Learn About DMV Fines and Traffic Violations

Understanding Traffic Violations and DMV Fines

Traffic violations occur when a driver breaks a rule of the road established by state or local law. These violations range from minor infractions to serious criminal offenses, and each carries different consequences. The Department of Motor Vehicles (DMV) works with law enforcement and the court system to track violations, assess penalties, and manage driver records. Understanding how violations work and what fines they carry is important for anyone who drives.

When an officer issues a citation, they record specific details about what rule was broken and under what circumstances. This information flows to the DMV, which maintains a permanent record on your driving history. Insurance companies review these records when calculating your rates, employers may check them for commercial drivers, and courts reference them when determining penalties for future violations.

The severity of a violation depends on several factors: whether the violation caused an accident, if it endangered other people, whether it involved alcohol or drugs, and your prior driving record. A driver who rolls through a stop sign on an empty road faces a different penalty than one who runs a red light during rush hour and causes a collision.

Each state defines its traffic laws differently, so what is a fine-only violation in one state might carry license suspension in another. The same applies across different counties and municipalities within a state. This variation makes it important to understand the specific rules where you live and drive regularly.

Practical Takeaway: Keep a record of your driving history by requesting a copy from your state DMV. Review it for accuracy and understand which violations appear on it. Knowing what violations are on your record helps you understand how they may affect insurance rates and employment opportunities.

Common Traffic Violations and Their Fine Ranges

Speeding remains the most frequently cited traffic violation in the United States. According to the National Highway Traffic Safety Administration, speeding is involved in approximately 26% of all traffic fatalities. Fines for speeding vary widely based on how much over the limit you were traveling. In many states, going 1-10 miles over the limit may result in fines between $50 and $150, while going 26 miles or more over the limit can result in fines exceeding $500.

Reckless driving is a more serious violation that involves operating a vehicle with willful disregard for the safety of people or property. This might include excessive speeding, weaving through traffic, or racing. Fines for reckless driving typically range from $200 to $1,000, and some states impose jail time along with fines. A reckless driving conviction stays on your record for 3-10 years depending on your state.

Failure to stop at a traffic light or stop sign is another common violation. These violations put other drivers and pedestrians at serious risk. Fines typically range from $70 to $300, though if the violation causes an accident, penalties increase significantly. Running a red light caught on camera in some jurisdictions results in automated fines, which are typically lower—around $50 to $150—but still appear on your driving record.

Improper lane changes, following too closely (tailgating), and unsafe turns are violations that can result in fines ranging from $50 to $200. While these might seem minor, they often factor into insurance rate increases because they indicate risky driving habits. Distracted driving violations—including texting or holding a cell phone while driving—carry fines ranging from $100 to $400 in most states, with penalties increasing in some jurisdictions to $500 or more.

Driving with an expired registration or expired license plate tags typically results in fines between $50 and $300. These violations are administrative in nature but important to address quickly because continuing to drive with expired tags compounds the problem. Parking violations, while not typically classified as moving violations, can result in fines from $25 to $500 depending on the location and the severity of the offense.

Practical Takeaway: Review your state's traffic code to understand specific fine amounts for common violations. Many state DMV websites publish penalty schedules that show fines for different violations. Bookmark this information for reference and share it with other drivers in your household to reinforce safe driving habits.

How Points Systems and License Suspension Work

Most states use a points system to track serious or repeated violations. When you receive a traffic citation, points are added to your driving record based on the severity of the violation. The more severe the violation, the more points assigned. For example, a minor speeding violation might add 2-3 points, while reckless driving might add 4-6 points. These points remain on your record for a set period—typically 3-5 years—depending on your state.

When your points total reaches a threshold set by your state, you face license suspension. In many states, accumulating 12 points within three years results in a license suspension of 30-90 days for a first offense. A second suspension within a specified timeframe is typically longer—potentially 6 months or a year. New York State, for example, suspends licenses when drivers reach 11 points; California uses a similar 4-point system over a 12-month period.

License suspension means you are legally prohibited from driving. Getting behind the wheel during a suspension is a criminal offense that can result in arrest, fines up to $1,000, jail time, and additional license suspension. Some states allow limited driving privileges during suspension—such as driving to work or school—but these must be specifically authorized by the court.

Different violations carry different point values. Moving violations that are more serious carry more points. A speeding ticket for going 1-10 miles over the limit might be worth 2-3 points, while speeding 31+ miles over the limit might be worth 4-6 points. Some violations, like parking tickets or equipment violations (broken taillight), are not moving violations and do not add points to your record.

It's possible to reduce points on your record by completing a defensive driving course, also called traffic school. Many states allow drivers to attend an approved course after receiving a ticket and have the points reduced or removed from their record, though they still must pay the fine. The course typically costs between $20 and $75 and takes several hours to complete. Regulations vary—some states allow this only once every three years or once per conviction.

Practical Takeaway: Request your current driving record from your state DMV to see how many points you have. If you are within a few points of suspension, look into defensive driving courses in your state to learn if you are eligible for point reduction. Understanding your point total helps you make informed decisions about your driving.

Impact of Violations on Insurance Rates and Driving Records

Traffic violations significantly affect your auto insurance premiums. Insurance companies use your driving record as one of the primary factors in calculating rates. According to data from the Insurance Information Institute, a driver with a speeding ticket can see rate increases of 10-30% depending on the insurance company and the severity of the speeding violation. A reckless driving conviction can increase rates by 15-40% or more.

The impact varies based on the type of violation and the insurance company's underwriting guidelines. Some insurers focus more on safety-related violations like speeding or running a red light, while others weight violations differently. An accident your fault appears on your record and typically causes rate increases of 20-50% depending on the severity and your insurer. Insurance companies usually consider violations for 3-7 years when calculating rates, though the impact diminishes over time if no new violations occur.

Minor violations like parking tickets or expired registration generally do not affect insurance rates because they are not moving violations. However, they do create a pattern that law enforcement may notice. Some insurers offer programs that track safe driving habits through mobile apps—if you receive no violations during the monitoring period, you may receive a discount.

Your driving record is permanent, but violations eventually "age off" and stop affecting your rate. This process typically takes 3-7 years for minor violations and up to 10 years for serious violations like DUI or reckless driving. Some insurers are stricter than others about how long they look back into your history.

Getting a violation in a different state does not hide it from your insurance company. States share violation information through the National Driver Register (NDR) and through the Interstate Compact system. Your insurance company can and will discover violations in other states, and those violations will affect your rates in your home state. Attempting to hide violations by not reporting accidents or tickets is considered fraud and can result in
