Learn About Probate Filing Deadlines After Death

Understanding Probate and Why Filing Deadlines Matter

Probate is the legal process that happens after someone dies. It involves validating their will (if one exists), identifying their assets, paying their debts and taxes, and distributing what remains to heirs and beneficiaries. Think of it as the court-supervised system for wrapping up a person's financial and legal affairs.

Filing deadlines in probate are not optional suggestions—they are legal requirements set by state law. Missing these deadlines can result in serious consequences, including loss of certain rights, rejection of claims, penalties, or even removal of the person managing the estate (called an executor or personal representative). Each state sets its own rules about when documents must be filed and what notifications must be sent to beneficiaries and creditors.

The probate process typically begins when someone files the death certificate and the will (if there is one) with the local probate court. The court then issues documents—such as "Letters Testamentary" or "Letters of Administration"—that give the executor legal authority to act on behalf of the estate. From that moment forward, a series of deadlines starts ticking. These deadlines cover everything from notifying interested parties to filing tax returns to settling the estate.

Understanding these deadlines matters because they protect everyone involved. Creditors need to know how long they have to make claims against the estate. Beneficiaries need to know when they can expect distributions. The executor needs clear guidance on what must happen and when. State courts use these deadlines to keep the probate process moving and to prevent indefinite delays.

Practical Takeaway: View probate deadlines as a roadmap for the entire process. Knowing which deadlines apply to your situation—whether you are an executor, beneficiary, or creditor—helps you understand what to expect and when.

Key Deadlines: Filing the Will and Opening Probate

The very first deadline in probate involves filing the will with the court. In most states, a will must be filed with the probate court within a specific time frame after the person's death—often between 10 and 30 days, though this varies by location. Some states require it "without unnecessary delay," while others give executors up to several months. Failing to file the will promptly can result in the court treating the estate as if no will exists, which means state intestacy laws determine who inherits, not the wishes stated in the will.

Along with the will, the executor typically must file a "Petition to Probate" or similar document that formally asks the court to open the probate case and recognize the executor's authority. This petition contains information about the deceased person, the will, and the executor. Some states require this petition to be filed at the same time as the will; others allow more time. The court reviews these documents and, if everything is in order, issues official documentation granting the executor authority to act.

The timing of opening probate matters because it starts the clock on many other deadlines. For example, creditors' claims periods typically begin when probate is officially opened. If probate is not opened on time, creditors might claim they were never properly notified and pursue claims against beneficiaries directly, potentially creating personal liability for those who already received distributions.

In cases where someone dies without a will (called dying "intestate"), a family member or interested party must still petition the court to open probate and request appointment as administrator. This process is similar but typically requires proof that the person died without a will and documentation of family relationships to establish who has priority to serve as administrator under state law.

Practical Takeaway: If you are an executor, locate the will and the person's death certificate immediately, then contact the probate court in the county where the person lived to learn the specific filing deadline and required documents in your state.

Notifying Heirs, Beneficiaries, and Creditors: Statutory Deadlines

Once probate is opened, state law requires that heirs, beneficiaries, and creditors be formally notified. These notifications must happen within specific timeframes—commonly within 10 to 30 days of the probate case opening, though again this varies by state. The notification serves multiple purposes: it informs people that the probate process has begun, tells them who the executor is, explains how to contact the court, and sets deadlines for creditors to submit claims.

Heirs are people who would inherit under state intestacy law if there were no will. Beneficiaries are people named in the will. Some people may be both. The executor must provide these individuals with a copy of the will (if one exists), information about the probate case, and their rights. Failing to provide proper notice can give beneficiaries the right to contest the executor's actions later or even remove the executor from the case.

Creditor notification is equally important. The executor must publish a notice in a local newspaper (in most states) announcing that creditors have a set period—typically between 4 months and 1 year—to file claims against the estate. The exact period depends on state law and whether the creditor can be personally served with notice. If a creditor does not file a claim within the deadline, they generally lose the right to collect from the estate, though beneficiaries who received distributions cannot typically be pursued personally for debts that were not paid.

The practical effect of these notification deadlines is that an executor cannot simply pay bills and distribute assets whenever they wish. They must follow proper notice procedures, wait for the creditor claim period to expire, and only then pay verified claims and distribute what remains. This protects beneficiaries by ensuring that known debts are paid from estate assets before distribution, rather than creating a situation where beneficiaries must later repay creditors.

Practical Takeaway: If you are an executor, work with the probate court or an attorney to prepare proper notifications and publish required notices in a timely manner. Keep copies of all notifications and publications for your records, as you may need to prove to the court that proper notice was given.

Tax Filing Deadlines: Federal and State Requirements

The estate itself may owe federal income taxes, state income taxes, and federal estate taxes, depending on its size and the deceased person's income. These have separate deadlines from the probate process itself, and missing them can result in penalties and interest charges paid from estate funds, reducing what beneficiaries receive.

The final individual income tax return for the deceased person is typically due on the same date as any living person's return—usually April 15 of the year following death. However, if the person died before that date, the return may be due earlier or the personal representative may receive an automatic extension. Additionally, if the estate generates income during the probate process (such as interest, rent, or dividends), the estate may need to file its own income tax return on a Form 1041, also generally due by April 15 (with possible extensions).

Federal estate taxes apply only to very large estates—in 2024, the threshold is over $13.61 million—but if the estate is large enough, a federal estate tax return (Form 706) must be filed within 9 months of death. State estate or inheritance taxes may apply at lower thresholds depending on where the person lived. Some states have no estate tax at all. These returns often require professional tax preparation and must be filed even if no tax is ultimately owed, in order to start certain legal protections related to the statute of limitations.

Missing tax deadlines can create significant problems. The IRS and state tax agencies can assess penalties and interest. These amounts come out of the estate, leaving less for beneficiaries. Additionally, the executor may be personally liable to beneficiaries if the executor fails to file required tax returns and as a result the estate loses money to penalties. Some executors obtain extensions, but extensions must be requested before the deadline passes.

Practical Takeaway: Work with an accountant or tax professional as soon as probate opens to identify all tax obligations. Do not assume the estate owes nothing—many small estates still require returns to be filed. File required returns on time or request extensions before the original deadline.

Creditor Claim Deadlines: How Creditors Protect Their Rights

Creditors—such as credit card companies, medical providers, mortgage lenders, and others to whom the deceased person owed money—have a limited time to file claims against the estate. These deadlines vary significantly by state but typically range from 4 months to 1 year after
