Understanding 18-Wheeler Accidents and Why They're Different

Eighteen-wheeler accidents—also called semi-truck or commercial vehicle accidents—are fundamentally different from regular car crashes. These massive vehicles can weigh up to 80,000 pounds when fully loaded, compared to a typical car weighing around 3,500 pounds. This enormous weight difference means the damage and injuries from an 18-wheeler accident are often catastrophic.

According to the National Highway Traffic Safety Administration (NHTSA), large trucks were involved in 5,837 fatal crashes in 2022, accounting for about 13% of all traffic fatalities. In Texas, commercial vehicle accidents represent a significant portion of roadway incidents. San Antonio, located on major interstate corridors including I-37 and I-35, sees regular 18-wheeler traffic due to its position along key logistics and distribution routes.

When a collision involves a semi-truck, multiple parties may share responsibility—including the truck driver, the trucking company, the vehicle manufacturer, or maintenance providers. This complexity means accident claims often involve several insurance companies and legal considerations beyond what you'd encounter in a standard vehicle accident.

The investigation process also differs significantly. Federal regulations govern commercial trucking, and accident investigations typically examine the truck's black box data, maintenance records, driver logs, and compliance with Department of Transportation (DOT) regulations. These investigations are more thorough and technical than investigations into regular vehicle accidents.

Practical Takeaway: Understanding that 18-wheeler accidents involve unique legal, regulatory, and technical factors helps you recognize why working with someone familiar with commercial vehicle claims is important for protecting your interests.

How to Document the Accident Scene and Gather Evidence

Proper documentation at the accident scene is crucial for an 18-wheeler claim. The first priority is always safety—if you can do so without risk, gather information that will support your claim later. Start by calling emergency services if there are injuries, and make a police report, which is often legally required for serious accidents involving commercial vehicles.

Photography and video documentation should include multiple angles of the accident scene. Take pictures of the truck's position, vehicle damage on all sides, road conditions, weather, traffic signals or signs, and any visible driver behavior or condition. If possible, photograph the truck's license plate, company name, and any identifying numbers on the trailer. These images create a visual record that memories cannot fade over time.

Collect contact information from witnesses—including their names, phone numbers, and written statements about what they saw. Witnesses present at the scene have the most immediate perspective of how the accident occurred. Police reports will include some witness information, but getting direct contact details allows you to follow up later if needed.

Document medical attention you receive immediately and in the days following the accident. Keep records of hospital visits, emergency room reports, doctor visits, and prescribed medications. Medical records create a documented timeline linking your injuries to the accident. Even injuries that seem minor at first can develop complications, so complete medical documentation is important.

Preserve evidence like damaged clothing, personal items from the vehicle, and any physical objects involved in the collision. Insurance companies and investigators examine these items as part of their review. Keep records of all expenses related to the accident—vehicle rental, transportation, medical co-pays, and lost wages if you missed work.

Practical Takeaway: Comprehensive evidence collection at the scene and in the immediate aftermath creates a strong foundation for your claim, making it harder for insurance companies to dispute what happened or minimize your damages.

Understanding Liability and Fault in Commercial Truck Accidents

Determining who is legally responsible for an 18-wheeler accident involves examining multiple potential liable parties. Unlike single-vehicle accidents where fault may be clear, commercial truck accidents often involve shared responsibility among several entities.

The truck driver may be liable if they violated traffic laws, drove recklessly, operated while fatigued, or failed to follow proper procedures. Federal regulations limit truck drivers to 11 hours of driving after 10 consecutive hours off duty, so investigators examine electronic logging devices (ELDs) and logbooks to determine if the driver exceeded these limits. Fatigue is a factor in approximately 13% of commercial truck accidents according to the Federal Motor Carrier Safety Administration (FMCSA).

The trucking company can be held liable through a legal principle called "vicarious liability," meaning they're responsible for their employees' actions during work. Additionally, trucking companies are responsible for hiring qualified drivers, maintaining vehicles properly, and ensuring compliance with federal regulations. If a company failed to maintain the truck and mechanical failure contributed to the accident, the company bears liability.

Other potentially liable parties include:

• Cargo loaders who improperly loaded or secured freight, affecting the truck's handling or causing cargo spillage
• Maintenance facilities that failed to repair known mechanical problems
• Vehicle manufacturers if a defect in the truck or trailer contributed to the accident
• Other drivers whose actions forced the truck driver into the accident situation
• Road maintenance authorities if poor road conditions or inadequate signage contributed to the accident

Texas follows a modified comparative negligence rule, meaning an injured person can recover damages even if partially at fault, as long as they're not more than 50% responsible for the accident. However, any recovery is reduced by the percentage of fault assigned to them. For example, if you're 20% at fault, your compensation would be reduced by 20%.

Practical Takeaway: Identifying all potentially liable parties early in the process maximizes the sources of compensation available to you and prevents missing important claims due to statute of limitations deadlines.

Navigating Insurance Companies and Coverage Types

Commercial trucking involves multiple layers of insurance coverage that work differently than standard auto insurance. Understanding these layers helps you know where to direct your claim and what compensation may be available.

The trucking company is required by federal law to carry commercial liability insurance with minimum coverage of $750,000 for accidents involving cargo transportation. This is the primary source of compensation for injuries and damages. The insurance company handling this policy will assign an adjuster to investigate the accident. It's important to know that this insurance company represents the trucking company's interests, not yours.

Your own auto insurance policy may provide coverage through an underinsured motorist (UIM) clause. While the truck's insurance is typically adequate, UIM coverage provides an additional layer if the damages exceed the truck company's insurance limits. Medical payments coverage under your own policy may cover some medical expenses regardless of fault, which can be valuable for immediate costs.

If you're a passenger or were struck while on foot or bicycle, you may also have claims against the responsible party's insurance, your own insurance, or potentially through the at-fault driver's personal auto insurance if they owned the vehicle personally rather than for commercial purposes.

Insurance companies often attempt to settle claims quickly and for less than full value. They use various tactics including:

• Offering quick settlement before you understand the full extent of your injuries
• Requesting you sign medical authorization forms that give them access to your complete medical history
• Making low initial offers hoping you'll accept out of financial pressure
• Disputing the severity of your injuries based on their own medical reviews
• Arguing comparative fault to reduce their obligation

In San Antonio, commercial trucking insurance claims are common enough that most insurance companies have established processes for handling them. However, these processes are designed to minimize payouts. You're not obligated to accept the insurance company's first offer or even to negotiate directly with them.

Practical Takeaway: Understanding the insurance structure involved in commercial truck accidents helps you recognize when settlement offers are inadequate and know when to seek additional counsel before accepting any settlement.

The Role of Federal Regulations in Your Claim

Federal regulations create a unique framework for 18-wheeler accident claims that doesn't apply to regular vehicle accidents. These regulations exist to promote safety and create standards that can establish negligence when violated.

The Federal Motor Carrier Safety Administration (FMCSA) maintains extensive regulations affecting commercial trucking operations. Key regulations relevant to accident claims include hours-of-service limits, vehicle maintenance requirements, driver qualifications, and cargo securement standards. When a truck company or driver violates these regulations and an accident results, the violation can establish negligence
