Learn About Green Card Routes and Requirements

Understanding Green Card Basics and What It Means

A Green Card is a document that shows you are a lawful permanent resident of the United States. The official name is a Permanent Resident Card, but most people call it a Green Card because older versions had a green tint. This card allows you to live, work, and study anywhere in the United States without needing a visa or work permit.

When you have a Green Card, you gain certain rights that visitors and temporary visa holders do not have. You can work for any employer without needing special permission. You can start your own business. You can own property. You can travel outside the United States and return, as long as you maintain your status. You can attend public schools and colleges at in-state tuition rates in many cases. You can also sponsor family members to come to the United States through specific programs.

However, a Green Card is different from citizenship. As a Green Card holder, you do not have the right to vote in federal elections, though some local elections may allow it. You cannot hold certain government jobs. You must follow all U.S. laws, and breaking laws can put your Green Card status at risk. You may also need to pay taxes on income earned worldwide, similar to U.S. citizens.

The Green Card process typically takes between several months to several years, depending on which route you take and your individual circumstances. Understanding the different paths to a Green Card helps you learn which options might be relevant to your situation.

Practical takeaway: Before exploring Green Card routes, understand what permanent residency means for your rights, responsibilities, and limitations compared to being a visitor or temporary visa holder.

Family-Based Green Card Routes

Family-based immigration is one of the most common ways people obtain Green Cards. U.S. citizens and Green Card holders can sponsor certain family members. The process depends on the relationship between the person sponsoring (the petitioner) and the person seeking the Green Card (the beneficiary).

If you are a U.S. citizen, you can sponsor a spouse, parent, child over age 21, and siblings. There are no annual limits on sponsoring spouses or parents, but there are yearly limits on sponsoring children and siblings. If you are a Green Card holder, you can only sponsor a spouse and children. The sponsorship process requires the petitioner to show they have enough income to support the family member, typically at 125% of the federal poverty level.

For immediate relatives of U.S. citizens—spouses, parents of adult citizens, and children under 21—there are no visa number limits. This means the process may move faster because everyone who is approved can move forward without waiting for visa numbers to become available. In 2023, immediate relative cases moved relatively quickly, with some cases processing in under a year.

For other family categories, visa numbers are limited. There is a visa bulletin that comes out monthly showing which dates are moving forward for which categories. For example, if you are the adult child of a U.S. citizen, your case might move through the system more slowly than an immediate relative case. Sibling sponsorships typically have longer wait times—sometimes 10 to 20 years or more, depending on the country of origin.

The family-based process involves two main steps: the I-130 petition (Petition for Alien Relative) and the I-485 application (Application to Register Permanent Residence or Adjust Status) if you are in the United States, or consular processing if you are abroad. Many family-based cases may be handled through concurrent filing, where both steps happen at the same time.

Practical takeaway: If you have close family members who are U.S. citizens or Green Card holders, learn about sponsorship limits and processing times for your specific relationship category to understand what timeline to expect.

Employment-Based Green Card Routes

Employment-based Green Card routes allow people to obtain permanent residency through a job offer or professional skills. There are five main employment categories, labeled EB-1 through EB-5, plus some specialty categories. Each category has annual visa limits, and processing times vary significantly.

EB-1 is for people with extraordinary ability in their field—think Olympic athletes, published researchers, or acclaimed artists. This category requires evidence of sustained national or international acclaim. EB-2 is for professionals with advanced degrees or people with exceptional ability in the sciences, arts, education, business, or athletics. EB-3 is for skilled workers, professionals with bachelor's degrees, and certain other workers. EB-4 includes certain special immigrants like religious workers and people who worked for the U.S. government abroad. EB-5 is for investors who invest a certain amount of money in a U.S. business that creates jobs.

Most employment-based cases require labor certification, which means the employer must show there are not enough available workers in the United States who can do the job. This process involves testing the labor market and can take 1-2 years. EB-1 and some EB-2 cases may not require labor certification, which can speed up the timeline.

In 2023, employment-based visa numbers were heavily backlogged for certain countries. For example, EB-2 and EB-3 cases for people born in India or China faced wait times of several years. For people born in most other countries, processing was faster. Annual visa numbers total 140,000 for employment-based cases, split across the five categories.

The employer plays a major role in employment-based cases. They must file the labor certification petition, the I-140 (Immigrant Petition for Alien Worker), and support the green card process. Some employers are experienced with this process; others are not. The job offer must be permanent and full-time in most cases.

Practical takeaway: If you are considering an employment-based route, learn which category your job might fit into and understand that your country of birth can significantly affect processing times.

Diversity Visa Lottery and Other Routes

The Diversity Visa program, often called the green card lottery, is designed to increase immigration from countries that have sent fewer immigrants to the United States. Each year, the program selects approximately 50,000 people from a pool of millions of applicants. The selection is random, similar to a lottery drawing. To participate, you must have a high school education or equivalent, or you must have two years of work experience within the past five years in an occupation that requires at least two years of training.

Not all countries are eligible for the diversity visa lottery. Countries that have sent more than 50,000 immigrants to the United States in the previous five years are typically not eligible. This means countries like Mexico, Philippines, India, China, and others are not eligible. Eligible countries change year to year. The U.S. State Department publishes a list of eligible countries each year before the application period opens.

The diversity visa lottery application period is typically open for about one month each year, usually in October. The application process is free and conducted through an online portal. If you are selected, you still need to go through medical exams, background checks, and an interview at a U.S. consulate or embassy before receiving your Green Card. The entire process from lottery selection to obtaining a Green Card typically takes 6-12 months.

Other routes to a Green Card include refugees and asylees, who may adjust to permanent residency after one year of status. Victims of trafficking, abuse, or crime may also have pathways through special visa categories like the T visa or U visa. Military service members who are not U.S. citizens may become citizens and thus sponsors for their families. Some people may also become permanent residents through congressional action or other special provisions.

Each route has different requirements and processing times. The diversity visa lottery is notable because it does not require a job offer or family sponsorship, making it an option for people who do not have U.S. relatives or an employer willing to sponsor them. However, the odds of being selected are extremely low—in recent years, approximately 1-2% of applicants are selected.

Practical takeaway: If you do not have family or employment sponsorship options, learn about the diversity visa lottery requirements and eligible countries to see if you might pursue this route, while understanding the very low odds of selection.
