Understanding Handicap Parking Permits: What They Are and How They Work

A handicap parking permit, also called a disability parking permit or accessible parking placard, is an official document that allows people with disabilities to park in designated accessible parking spaces. These spaces are closer to building entrances and are wider than regular spaces to accommodate wheelchairs, walkers, and other mobility devices. The permit tells parking enforcement and business owners that the vehicle has the right to use these special spaces.

Handicap parking permits come in two main forms: hang tags (placards that hang from the rearview mirror) and license plates. Hang tags are temporary or permanent and display a specific symbol—usually a white wheelchair on a blue background. Permanent license plates have the same symbol but are affixed to the vehicle. Both types show an identification number and expiration date when applicable.

The rules for handicap parking are governed by the Americans with Disabilities Act (ADA), a federal law passed in 1990. However, individual states and some local municipalities add their own rules and requirements. This means the process for obtaining a permit and the specific rules for using it can vary depending on where you live. For example, some states allow out-of-state permits to be used, while others have restrictions.

Handicap parking spaces are legally protected. A vehicle parked illegally in one of these spaces can receive a substantial fine—often between $250 and $1,000 depending on the state and location. Towing is also common. These strict penalties exist because removing one accessible space from use can make it impossible for someone with a disability to access essential services, medical care, or their workplace.

Practical takeaway: Before seeking a permit, research your state's specific rules about permit types, costs, and how long permits are valid. Contact your state's Department of Motor Vehicles or department of health to find the official rules that apply to your location.

Types of Handicap Parking Permits: Temporary vs. Permanent Options

Handicap parking permits are divided into two categories: temporary and permanent. Understanding the difference is important because the rules for using them and how long they last are different.

A permanent permit is issued when a person has a long-term or lifelong disability. Permanent permits typically have no expiration date, though some states require renewal every 3 to 5 years. The permit remains valid for as long as the person has the disability or until the permit expires and needs renewal. Permanent permits are often indicated by a blue background with a white wheelchair symbol. Once issued, a permanent permit can be used indefinitely in most cases.

Temporary permits are issued for disabilities expected to last a limited time—typically 6 months to 2 years. These might be given to someone recovering from surgery, dealing with a temporary injury, or undergoing medical treatment that temporarily limits mobility. Temporary permits usually display a red or orange background instead of blue, making them easy to distinguish from permanent ones. When the expiration date passes, the permit is no longer valid and must be returned or discarded.

Some states also offer provisional permits for conditions that may improve or worsen over time. A provisional permit allows for a review period to determine if the condition warrants permanent or temporary status. During this time, the person can use accessible parking while their situation is being evaluated.

Most states allow one permit per person, but some allow the permit to be transferred to other vehicles if the person isn't driving. This is useful for people who may ride in different family members' cars. However, the permit must always be with the vehicle being parked in an accessible space. Using someone else's permit without that person present is illegal and can result in fines and vehicle towing.

Practical takeaway: Determine whether your condition is likely temporary or permanent, as this affects which type of permit you should request. Keep track of your permit's expiration date and plan for renewal at least 30 days before it expires to avoid having no permit during the renewal process.

How to Obtain a Handicap Parking Permit in Your State

The process for obtaining a handicap parking permit varies by state, but most states follow similar general steps. The first step is to gather required documents and contact your state's Department of Motor Vehicles (DMV) or equivalent agency. Each state has specific requirements, so visiting the official state website or calling the DMV directly is essential.

Most states require a physician or healthcare provider to complete a medical certification form. This form documents that the person has a disability that affects their ability to walk or move. The physician will usually need to describe the person's condition, how it limits their mobility, and whether the limitation is temporary or permanent. Some states have specific forms they require, while others accept letters from healthcare providers. The medical professional does not need to be a specialist—your primary care doctor or nurse practitioner can often complete the form.

Common disabilities that may support a permit request include arthritis, heart disease, respiratory conditions, mobility issues from injury or surgery, neurological conditions, cancer-related fatigue, and visual impairments. Having one of these conditions does not automatically result in a permit; the healthcare provider must determine that it significantly affects walking or moving. For example, someone who can walk short distances without difficulty might not meet the criteria, even if they have a chronic condition.

In most states, you will need to submit an application form along with the medical certification. You can obtain the form from the DMV website, by visiting an office in person, or by phone. Some states now accept online submissions. The application typically requires your name, address, driver's license number, vehicle information, and signature. A fee is usually charged—typically between $5 and $50, depending on the state. Some states waive fees for low-income individuals.

Processing times vary. Many states issue permits within 1 to 3 weeks, though some take longer. During peak times or with incomplete paperwork, processing may take 4 to 6 weeks. Some states offer expedited processing for an additional fee. You should receive your permit by mail or can pick it up at a local DMV office.

Practical takeaway: Start the process by visiting your state's official DMV website to download the required forms and see the current fee. Schedule an appointment with your healthcare provider to discuss your mobility limitations and request the medical certification form. Allow at least 4 to 6 weeks for processing.

Rules for Using Handicap Parking Permits Legally

Having a valid handicap parking permit comes with specific legal responsibilities. Understanding these rules helps prevent fines and ensures accessible spaces remain available for those who truly need them.

The most important rule is that a vehicle can only park in an accessible space if the person with the disability is in the vehicle. The permit is tied to the individual, not just the vehicle. This means if someone borrows the family car to run an errand and parks in an accessible space without the permit holder present, that is illegal—even if the permit is displayed. This rule exists because accessible spaces are meant to support people with disabilities while they are traveling, not to provide convenient parking for their family members or friends.

A vehicle with a valid permit can park in accessible spaces without paying parking fees or adhering to time limits, even in metered parking areas. However, the vehicle must still follow all other parking regulations. For example, a permit does not allow you to park in a no-parking zone, in a fire lane (even though these are sometimes near accessible spaces), or on private property without the property owner's permission.

Accessible spaces must have proper signage and markings. A space is only truly an accessible space if it is marked on the ground and has an appropriate sign. Parking in a space that looks empty or available but is not officially marked as accessible can still result in a citation. Always look for official blue markings and signage before parking.

If you use someone else's permit or display an expired permit, you can be cited. Fines for misuse typically start at $250 and can reach $1,000 or more. Criminal charges are possible in cases of repeated or fraudulent permit use. Some states have prosecuted people who sold or fraudulently obtained permits.

When parked in an accessible space, your vehicle must display the permit clearly. A hang tag should be visible from outside the vehicle. License plates must remain on the vehicle. If a permit is damaged or lost, contact your DMV for a replacement.

Practical takeaway: Only use your accessible space when you are the one being transported or driving. Never lend your permit to another person, and always display your permit
