Learn About Section 8 Housing Options in North Dakota

Understanding Section 8 Housing in North Dakota

Section 8 is a federal housing program that helps low-income individuals and families pay rent. The program gets its name from Section 8 of the Housing Act of 1937. Instead of giving money directly to people, the government gives money to landlords on behalf of renters who participate in the program. This arrangement means that participating landlords agree to rent their properties to Section 8 tenants at rates the government has determined are fair for that area.

In North Dakota, the Section 8 program is managed by public housing authorities (PHAs) in different regions across the state. These local authorities receive federal funding and oversee how the program works in their communities. The program focuses on helping people find safe, sanitary housing in the private rental market, rather than living in government-owned housing projects.

The basic way Section 8 works is straightforward: a tenant pays a portion of their income toward rent (typically around 30 percent), and Section 8 pays the landlord the remaining amount, up to a maximum set by the government for that area. This maximum is called the Fair Market Rent (FMR). For example, if a one-bedroom apartment's FMR in Bismarck is $800 per month, and a tenant's income-based rent share is $200, Section 8 would pay the landlord $600.

North Dakota has several local housing authorities that administer Section 8. These include authorities in Bismarck, Fargo-Moorhead, Williston, and other cities. Each authority maintains its own waiting list and has different timelines for when people might receive assistance. Some areas have longer wait times than others due to funding levels and demand in that region.

Practical takeaway: Section 8 in North Dakota works through local housing authorities, not directly from the state. Finding the right authority for your area is the first step to learning more about the program.

Income Limits and Rent Calculations in North Dakota

Section 8 program participation depends partly on household income. The program serves households at or below 80 percent of the area median income (AMI). However, many local authorities prioritize serving households at 30 percent of AMI or below, meaning the lowest-income people in the community. Understanding these income thresholds helps you know whether you might be considered for the program.

In North Dakota, income limits vary by location and household size. For instance, in Bismarck, a household of four might have an income limit around $52,000 annually, while in a rural county, the limit might be lower. The state's median household income of approximately $75,000 means that many North Dakota residents fall within the income ranges the program serves. These figures change annually, so checking with your local housing authority gives you current information for your area.

When calculating how much rent a Section 8 tenant pays, the program uses what is called a "tenant-based voucher." The tenant typically pays 30 percent of their monthly adjusted income toward rent. Adjusted income means gross income minus certain deductions for things like medical expenses for elderly or disabled household members, or childcare costs. This calculation means that someone earning $1,500 per month might pay around $450 in rent, with Section 8 making up the difference to the landlord.

The Fair Market Rent (FMR) sets a ceiling on how much Section 8 will pay. The U.S. Department of Housing and Urban Development (HUD) studies rental markets in different areas and sets these rates. North Dakota's FMR amounts tend to be lower than national averages, reflecting the state's lower cost of living. For example, a two-bedroom apartment in rural North Dakota might have an FMR of $750, while a similar unit in Fargo might be $950.

Practical takeaway: Your rent contribution depends on your income, and the program has income limits based on where you live. Understanding these limits helps you understand whether the program might work for your situation.

The Section 8 Waiting List and Timeline Process

Nearly all Section 8 programs in North Dakota maintain waiting lists. These lists exist because demand for housing assistance exceeds available funding in most areas. A waiting list is simply a record of people who have submitted their information to a housing authority and are waiting for their name to come up for potential program participation. The wait time varies dramatically by location and can range from months to several years.

In Bismarck, the waiting list has occasionally been closed to new applications when it reaches a certain size. Fargo-Moorhead has faced significant demand, with wait times that have stretched multiple years. Smaller communities in North Dakota often have shorter waiting lists, and some areas have opened and closed their lists depending on funding availability. Checking your local housing authority's website or calling directly reveals the current status of their waiting list and whether they are currently taking new names.

The process of getting on a waiting list typically involves contacting your local public housing authority and providing basic information about your household. This information usually includes household size, income, and contact details. The housing authority then places your name on the list in the order your request was received. When funding becomes available and your name approaches the top of the list, the authority contacts you for additional steps.

Once an authority calls you from the waiting list, the timeline moves forward. You will typically need to provide documentation of your income (pay stubs, tax returns), proof of identity, and verification that household members are U.S. citizens or have eligible immigration status. You will also need to find a rental property with a landlord willing to participate in Section 8. The housing authority then inspects the property to ensure it meets housing quality standards. This entire process from being contacted to signing a lease typically takes several weeks to a few months, depending on how quickly you can gather documents and find housing.

Practical takeaway: Getting on a waiting list is usually free and simple, but understand that wait times vary greatly by location in North Dakota, and there is no guarantee about when or if you will be contacted.

Housing Quality Standards and Property Requirements in North Dakota

Section 8 housing must meet specific safety and quality standards. These standards exist to protect tenants and ensure that public money goes toward housing that is truly safe and livable. North Dakota housing authorities conduct inspections based on HUD's Housing Quality Standards (HQS). These standards cover structural integrity, systems and appliances, sanitation, and safety.

Structural requirements include that the roof must not leak, walls and ceilings must be in good condition, floors must be safe and sanitary, and the foundation must be sound. Windows and doors must close and lock properly. Stairs, railings, and porches must be structurally safe. The property must have adequate weatherproofing to protect residents from the elements—important in North Dakota's harsh winters.

Systems and appliances must work properly. This includes a working heating system (critical for North Dakota), plumbing that functions without leaks, and electrical systems that are safe. A refrigerator and stove are required in units. If utilities are included in the rent, the landlord must pay for them; if the tenant pays, the unit must have separate utility meters or a reasonable method of calculating the tenant's share.

Sanitation standards require that the unit be clean and free of pest infestation, rodents, or vermin. Bathrooms and kitchens must have hot and cold running water. The unit must have at least one working toilet, one sink, and one bathtub or shower. Lead-based paint hazards must be addressed in older properties. Smoke detectors and carbon monoxide detectors must be present and working.

When a property fails inspection, the landlord is given a timeframe to fix the problems before the property can be approved for Section 8. Common issues include missing smoke detectors, needed paint touch-ups, plumbing leaks, or pest problems. Once repairs are completed, the housing authority re-inspects. If a landlord cannot or will not make repairs, the property cannot be used for Section 8, and the tenant must find different housing.

Practical takeaway: Section 8 housing in North Dakota must pass safety inspections. This protects you, but it also means not all rental properties will qualify, and landlords must be willing to maintain their properties to standard.
