How To Get Married At The Courthouse

Understanding Courthouse Marriage Basics

A courthouse marriage is a civil ceremony conducted by a judge, magistrate, or authorized official at a government courthouse rather than in a church or wedding venue. This process offers a straightforward, legally binding way to marry without the planning and expense of a traditional wedding. According to the U.S. Census Bureau, approximately 5-10% of marriages in the United States take place in courthouses or similar civil settings each year, with numbers varying significantly by state and region.

The courthouse marriage process differs fundamentally from religious or ceremonial weddings. Instead of months of planning, large guest lists, and elaborate decorations, you typically need just a marriage license, two witnesses in most states, and a few minutes before an official. The entire ceremony might last 5-15 minutes. A judge or magistrate recites standard vows or allows you to say your own brief statements, then officially pronounces you married and signs the marriage certificate.

Courthouse marriages carry the same legal weight as any other civil marriage. Once the official signs the marriage license, you are legally married in all 50 states and for federal purposes. Your marriage will be recognized for Social Security benefits, tax filing, insurance coverage, inheritance, and all other legal matters. The main difference is the lack of religious content and ceremonial elements—not the legal standing of the marriage itself.

Cost represents another major distinction. A typical courthouse wedding costs between $50 and $300, depending on the state and county. This covers the marriage license fee and sometimes the ceremony fee. By contrast, the average American wedding costs over $30,000 according to recent wedding industry data. For couples prioritizing legal marriage status over celebration, or those with limited budgets, courthouse marriage provides a practical alternative.

Practical Takeaway: Research your specific county courthouse website to understand local procedures. Courthouse marriages are legal, binding, and significantly less expensive than traditional weddings, making them a viable option for many couples.

Obtaining Your Marriage License

Before you can marry at a courthouse, you must obtain a marriage license from your county clerk's office. This is a separate step from the actual marriage ceremony. The marriage license is an official document issued by the county government that gives you permission to marry. You typically cannot get married without this document, and no courthouse official will perform a ceremony without seeing a valid, unissued license.

Requirements for a marriage license vary by state and county but generally include: both partners present in person (some counties allow one partner to authorize someone else in limited circumstances), valid photo identification such as a driver's license or passport, proof of age (usually at least 18 years old, though some states allow younger marriages with parental consent), and a Social Security number. Several states also require proof of citizenship or legal residency. You'll need to complete an application form provided by the county clerk's office, which asks for basic information: full legal names, dates of birth, current addresses, and whether either person has been married before.

Marriage license fees range from $20 to $100 depending on your location. Some counties offer discounts if you take a premarital counseling course—typically saving $10-30 on the license fee. A few states still require blood tests or health screenings, though most abolished this requirement decades ago. Check with your specific county clerk to confirm current requirements, as they may differ from neighboring counties even within the same state.

The waiting period between obtaining a license and using it varies significantly. Some states have no waiting period—you can marry the same day you receive your license. Others require 1-3 day waiting periods. A few states like Arkansas have a three-day waiting period but allow you to waive it with a judge's permission. The license itself remains valid for 30-90 days in most states, though a few states extend this to six months or longer. Always verify your state's specific rules because using an expired license will prevent you from marrying.

Both partners must typically visit the county clerk's office together to apply for a marriage license. Some counties now offer online applications that you can complete before arriving, which speeds up the in-person process considerably. Bring all required documents with you—missing documents mean you'll need to return another time. Visit during normal business hours, which are typically Monday through Friday, 8:00 AM to 5:00 PM, though some county offices now have extended evening or Saturday hours.

Practical Takeaway: Contact your county clerk's office at least two weeks before your desired wedding date to learn specific requirements, fees, and waiting periods. Prepare all required documents and identification to obtain your license in a single visit.

Meeting Legal Requirements and Documentation

Legal requirements for courthouse marriage extend beyond the marriage license itself. Each state and county maintains specific rules about who can marry, when they can marry, and what documentation proves they meet these requirements. Understanding these requirements prevents delays on your wedding day or legal problems after the ceremony.

Age requirements are among the most strictly enforced. All 50 states require both partners to be at least 18 years old to marry without parental consent. However, many states allow younger people—sometimes as young as 16—to marry with written parental or judicial consent. Some states have minimum ages even with parental permission, often 16. A few states still permit marriage at age 15 with consent. You'll need to bring a birth certificate or certified copy showing your age, and if under 18, a parent or guardian must sign the application form.

Divorce decrees or annulment papers are required if either person was previously married. Some states require these documents be dated at least a certain number of days before remarriage—often 30-90 days. You must bring a certified copy of the final divorce decree or annulment order, not just a copy. A certified copy bears a court seal and clerk's signature, proving it's an official document. You can obtain certified copies from the county courthouse where the divorce was finalized by contacting the clerk's office or searching their website.

Identification documents must be valid and current. Both partners need a government-issued photo ID such as a driver's license, state ID card, or passport. The ID must show your current name or explain any name changes—for example, if you changed your name through a previous marriage or legal name change. Expired IDs may or may not be accepted; some counties are flexible while others strictly require unexpired identification. Bring multiple forms of ID if possible, as requirements sometimes change between visits.

Name change documentation becomes important if you've legally changed your name since your last ID was issued. If you've done this, bring a certified copy of your court order for name change, or a certified copy of a previous marriage certificate if you changed your name through that marriage. Without documentation, discrepancies between your ID and marriage license application can cause delays.

Social Security numbers are required by nearly all states for both partners. You'll provide these on the marriage license application. If you don't have a Social Security number, contact the Social Security Administration at least one month before planning your courthouse wedding, as obtaining a number takes time. Some counties may have procedures for people without SSNs, but these are rare and county-specific.

Practical Takeaway: Gather certified copies of all prior divorces, annulments, or name changes at least one month before your courthouse wedding. Create a checklist of required documents specific to your county and verify all ID documents are current and accurately reflect your legal name.

Planning Your Courthouse Wedding Day

Scheduling your courthouse wedding requires contacting the courthouse or judge's office to reserve a time slot. Unlike religious venues that may book months in advance, courthouse weddings often can be scheduled within days or weeks. However, some busy urban courthouses may have longer wait times, sometimes several weeks during peak seasons like summer or around holidays.

Contact your county courthouse and ask for the procedure to schedule a civil marriage ceremony. Some courthouses have a dedicated civil marriage office or clerk who handles scheduling. You'll typically call, visit in person, or submit a request through their website. Ask these specific questions: What days and times are ceremonies performed? How far in advance must you schedule? Is there a waiting list? What is the fee for the ceremony? Who will perform the ceremony? What witnesses are required? Can you bring additional guests, and if so, how many?

Fees for the ceremony itself vary widely. Some courthouses perform ceremonies at no additional charge beyond the marriage license fee. Others charge $25-$75 for the judge or magistrate to perform the ceremony. A small number of courthouses have higher fees, especially in major cities. Ask about the fee during scheduling so you're not surprised on the day of the wedding.
