Learn About Filing FOIA Government Records Requests

Understanding FOIA and Your Right to Government Records

The Freedom of Information Act (FOIA) is a federal law passed in 1966 that gives people the right to request documents and records held by federal government agencies. This law is based on the principle that the public should have access to information about how their government operates. Under FOIA, you can request records from agencies like the FBI, Department of Defense, Environmental Protection Agency, Internal Revenue Service, and many others.

FOIA does not require you to explain why you want the records or what you plan to do with them. You do not need to be a U.S. citizen or a journalist to make a request. Anyone can submit a FOIA request—students researching topics, business owners seeking competitive information, activists investigating government actions, or ordinary citizens curious about how agencies work.

The law requires agencies to respond to requests within 20 business days, though this timeline can be extended under certain circumstances. Agencies must either provide the requested records, explain why they cannot, or indicate that they do not have the records you are seeking. The goal of FOIA is to promote government transparency and accountability.

However, FOIA includes nine categories of information that agencies may withhold, such as national security classified documents, personal privacy information, confidential business secrets, and law enforcement records. Understanding what can and cannot be withheld is important when you are planning your request.

Practical Takeaway: Learn which federal agency might have the records you seek. Different agencies maintain different types of documents. For example, the Department of Labor handles employment-related records, while the Department of Health and Human Services manages health policy information. Identifying the correct agency makes your request more likely to be successful.

Types of Records Available Through FOIA Requests

Federal agencies maintain millions of records covering nearly every aspect of government operations. These records can include policy documents, emails, contracts, meeting notes, research data, financial records, and reports. Understanding what types of documents exist helps you form a focused request.

One common type of FOIA request involves environmental records. For instance, someone might request the EPA's inspection reports for a local factory or documents related to water quality testing in their area. Another category involves employment and workplace safety—the Occupational Safety and Health Administration (OSHA) receives requests for safety violation reports and inspection findings at specific worksites.

Freedom of Information Act requests also frequently target law enforcement and national security agencies. People have obtained records about civil rights investigations, surveillance practices, or historical events. The FBI's vault, a digital repository of previously released FOIA documents, contains thousands of records ranging from investigations into organized crime to files on civil rights leaders.

Agency budgets and spending records represent another significant category of FOIA requests. These documents show how taxpayer money is allocated and spent. You might request information about grant funding, contract awards, or administrative spending within a particular agency or program.

Research and scientific records held by federal agencies are also obtainable. Universities and private researchers often request climate data, medical research findings, agricultural studies, or other scientific information compiled by government agencies.

Practical Takeaway: Before submitting a request, check if the records you seek might already be publicly available. Many agencies publish reports, databases, and documents on their websites without requiring a FOIA request. Starting with an agency's public records section can save time and may provide the information you need immediately.

The FOIA Request Process: Step-by-Step

Filing a FOIA request involves several straightforward steps. First, you must identify which agency holds the records you want. You can often find this by looking at an agency's website or contacting their public affairs office. Most federal agencies have a FOIA office or a designated FOIA contact person listed on their website.

Second, you need to write a request letter or form. Your request should describe the records you seek in clear, specific language. Instead of asking for "all files about a company," describe specific documents, a date range, and other details that narrow the scope. Vague requests often result in delays or requests for clarification, as agencies need to understand exactly what you are looking for.

Third, you must submit your request to the appropriate agency. Most federal agencies now accept FOIA requests through online portals, email, or mail. The agency's FOIA office will have instructions for submission. Some agencies use centralized request systems, while others maintain separate processes by department.

Fourth, the agency will send you an acknowledgment confirming receipt of your request and typically providing a tracking number. Keep this number for your records. The agency must respond within 20 business days of receiving your request, though this period can be extended if the agency needs additional time to search for records or consult with other offices.

Fifth, the agency will provide the requested records, provide them with redactions (portions blacked out) for protected information, deny the request, or notify you that they do not have the records. If records are denied or withheld, the agency must explain the legal basis for the denial and inform you of your right to appeal.

Practical Takeaway: Write your request as specifically as possible. Include document types, date ranges, names of individuals or organizations, and any other specific details you know. A request for "all documents regarding Project X from January 2020 to December 2021 held by the Research Division" is far more effective than "all documents about Project X." Specific requests reduce processing time and increase the likelihood of obtaining useful results.

Fees, Timelines, and Exemptions You Should Know

FOIA requests are often processed at no cost to the requester. Agencies may charge fees for copying, scanning, and staff time spent searching for and reviewing records, but many agencies waive fees for certain types of requests or requesters. Educational institutions, news organizations, and nonprofit groups sometimes receive fee waivers. Individual requesters may also request a fee waiver by demonstrating that the records are in the public interest and that you cannot afford the fees.

The standard response timeline is 20 business days from the date an agency receives your request. However, agencies frequently extend this timeline when records are extensive or when consultation with other agencies is needed. Extensions are permitted under FOIA and are common in practice. Some large requests or those involving classified information may take months or even years to process.

FOIA includes nine exemptions allowing agencies to withhold certain categories of information. These include: (1) classified national security information, (2) internal personnel and management rules, (3) information protected by other federal laws, (4) confidential business information, (5) internal government communications, (6) personal privacy information, (7) law enforcement investigative records, (8) financial institution information, and (9) geological and geothermal information. When agencies withhold records, they must identify which exemption applies.

Some agencies are slower to respond than others. According to government statistics, the average FOIA response time across federal agencies is approximately 60-90 days, though many routine requests are completed faster. Complex requests involving multiple offices or extensive record collections may take significantly longer.

If you believe an agency wrongfully withheld records, you have the right to appeal the decision. Appeals must generally be filed within a specific timeframe, typically 30-90 days depending on the agency. The appeal is reviewed by a higher authority within the agency.

Practical Takeaway: Understand that "expedited processing" is available in certain circumstances—such as when there is a demonstrable urgency related to public health, safety, or current news events. Requesting expedited processing requires you to explain why the faster timeline is warranted, and the agency will determine whether your request qualifies.

Common FOIA Exemptions and Why Records Are Withheld

When you receive a response to a FOIA request, records may be partially redacted or entirely withheld. Understanding the most common reasons agencies refuse to release information helps you understand government decisions and may guide future requests.

The most frequently cited exemption is Exemption 5, which protects internal government communications and decision-making processes. This includes attorney-client communications, deliberations between staff members, and advice given to decision-makers. The rationale is that agencies need a confidential space to discuss options and reasoning before making public decisions. However, factual information within these communications may sometimes be released even if deliberative portions are withheld.
