Learn About Property Legal Descriptions

What Is a Legal Property Description?

A legal property description is an official written account of exactly where a piece of land or property is located. It's different from a street address like "123 Main Street" because it uses precise measurements and boundaries to define the property in legal terms. Think of it as the property's fingerprint—it's unique and specific enough that no other property should have the identical description.

Legal descriptions appear on deeds, mortgages, tax records, and property surveys. They exist because street addresses alone aren't detailed enough for legal purposes. A street address tells you which house, but a legal description tells you the exact dimensions, boundaries, and location relative to fixed points in the area. This matters enormously when property changes hands, when disputes arise about where one property ends and another begins, or when governments need to assess property taxes.

Every piece of real estate in the United States has a legal description. Whether you own a small residential lot or a large commercial building, your property has one. These descriptions have been in use for centuries and follow specific rules that vary by state and local government. Understanding how they work helps you grasp important property documents and makes it easier to research property history or boundaries.

Legal descriptions are created by licensed surveyors who use specialized equipment and mathematical calculations. The description they create becomes the official record. When you buy a house, the deed you receive includes the legal description. If you ever refinance a mortgage or take out a home equity loan, that document will also reference your property's legal description. Banks and lenders require it because it proves exactly what property secures the loan.

Practical Takeaway: Locate your property's legal description by checking your deed, mortgage documents, property tax statement, or county assessor's website. Keep this information accessible for reference, as you'll need it if you ever refinance, sell, or dispute your property boundaries.

The Three Main Systems for Describing Property

The United States uses three primary systems for creating legal descriptions. These systems developed at different times and in different regions, so which one applies to your property depends on where you live. Understanding these systems helps explain why some descriptions look completely different from others.

The oldest system is called the metes and bounds method. "Metes" refers to distances, and "bounds" refers to boundaries. This system describes a property by starting at a known point and then giving directions and distances around the entire perimeter. A metes and bounds description might say something like "beginning at the iron stake at the northwest corner, then south 247 feet along the east line of Elm Street, then east 402 feet, then north 247 feet, then west 402 feet back to the point of beginning." This system was used widely in the original thirteen states and in many eastern and southern states today. It's very old-fashioned but still legally valid.

The second system is the rectangular survey system, also called the Public Land Survey System (PLSS). This system divides land into a grid pattern. It uses townships (which are 6 miles by 6 miles), ranges (columns running north-south), sections (which are 1 mile by 1 mile), and further subdivisions. A PLSS description might look like "Section 14, Township 3 North, Range 2 West of the Third Principal Meridian." This system covers most of the land west of the Mississippi River and parts of the east. It's more organized and easier to reference than metes and bounds.

The third system is the lot and block method. This system is used in subdivisions and urban areas. When a developer creates a neighborhood, they divide the land into numbered lots and blocks. The description simply refers to these numbers along with the subdivision name. For example: "Lot 7, Block 12, Greenwood Heights Subdivision." This is the simplest system and the easiest for most people to understand.

Practical Takeaway: Look at your property's legal description to identify which system describes your property. This tells you how your local government organizes land records and helps you understand documents related to your property.

Understanding Metes and Bounds Descriptions

Metes and bounds descriptions create boundaries by walking around the perimeter of a property with directions and distances. They work well for irregularly shaped properties and for land that doesn't fit neatly into grids. However, they can be confusing and prone to errors, which is why they're less common in newly developed areas.

A complete metes and bounds description follows a specific format. It always begins at a starting point, often called the "point of beginning" (POB). This starting point is tied to something permanent and identifiable, like a monument, a street intersection, a survey marker, or a natural feature like a river or tree. The description then moves around the property in a clockwise direction, giving both the direction (north, south, east, west, or degrees of compass) and the distance in feet or chains for each side. When you follow all the directions and distances, you should end up back where you started.

Example: "Beginning at a concrete monument at the southeast corner of the intersection of Main Street and Oak Avenue, then north along the east line of Oak Avenue 325 feet to a steel pin, then east 175 feet to a granite marker, then south 325 feet to a point on Main Street, then west along Main Street 175 feet back to the point of beginning." This description creates a rectangle. More complex properties might have many more sides and directions.

Metes and bounds descriptions sometimes reference natural boundaries. You might see language like "then along the meanders of Willow Creek" or "then along the ridge line to a large oak tree." These natural features can shift over time, which occasionally causes disputes. When a creek floods and changes course, does the property boundary move with the creek? These questions sometimes end up in court. Modern surveys try to use more permanent markers to avoid this problem.

One challenge with metes and bounds is that small measurement errors can compound. If each side's measurement is off by just a few inches, by the time you've gone around the entire property, you might not end up exactly where you started. Professional surveyors use precise equipment to minimize these errors, and they note what they find when reality doesn't quite match the old description.

Practical Takeaway: If your property description uses metes and bounds language, you can verify its accuracy by hiring a surveyor. A survey shows exactly where your property boundaries actually are, which is especially important if you're planning construction or if disputes arise with neighbors.

The Public Land Survey System Explained

The Public Land Survey System (PLSS) is a standardized grid-based method used across most of the United States west of the Ohio River, plus parts of Alabama, Florida, and Mississippi. It was created by Thomas Jefferson and others in 1785 to organize the vast western territories in an orderly way. The system is mathematically precise and makes it easy to reference properties without lengthy descriptions.

The PLSS divides land using several layers of organization. At the largest level are principal meridians (running north-south) and baselines (running east-west). These major lines create a framework for the entire region. For example, the "Third Principal Meridian" passes through Illinois and Indiana. Different areas of the country reference different principal meridians.

Moving to the next level, the system divides land into ranges and townships. Ranges run north-south and are numbered east or west of the principal meridian. Townships run east-west and are numbered north or south of the baseline. A township is 6 miles by 6 miles, creating a square that covers 36 square miles. A typical township is identified by its number and direction from the baseline and principal meridian.

Within each township, the land divides into 36 sections, each 1 mile by 1 mile (640 acres). Sections are numbered 1 through 36 in a specific pattern, starting at the northeast and moving west, then starting over at the southeast of the next row. Further subdivision creates quarter sections (160 acres) and quarter-quarter sections (40 acres). A PLSS legal description might read: "The Southeast Quarter of the Northwest Quarter of Section 12, Township 5 North, Range 3 West of the Third Principal Meridian, containing 40
