Understanding Criminal Record Sealing: What It Means and How It Works

Criminal record sealing is a legal process that removes certain criminal records from public view. When a record is sealed, it becomes hidden from most background checks and public databases. This means that for many purposes—like job applications, housing, or loans—you can legally say you do not have that criminal record.

It's important to understand that sealing is different from expungement, though the terms are sometimes used interchangeably. Expungement physically destroys or erases a record, while sealing keeps the record but makes it inaccessible to the general public. Some states use one term, some use the other, and some recognize both as separate processes.

When a record is sealed, the arresting agency, court, and prosecution office maintain the sealed documents, but they are typically not visible in standard background checks. However, certain organizations—like law enforcement agencies, courts, and sometimes licensing boards—retain the ability to view sealed records. This limited access is important because it means the record is not completely erased; it is simply restricted from public access.

The specifics of what sealing accomplishes vary by state and by the type of charge involved. Some states allow you to say that an arrest never happened once a record is sealed, while others have different rules about what you must disclose. Understanding your state's particular laws is crucial, as the rules differ significantly across jurisdictions.

Practical Takeaway: Before pursuing any sealing action, research your state's specific definitions and processes. Contact your state court clerk's office or a legal aid organization to understand whether sealing, expungement, or another process applies to your situation. The terminology and rules vary widely, and what works in one state may not apply in another.

Types of Records That May Be Sealed

Not all criminal records may be sealed. The types of charges and cases that qualify for sealing vary significantly by state and sometimes by county. Understanding which records fall into sealing-eligible categories is a first step in exploring this option.

Arrests that did not result in conviction—including cases dismissed, acquittals, or cases where charges were dropped—are often sealing-eligible in many states. If you were arrested but the case never went to trial, or if you were found not guilty, the arrest record frequently becomes removable from public view. These records represent situations where no legal guilt was established, making them common candidates for sealing.

Misdemeanor convictions may be sealing-eligible in some jurisdictions, particularly after a waiting period has passed. Waiting periods commonly range from three to seven years after conviction, sentencing completion, or both. Some states allow misdemeanor sealing sooner if restitution is paid or other conditions are met. The specific timeline depends on your state's law.

Juvenile records are frequently sealing-eligible, though the specific rules for juveniles vary by state. Many states have processes allowing juvenile records to be sealed automatically after certain ages are reached or after specific time periods pass. This reflects the legal principle that juvenile records should not permanently harm a person's future opportunities. Some states seal juvenile records more automatically than adult records.

Felony convictions present more restrictions. Many states do not allow felony records to be sealed, or only allow it under narrow circumstances—such as for certain drug offenses, property crimes below a specific value, or only after many years have passed (sometimes 10-20 years or more). Some states have no felony sealing provisions at all.

Practical Takeaway: Create a summary of the charges on your record, including whether each resulted in conviction or dismissal, and the offense level (misdemeanor or felony). Then research your state's specific sealing statutes or contact a legal aid society to determine which records on your history may fall within sealing-eligible categories.

State-by-State Variations in Sealing Laws

Criminal record sealing laws differ dramatically across the United States. What is easily sealing-eligible in one state may be impossible in another. Some states have broad sealing provisions, while others have very restrictive laws or minimal sealing options.

States like California, New York, and Illinois have implemented relatively expansive sealing processes in recent years. California's Senate Bill 731, which took effect in 2022, allows many felony convictions to be dismissed and records sealed after conviction. New York expanded sealing eligibility through its Criminal Justice Reform Act. These states represent examples of broader sealing access.

Other states maintain stricter approaches. Some southern states and certain midwest states have very limited sealing provisions, particularly for felony convictions. A few states have no sealing or expungement statutes at all, meaning records remain permanently public for most criminal cases.

Waiting period requirements also vary widely. Some states allow non-conviction records (dismissals, acquittals) to be sealed relatively quickly—sometimes immediately or within one to two years. Conviction records typically require longer waiting periods. These periods range from three years in some jurisdictions to 15-20 years in others. A few states base waiting periods on age at sentencing or time since release from incarceration rather than a fixed calendar period.

In addition, some states separate "sealing" from "expungement," treating them as different processes with different requirements and outcomes. Others use the terms interchangeably. A few states have introduced "record restriction" or "record concealment" as additional categories with their own rules. Understanding your state's terminology is essential because using the wrong term when researching may lead to confusion.

Practical Takeaway: Visit your state's judicial or legislative website and search for "criminal record sealing" or "record expungement." Look for your state's specific statute number. Additionally, contact your state bar association's lawyer referral service or a legal aid organization in your area—these groups maintain current information about your state's laws and recent changes.

The Sealing Process: Steps and Timeline

The process for sealing a criminal record typically involves several steps, though the exact procedure varies by state and county. Understanding the general process helps you know what to expect.

The first step usually involves determining whether your record meets sealing criteria. This requires reviewing the specific charges, their disposition (conviction or dismissal), and the time that has passed since the case ended. You will need to gather information about your case, including the case number, court, date of conviction or dismissal, and offense charges.

Next, most states require you to prepare a petition or motion for record sealing. This document—filed with the court that handled your case—requests that the judge order the record sealed. The petition typically includes your case information and an explanation of why the record should be sealed. Court rules dictate the specific format and required contents. Many courts publish templates or forms that show what information must be included.

The petition is then filed with the court clerk. Filing fees vary by state and county, ranging from $0 to $300 or more. Some courts waive fees for individuals with low income, though fee waiver procedures vary. You will receive a filing date and case number.

After filing, the prosecution (district attorney or state attorney) typically receives a copy of your petition. In many cases, prosecutors must respond within a set timeframe—usually 20 to 30 days. Some prosecutors object to sealing; others do not oppose it. The judge may then review the petition and any response, or may schedule a hearing where both sides may present arguments.

The timeline from filing to final order typically ranges from 30 days to several months, depending on case complexity, court caseload, and whether objections are filed. After the judge signs an order sealing the record, the court notifies relevant agencies—including police departments, prosecutors, and background check companies—to seal or restrict the record in their databases.

Practical Takeaway: Contact your county court clerk's office and ask for the specific steps required to file a petition for record sealing in your jurisdiction. Request any forms, instructions, or fee information. Ask about filing fees and fee waiver procedures. Many court websites now provide step-by-step guides and downloadable forms.
