Learn About Finding People Using Public Records

Understanding Public Records and What Information They Contain

Public records are documents and information maintained by government agencies that are available for anyone to view. These records exist at federal, state, county, and local levels. They include birth certificates, marriage licenses, property deeds, court documents, business filings, voting registrations, and criminal records. The concept of public records dates back to the founding of the United States, where the idea of transparency in government was considered essential to democracy.

The specific types of public records vary by location and agency. For example, county courthouses maintain records of civil cases, divorce proceedings, and property transactions. State vital records offices keep birth and death certificates. Local assessor offices store property ownership information and tax records. The federal government maintains records through the FBI, courts, and other agencies, though some federal records have restricted access for national security reasons.

Not all information about a person is public. Medical records, educational transcripts, and financial information from banks are typically private. However, once information enters the court system or becomes part of a government transaction, it often becomes public. For instance, if someone appears in court, that appearance becomes a matter of record. If someone owns property, that ownership is typically public information.

The Freedom of Information Act (FOIA), passed in 1966, established the legal foundation for accessing federal records. Most states have similar laws that allow residents to request records from state and local agencies. These laws recognize that citizens have a right to know what information the government maintains about them and about public matters.

Practical takeaway: Before searching for someone, understand what types of records might exist and where they would be stored. This helps you focus your search efficiently and understand what information you're likely to find versus what will remain private.

Accessing County and Local Public Records

County-level records are often the most accessible and comprehensive sources for finding people. Most county governments maintain records in a central courthouse or records office. These include property records, which show who owns what land and buildings. Property records typically include the owner's name, the property address, the sale price, and the date of the transaction. Anyone can usually view these records in person or increasingly through online databases.

Court records at the county level document civil cases, criminal cases, divorce proceedings, and small claims disputes. If someone has been involved in a lawsuit, you can often find their name, address, and details about the case. Criminal records show arrests and convictions. These records are generally public unless a court has ordered them sealed. County jails and sheriff's departments also maintain records about people currently or recently in custody.

Vital records—birth certificates, marriage licenses, and death certificates—are maintained by county or state vital records offices. While the records themselves are public, there are often restrictions on who can obtain copies. Generally, you can obtain your own vital records without question. Obtaining someone else's vital records may require demonstrating a legitimate interest, such as being a direct relative or having a legal reason to access the information.

Many county governments now maintain searchable online databases. You can search for property records, court cases, and other information from your computer. Some databases are free, while others charge a small fee per search or per page of records retrieved. Popular county record sites include property appraiser websites, county clerk websites, and dedicated record search portals operated by county governments.

When accessing records in person, most courthouses and government offices have staff who can direct you to the appropriate office and explain how to search their systems. Some offices have been digitizing historical records, making information from decades past increasingly searchable. However, some smaller counties still maintain primarily paper records, which may require a physical visit to review.

Practical takeaway: Start with your county government's website to identify which office maintains the type of record you're seeking. Many counties now allow online searching at no cost, making this an efficient first step in locating someone.

Using State-Level Records and Resources

State governments maintain several important categories of public records that can help locate people. State vital records offices hold birth, death, and marriage certificates for people born or registered in that state. These records are indexed and searchable, though access varies by state. Some states allow unrestricted searches, while others require proof of relationship or legitimate interest. State vital records offices typically charge a fee—usually between $10 and $30—for each certified copy of a record.

State court systems maintain records of cases that were appealed or heard in state appeals and supreme courts. These records are public and often searchable online through each state's judicial website. In addition, many states now maintain centralized databases of criminal records, though the level of detail available varies. Some states provide free online access to criminal history information, while others charge fees or require requests through law enforcement channels.

Professional licensing records are maintained by state agencies and are generally public. If someone holds a license to practice medicine, law, nursing, contracting, or another profession, you can typically search a state database to confirm their licensing status and any disciplinary history. These searches are often free and available on each profession's state board website.

State business registration records show who owns or operates businesses. Secretary of state offices maintain databases of registered businesses, and this information is generally public and searchable. You can find the registered agent for a business, which may be the business owner or their representative. Some state agencies also maintain property deed recording information centrally, making statewide property searches possible.

State-level records also include information from the Department of Motor Vehicles, though access to this information is restricted in most states. However, public information from driver licenses and vehicle registrations may be available in limited circumstances through public records requests. Additionally, state voter registration records are public in most states, though they may not be searchable online in all cases.

Practical takeaway: Visit your state government's website and explore the websites of specific state agencies—particularly vital records, courts, and professional licensing boards—to understand what records are searchable and how to access them.

Navigating Federal Public Records and National Databases

Federal public records include information maintained by courts, law enforcement agencies, and other federal departments. The federal court system maintains records of cases heard in federal district courts, appeals courts, and the Supreme Court. These records are increasingly searchable through PACER (Public Access to Court Electronic Records), a system maintained by the federal judiciary. PACER allows you to search for cases and view documents, though there is a small fee for accessing certain documents—typically $0.10 per page.

The FBI maintains criminal records through the National Crime Information Center (NCIC), but direct public access to this database is limited. However, the FBI Criminal Justice Information Services division provides criminal background checks for certain purposes. Additionally, many federal law enforcement agencies publish information about wanted individuals and convicted felons, available through their public websites.

The Social Security Administration maintains the Social Security Death Index, which is a searchable database of people who died and whose death was reported to Social Security. This is a public record and can help determine if someone has died. The information typically includes the person's full name, dates of birth and death, state where the death was recorded, and sometimes their last known residence.

Immigration records are maintained by U.S. Citizenship and Immigration Services (USCIS). Naturalization records, which show when someone became a U.S. citizen, are public records. You can search for naturalization records through the National Archives or through USCIS directly. These records typically include biographical information and the court where the naturalization occurred.

The Federal Bureau of Prisons maintains a searchable database of current inmates in federal facilities, called the Inmate Locator. This database includes the inmate's name, registration number, facility, and projected release date. At the state level, most state departments of corrections maintain similar databases for people incarcerated in state facilities.

Practical takeaway: Understand that federal records require different access methods than local records. Start with specific federal agency websites related to your search—courts, prisons, Social Security—rather than trying to search one central national database.

Finding People Through Online Public Records Aggregators

Online public records aggregators are websites that compile information from multiple public sources into searchable databases. These companies purchase or legally obtain public records from government agencies and create searchable indexes. Examples include sites that aggregate property records, court documents, criminal histories, and other public information. Some of these services are free, while others charge fees that range from a few dollars for a single search to subscription fees for unlimited searching.
