Understanding Immigration: Types of Status and Categories

Immigration to the United States involves several different legal statuses, each with different rules and pathways. Understanding these categories helps people learn about options that may be relevant to their situation.

Permanent Resident status, often called a "green card," allows someone to live and work permanently in the United States. According to U.S. Citizenship and Immigration Services (USCIS), there are approximately 13.1 million lawful permanent residents in the United States as of recent data. People can obtain permanent resident status through several routes, including family sponsorship, employment-based immigration, diversity visa lottery, refugee or asylee status, or special immigrant categories. Each route has its own requirements and process.

Temporary visa categories include H-1B visas for specialty occupations, L visas for intracompany transfers, F visas for students, and O visas for individuals with extraordinary ability in sciences, arts, or business. Each visa type serves different purposes and comes with specific conditions about work, duration of stay, and what happens if circumstances change.

Refugee and asylee status both relate to people fleeing persecution or danger in their home countries. The main difference is that refugees apply from outside the United States, while asylees apply from within the U.S. or at a port of entry. According to the Department of State, the U.S. admitted over 76,000 refugees in fiscal year 2023.

Temporary Protected Status (TPS) provides temporary immigration status to nationals of designated countries experiencing armed conflict, natural disasters, or other extraordinary conditions. As of recent records, countries designated for TPS include Syria, South Sudan, Yemen, and several others. TPS holders may work in the United States during their status period.

Deferred Action for Childhood Arrivals (DACA) was created through executive action and provides work authorization and protection from deportation to certain people who arrived as children. The policy has been subject to legal challenges, and the landscape continues to change.

Practical Takeaway: Learning which immigration status categories exist helps people understand what information they may need to research further. Different statuses have different rules about work, travel, and family reunification, so understanding these categories is the first step in exploring what options might apply to a particular situation.

Family-Based Immigration Pathways and Sponsorship

Family relationships form the basis for many immigration pathways in the United States. According to USCIS data, family-sponsored immigrants represent the largest share of people obtaining permanent resident status each year—approximately 68% in recent years. Understanding how family sponsorship works provides information about one major immigration route.

U.S. citizens can sponsor certain family members, and lawful permanent residents can sponsor others. The rules differ based on the relationship. U.S. citizens can petition for spouses, children (unmarried and married), parents, and siblings. Immediate relatives of U.S. citizens—spouse, unmarried children under 21, and parents of citizens 21 and older—have the shortest wait times because they are not subject to annual visa number limits. Other family categories have wait times that vary from months to many years, depending on visa availability and demand.

Lawful permanent residents can sponsor spouses and unmarried children, but not parents, siblings, or married children. The process for permanent residents typically takes longer than for citizen sponsors because visa numbers for permanent resident sponsors are limited.

The sponsorship process requires the sponsoring family member to file a petition showing the relationship and proving they have sufficient income to support the immigrant so they do not become a public charge. Federal poverty guidelines are used to determine income requirements. For example, in 2024, a U.S. citizen sponsoring one family member must show an annual income of at least $23,792 (for a family of two). These amounts increase based on family size and sponsorship of multiple people.

After the petition is approved, the immigrant typically must wait for a visa to become available (depending on visa category), undergo medical examination, background checks, and interviews. Processing times vary significantly—some immediate relative cases may be completed in months, while family preference categories may take years.

It is important to know that fraudulent documents or misleading information in the process can result in permanent bars to immigration, so people should seek information about proper procedures.

Practical Takeaway: Family immigration begins with understanding which family members can petition for whom, the income requirements for sponsors, and realistic wait times for different visa categories. This information helps families understand whether family-based immigration is a pathway worth exploring and what to expect in terms of timeline and requirements.

Employment-Based Immigration and Work Authorization

Employment represents another major pathway for immigration to the United States. According to USCIS, employment-based immigrants made up approximately 15% of new permanent residents in recent years, though this number fluctuates based on policy and economic conditions. People seeking to immigrate through employment, as well as employers considering hiring international workers, should understand how work-based immigration functions.

Employment-based immigration is divided into five preference categories, each with different requirements. The EB-1 category covers individuals with extraordinary ability in sciences, arts, education, business, or athletics—people recognized as leaders in their fields. The EB-2 category includes professionals holding advanced degrees and individuals with exceptional ability in sciences, arts, or business. The EB-3 category covers skilled workers, professionals, and unskilled workers. The EB-4 category covers special immigrants such as religious workers and Iraqi and Afghan nationals. The EB-5 category covers investors who create jobs in the United States.

Many employment-based categories require labor certification, a process showing that hiring the foreign worker will not negatively affect job opportunities for U.S. workers. The Department of Labor oversees labor certification. This process can take months or years to complete. Some categories, like EB-1, do not require labor certification.

Temporary work visas provide another pathway. H-1B visas for specialty occupations are used by thousands of employers annually—in 2023, there were approximately 386,000 H-1B visa holders in the United States. L visas allow companies to transfer employees from foreign offices to U.S. offices. E visas are used by treaty investors and traders. O visas are for individuals with extraordinary ability. Each has different requirements and procedures.

Employers must follow specific recruitment and notification procedures before hiring foreign workers in many visa categories. Fraud or misrepresentation in employment-based immigration can result in bars to future immigration benefits and potential criminal penalties.

Practical Takeaway: Employment-based immigration involves understanding visa categories, labor certification requirements when applicable, and differences between temporary and permanent work visas. Both employers and individuals benefit from learning how these systems work to assess whether employment-based immigration may be relevant to their situation.

Refugee and Asylee Pathways for People Fleeing Persecution

Refugee and asylee status represent humanitarian immigration pathways for people fleeing persecution, violence, or torture. These pathways exist because the United States is a signatory to the 1951 Refugee Convention and the 1967 Protocol, which establish international obligations regarding people fleeing persecution based on race, religion, nationality, political opinion, or membership in a particular social group.

Refugee status applies to people outside the United States who meet the legal definition of refugee and are referred for resettlement. The U.S. Refugee Admissions Program (USRAP) is managed jointly by the Department of State, Department of Homeland Security, and Department of Health and Human Services. According to the Department of State, the U.S. admitted 76,689 refugees in fiscal year 2023. Refugees typically go through security screening, health checks, and interviews before being admitted to the United States.

Asylum status applies to people who are in the United States or at a port of entry and meet the legal definition of refugee. They can request asylum at ports of entry, at border facilities, or by filing applications while in the country. According to recent USCIS data, asylum officers and immigration judges decide thousands of asylum cases annually. In fiscal year 2023, approximately 121,494 people were granted asylum in the United States.

Both refugees and asylees go through background checks and interviews to assess their claims. Applicants must show they have experienced persecution or have a well-founded fear of persecution. The interview process explores what happened, why it happened, and why the person cannot receive protection in their home country or another safe country.
