Learn About Legally Changing Your Name in Texas

Understanding Name Change Laws in Texas

Texas allows adults and minors to change their legal names through a court process. The state has specific rules about how name changes work, who can request them, and what paperwork is needed. Unlike some states that have complex restrictions, Texas takes a relatively straightforward approach to name changes, though you will need to follow the proper legal steps.

The Texas Family Code, specifically Chapter 45, governs all name change procedures. This law applies to both adults and children. Texas does not require you to have a specific reason for wanting to change your name—the state allows name changes for personal preference. However, the courts do review petitions to make sure they are not being filed for fraudulent purposes, such as evading debts or hiding from law enforcement.

Name changes in Texas are permanent legal changes that affect your official records. Once a name change is granted by a court, you can use that new name on driver's licenses, Social Security records, bank accounts, employment documents, and other official paperwork. The court order becomes your legal proof that the name change is valid.

Texas has over 250 district courts across the state, and each one handles name change petitions. The process is generally similar no matter which court you use, though filing fees and exact procedures may vary slightly by county. Understanding the basic framework helps you know what to expect when you start the process.

Practical takeaway: Texas law permits name changes for most people who follow the court process. Familiarizing yourself with the basic legal framework helps you understand what steps come next and why each step matters.

Who Can File for a Name Change in Texas

Adults in Texas can file for their own name change if they are at least 18 years old and a resident of Texas. There is no specific residency length requirement mentioned in the Family Code, though most courts require you to be a Texas resident at the time you file. If you are not yet 18, your parents or legal guardians must file the petition on your behalf.

Texas law does not restrict name changes based on gender, marital status, or sexual orientation. You can change your name regardless of whether you are married, single, divorced, or widowed. If you are married and want to change your last name to something other than your spouse's name, you can still do so through the court process. This is different from taking your spouse's name through marriage, which can often be done without a court petition.

For minors, the parent or parents with custody must petition the court. If the minor's parents are divorced or separated, you may need to show that the parent filing has legal custody. If both parents have custody, some courts require both parents to agree to the name change, while others allow one parent to file. The specific requirement can vary by judge and county.

People with criminal records can still change their names in Texas. However, if you have a felony conviction, the court has more power to deny your petition. The judge can consider whether the name change is being sought to avoid the consequences of a criminal record or to evade law enforcement. For misdemeanors, this is less of a concern, but disclosure of criminal history is generally required.

Practical takeaway: Most adults and minors in Texas can pursue a name change, but minors need parental involvement, and courts may scrutinize petitions from people with felony convictions. Knowing whether you fall into these categories helps you understand what documentation and explanations you may need.

Steps to File a Name Change Petition in Texas

The name change process in Texas begins by filing a petition in your county's district court. You will need to complete the proper legal forms and submit them to the court clerk. The exact forms vary slightly by county, but most courts use similar documents based on Family Code requirements. Your county district court clerk's office can provide the correct forms or direct you to where you can find them online.

The petition must include basic information: your current name, the name you want to change it to, your date of birth, your current address, and the reason for the name change. While Texas does not require a specific reason, providing a brief statement such as "for personal reasons" or "to use my preferred name" is standard. You must also state that you are a Texas resident and provide information about any prior name changes.

After completing the petition, you file it with the district court clerk in your county. You will pay a filing fee, which typically ranges from $100 to $300 depending on your county. Some courts offer fee waivers if you cannot pay, though you must request this separately and demonstrate financial hardship. Once filed, the court clerk assigns your case a docket number.

You must also notify certain people about your petition. In most cases, you need to serve notice to the district attorney's office in your county. This is a standard requirement and does not mean the district attorney will object to your petition—it is simply part of the process. You may also need to publish notice in a local newspaper for a certain number of days, usually 10 to 14 days, depending on your county's rules. This public notice requirement allows anyone with a legitimate reason to object to your name change.

Practical takeaway: Filing involves obtaining forms, completing them with accurate information, paying the filing fee, and fulfilling notification requirements. Contact your county district court clerk early to understand the specific forms and procedures your county uses, as these details matter for a successful filing.

The Court Hearing and Approval Process

After you file your petition and complete the notification requirements, the court schedules a hearing. Many name change cases proceed without any objection, and some judges grant petitions without requiring a hearing. However, you should be prepared to appear in court if scheduled. The hearing is typically brief and straightforward for routine name change cases.

At the hearing, you may be asked why you want to change your name, whether the change is for any fraudulent purpose, and basic questions to confirm the information on your petition. The judge wants to verify that you are the person who filed the petition and that you understand this is a permanent legal change. You do not need to hire an attorney for most straightforward name changes, though having one can help if complications arise.

The district attorney's office reviews most petitions to make sure there are no public safety concerns. They look for patterns like someone with criminal convictions trying to avoid identification or someone attempting to impersonate another person. For most people filing for personal reasons, the district attorney does not object. If the district attorney does object, you will be notified and may need to address their concerns at the hearing.

If the judge approves your petition, you receive a name change order. This order is the official legal document that proves your name has been changed. The court clerk provides you with certified copies of this order. You will use these certified copies to update your name on your driver's license, Social Security card, bank accounts, employment records, and other documents. Most people order multiple certified copies because many organizations require an original or certified copy to process name changes.

Practical takeaway: The hearing is typically straightforward for routine cases. Once approved, the judge's order is your legal proof of the name change. Obtain multiple certified copies of your order immediately after approval, as you will need them for updating other records.

Updating Your Records After the Name Change

After your name change is approved by the court, you must update your legal records with various organizations and agencies. This process is important because your new legal name must be consistent across your identification documents and records. You should start by updating your Social Security record, as many other agencies reference this information.

Contact the Social Security Administration with your certified name change order, birth certificate, and photo identification. You can visit a local Social Security office or handle this by mail. The Social Security Administration will update your record and issue a new Social Security card with your new name. This process typically takes a few weeks.

Next, update your Texas driver's license or identification card through the Texas Department of Public Safety. You will need to visit a local DPS office with your certified court order, proof of residency, and your current driver's license. The fee for a replacement driver's license is typically around $16. Your new license will show your new legal name and serves as primary identification in most situations.

Update your name with your employer, your bank, your insurance companies, and any other organizations that maintain records with your personal information. Financial institutions and employers have specific procedures for name changes. Contact their customer service or human resources departments to learn what documentation they need. Most request a certified copy of your court order.
