substance abuse and mental health together, recognizing that these conditions frequently occur together and interact. Some programs employ peer support specialists—individuals with lived experience in recovery—who work alongside clinical staff to provide encouragement and practical guidance.

Successful programs coordinate housing, mental health treatment, and substance abuse services together. Someone might access housing through one program while receiving substance abuse counseling and mental health therapy through the same organization or through partner agencies. This coordination reduces the burden on the individual and increases the likelihood that services will be used consistently.

Practical takeaway: Housing, mental health, and substance abuse support are interconnected services that second chance programs recognize as crucial to reentry success. These services are often available through coordinated programs rather than requiring individuals to navigate multiple separate agencies.

Family Reunification and Community Support Services

Incarceration disrupts families. Children may have grown significantly during a parent's imprisonment, and family relationships may be damaged or disconnected. Yet family support is one of the strongest factors promoting successful reentry. People who maintain strong family connections are more likely to avoid reoffending and to rebuild stable lives.

Second Chance Act family reunification programs help people restore these critical relationships. Some programs provide counseling that helps families understand the reentry process and work through the emotional challenges of reconnection. Programs might offer parenting classes for parents returning from incarceration, helping them reestablish their role in their children's lives in healthy ways.

Communication support is another key service. Family reunification programs may help pay for phone calls or video visits while someone is still incarcerated, helping maintain connections. Once released, programs might support family visits and gatherings, recognizing that travel costs and logistics can be barriers to staying connected.

Child welfare represents a particular concern in reentry.
