Learn About DACA and Immigration Status

What Is DACA and How Did It Begin

DACA stands for Deferred Action for Childhood Arrivals. The U.S. government created this program in 2012 under the Obama administration. DACA was designed to provide temporary relief from deportation for certain people who came to the United States as children without legal permission.

The program does not grant permanent legal status or citizenship. Instead, DACA provides what the government calls "deferred action," which means the Department of Homeland Security agrees not to remove a person from the country for a set period of time. This protection lasts for two years, after which people can request renewal if they continue to meet the program's criteria.

Before DACA existed, many young people who had grown up in America faced the constant threat of deportation, even though they had no real connection to their birth countries. These individuals came to be known as Dreamers, a term that references the Development, Relief, and Education for Alien Minors Act (DREAM Act), a proposed law that has never passed Congress. The DREAM Act would have created a path to permanent legal status for certain young immigrants, but DACA was created as an alternative tool when the legislation stalled.

Since its creation, DACA has affected millions of people. According to U.S. Citizenship and Immigration Services, more than 800,000 people have received DACA protection at various points. The program has been controversial, with supporters arguing it helps young people contribute to society while opponents question whether it undermines immigration law. Regardless of political views, DACA remains an important immigration program that many people rely on.

Practical Takeaway: Understanding DACA's origins helps explain why the program exists and what it was designed to accomplish. It is temporary protection from deportation, not a path to citizenship or permanent residency. The program has affected hundreds of thousands of people since 2012.

Understanding Immigration Status Categories

Immigration status describes a person's legal standing in the United States. The U.S. government recognizes several different categories, and where someone falls determines what rights, restrictions, and opportunities apply to them. Learning about these categories helps explain where DACA fits into the larger immigration system.

U.S. citizenship is the highest status. Citizens have full rights under U.S. law, can vote, can serve on juries, and generally have no restrictions on living or working in the country. People become citizens either by being born in the United States or by going through a naturalization process.

Lawful permanent residents, often called "green card" holders, have permission to live and work in the United States permanently. They have been through immigration processes and received approval from the government. However, they are not citizens and cannot vote. Lawful permanent residents must follow U.S. laws and can lose their status through certain criminal convictions.

Temporary visa holders have permission to be in the U.S. for a specific purpose and time period. Examples include student visas (F-1), work visas (H-1B), and tourist visas (B-1/B-2). People on temporary visas must follow the terms of their visa and leave when it expires, unless they change to a different status.

Undocumented immigrants are people in the United States without permission from the government. They may have entered without inspection, or their visas may have expired. Undocumented immigrants have no legal right to be in the country and can be subject to removal.

DACA recipients occupy a middle ground. They are not documented immigrants with government permission in the traditional sense, but they also are not subject to normal deportation procedures while their DACA protection is active. They can work and study but do not have a permanent legal status.

Practical Takeaway: Immigration status categories determine legal rights and restrictions. DACA provides temporary protection from deportation but does not change someone's underlying immigration status. Understanding these categories helps clarify what DACA does and does not do.

Who DACA Covers and Basic Program Requirements

DACA has specific criteria that people must meet. Understanding these requirements provides information about how the program defines who may be covered. These are the basic requirements as established by the Department of Homeland Security:

First, a person must have come to the United States before turning 16 years old. This age requirement is central to DACA's purpose—the program targets people who came as children. Someone who was 16 or older when they arrived would not meet this requirement.

Second, a person must have continuously lived in the United States since June 15, 2007. This means they must have been physically present in the country during this entire time period without significant absences. Brief trips outside the U.S. might not break this requirement, but extended absences could. The government has specific rules about what counts as continuous residence.

Third, a person must have been physically present in the United States on June 15, 2012 (the day the program was announced) and at the time they submit their request. This ensures the program only covers people who were already here when it began.

Fourth, a person must not have a serious criminal record. DACA cannot be granted to people with felony convictions or certain other crimes. The government reviews criminal history carefully when making decisions.

Fifth, a person must be at least 15 years old at the time of request (with limited exceptions for those in the juvenile justice system). This ensures a minimum age requirement.

The program also requires people to pay fees for processing and to undergo background checks, including fingerprinting. These are practical administrative steps the government uses to verify information and ensure public safety.

It is important to note that meeting these requirements does not guarantee any particular outcome. These are simply the conditions the government has stated as part of the program's framework.

Practical Takeaway: DACA has multiple requirements involving age, arrival date, continuous residence, clean criminal record, and administrative steps. Someone must meet all of these basic criteria for the program to potentially apply to them. A qualified immigration attorney or accredited representative can review individual situations.

What DACA Provides and What It Does Not Provide

DACA provides specific benefits during the time protection is active. Understanding exactly what the program does is crucial because many misconceptions exist about its scope and power.

DACA provides protection from deportation. During the two-year period that DACA is active, the government has stated it will not remove someone based on their immigration status alone. This is the core benefit and the reason many people view DACA as life-changing. Without this protection, these individuals would be at risk of removal proceedings at any time.

DACA provides work authorization. People with active DACA protection can obtain an Employment Authorization Document (EAD), which allows them to work legally in the United States. This document is recognized by employers as proof that someone has permission to work. Many DACA recipients use this authorization to gain employment, earn income, and support themselves and their families.

DACA provides a Social Security Number for people who do not already have one. This number is necessary for many aspects of life in America, including opening bank accounts, obtaining credit, and reporting income to the government.

DACA provides the ability to obtain a state driver's license or ID card. Most states recognize DACA as sufficient documentation for this purpose. A driver's license is important for daily life—it allows people to drive legally, provides identification, and is often required to access various services.

DACA does not provide citizenship or a path to citizenship. The program is temporary protection only. It does not change someone's immigration status or give them permanent legal residency.

DACA does not provide legal permanent residency status. Someone with DACA is not a lawful permanent resident, even though they have permission to work and be in the country.

DACA does not provide "green card" status or permanent rights to stay in the United States. The protection is temporary and must be renewed every two years.

DACA does not provide access to federal benefits in the same way citizens or permanent residents might. Some states offer certain benefits to DACA recipients, but this varies by location.

DACA does not protect someone from deportation if they leave the United States without permission to return. Someone with DACA must request advance permission to travel outside the U.S., known as "advance parole."
