Learn About Filing A Restraining Order Online

Understanding Restraining Orders and How Online Filing Works

A restraining order is a legal document issued by a court that directs one person to stay away from another person or place. Also called a protective order or order of protection, this court order can prohibit someone from contacting, threatening, harassing, or coming near you. When someone files a restraining order online, they typically use a court's electronic filing system to submit documents rather than visiting the courthouse in person.

Online filing has become available in many states and counties over the past decade. According to the National Center for State Courts, approximately 60% of state court systems now offer some form of electronic filing for civil cases, which includes restraining orders. However, the specific procedures, requirements, and availability vary significantly by location. Some courts offer fully online filing, while others allow only partial online submission with requirements to appear in person for the hearing.

The basic process involves gathering required documents, creating an account on the court's filing system, uploading paperwork, paying any filing fees, and receiving confirmation of submission. Different types of restraining orders exist, including domestic violence restraining orders, civil harassment orders, stalking orders, and workplace violence orders. Each type has different legal standards and documentation requirements.

Understanding your specific court's system is essential because procedures differ widely. A restraining order filed in California may follow entirely different steps than one filed in Texas or New York. Courts in urban areas often have more developed online systems than rural courts. Before beginning, you should identify which court has jurisdiction over your situation—typically the court in the county where you live or where the threatening behavior occurred.

Practical Takeaway: Visit your county or state court's official website to determine whether online filing is available for restraining orders in your location and review their specific procedures.

Types of Restraining Orders and When They Apply

Restraining orders fall into several categories, each designed for different situations. Domestic violence restraining orders protect people from abuse by intimate partners, spouses, or household members. These orders can be issued even before a criminal case is filed and typically protect not only the victim but also their children. According to the Centers for Disease Control and Prevention, approximately 1 in 4 women and 1 in 7 men experience severe intimate partner violence in their lifetime, making these orders critical legal tools for many people.

Civil harassment restraining orders address threats, harassment, or violence from people without a domestic relationship to the victim. This category covers situations involving neighbors, acquaintances, coworkers, or strangers. Stalking restraining orders specifically address repeated following, monitoring, or threatening behavior that causes someone to fear for their safety. A person may file a stalking order even if they have no prior relationship with the person doing the stalking.

Workplace violence restraining orders protect employees, employers, and other workplace individuals from threats or violent behavior at work. Schools can also file orders to protect students and staff from specific individuals who pose a threat on campus. Workplace-related orders may be filed by school officials or management on behalf of community members they serve.

Each order type has specific legal requirements for what must be proven. Domestic violence orders typically require showing abuse, defined as intentionally or recklessly causing injury, placing someone in reasonable apprehension of injury, or engaging in threatening behavior or harassment. Civil harassment orders generally require showing a pattern of conduct directed at you that seriously alarms, annoys, or harasses you, and that serves no legitimate purpose. Understanding which category applies to your situation helps determine what documentation you'll need to gather and what legal standard your case must meet.

Practical Takeaway: Review your situation against each order type to understand which category best describes your circumstances, as this determines the court procedures and legal standards you'll encounter.

Required Documents and Evidence for Your Filing

Successfully submitting a restraining order online requires preparing thorough documentation. The cornerstone document is typically the petition or request form, which varies by court but generally asks you to describe the behavior that threatens your safety, when it occurred, and what you're requesting the court to do. Many courts provide fill-in-the-blank petition forms that guide you through required information. You must typically state facts, not just conclusions—instead of writing "he is dangerous," explain "on March 15, 2024, he sent me 47 text messages over four hours threatening to harm my family."

Supporting evidence significantly strengthens restraining order filings. Text messages, emails, social media posts, or voicemails from the person threatening or harassing you provide strong documentation. Screenshots are often accepted, but some courts require certified copies or actual message records from phone companies or platforms. Police reports create powerful evidence; if you've reported the person's behavior to law enforcement, these official reports carry substantial weight. Medical records documenting injuries from violence support domestic violence petitions. Photographs of injuries, property damage, or threatening messages can be included.

Witness statements also matter. Written declarations from people who observed the threatening behavior, heard threats, or witnessed injuries strengthen your case. Courts often require these statements to be under oath, meaning the witness signs a declaration stating they understand making false statements is perjury. Documentation of patterns is particularly important; showing repeated incidents over time demonstrates harassment rather than a single isolated event.

The Stalking Resource Center reports that documentation gathering is one of the most challenging aspects of filing for protection orders, as many victims don't immediately save messages or report incidents. Starting now to document any ongoing behavior—saving messages, noting dates and times of incidents, and recording who witnessed events—creates the foundation for a strong filing. Some courts also require information about the other person: their full legal name, address, date of birth, and physical description help ensure the court order applies to the correct individual.

Practical Takeaway: Begin systematically collecting and organizing all documentation now—save messages, photograph evidence, obtain police report numbers, and gather witness contact information before starting your online filing.

The Step-by-Step Online Filing Process

The online filing process begins with accessing your court's official electronic filing system. Most county court websites have a link to their filing portal, often labeled as "e-file," "electronic filing," or "online services." Create a user account following the court's instructions, which typically requires an email address and password. Some courts require verification of your identity through security questions or a verification code sent to your email. Never use a public computer or shared device for this process, as your account will contain sensitive personal information.

Once logged in, you'll locate the option to file a new case or petition. Select the category matching your restraining order type—domestic violence, civil harassment, stalking, or workplace violence. The system guides you through a series of forms, often providing explanatory text about what information each section requires. Complete all required fields carefully; incomplete filings may be rejected by the court clerk. Take time to review your entries for accuracy, particularly spelling of names, dates, and other specific details.

Upload your supporting documents according to the court's specifications. Systems typically accept PDF files; convert documents to PDF format before uploading if needed. Many courts allow you to upload photographs, screenshots, and scans of police reports. Ensure uploaded documents are legible—blurry or cut-off images may not be accepted. Some systems have file size limits, requiring you to compress large images or split documents into multiple uploads. Label each uploaded document clearly so the judge can understand what you're providing.

After submitting documents, pay any filing fees required by your court. Filing fees for restraining orders vary considerably—some courts charge $50 to $200, while others waive fees for those unable to pay. Online systems typically accept credit cards, debit cards, or electronic fund transfers. After payment, the system provides a confirmation number and filing receipt. Screenshot or print this confirmation; you may need it to track your case or provide proof of filing. The court clerk reviews submitted documents and contacts you if any information is missing or needs clarification before the judge reviews your petition.

Practical Takeaway: Follow your court's instructions precisely, double-check all information before submitting, and save your confirmation number for your records.

Temporary and Emergency Orders, and Court Hearings

Many restraining order processes include a temporary protective order issued quickly, sometimes the same day you file, to provide immediate protection while your full case is reviewed. When you file online, you may be able to request this temporary order as part of your initial filing. Temporary orders typically last 14 to 21 days, providing protection while the court schedules a hearing on your full petition. According to court data, approximately 70% of petitioners receive temporary orders when they request them, though the order may be
