How to Get a Window Tint Waiver in Delaware

Understanding Delaware Window Tint Laws and Waiver Requirements

Delaware has specific laws governing window tinting on vehicles. These regulations exist to ensure driver visibility and public safety on roadways. The state's window tint law sets limits on how dark window tint can be, measured as a percentage of light that passes through the tinted window. This percentage is called Visible Light Transmission, or VLT.

According to Delaware law, the front windshield may have tint only on the top portion above the manufacturer's AS-1 line. The front side windows must allow at least 70% of light to pass through. Back side windows and rear windshields have less restrictive requirements and may be tinted darker. These numbers mean that front windows must remain relatively transparent so that law enforcement and other drivers can see into the vehicle.

Delaware does permit window tint waivers in certain medical situations. A waiver allows a person to have darker window tint than the law normally permits. The waiver is not automatic or guaranteed simply because someone requests one. Instead, waivers are considered on a case-by-case basis, and the person must provide medical documentation supporting their request.

The primary reason Delaware allows tint waivers relates to medical conditions that make people sensitive to sunlight. Conditions such as photosensitivity, lupus, severe sun allergies, and certain forms of dermatitis can cause extreme discomfort or health risks when exposed to direct sunlight. A person with one of these conditions may experience pain, burning sensations, or worsening of their medical condition during driving.

Practical takeaway: Before pursuing a waiver, understand that Delaware's tint laws exist for safety reasons, and waivers are exceptions granted only when medical necessity is documented. Knowing the standard legal limits helps you understand what variance a waiver might provide.

Medical Conditions That May Support a Waiver Request

Several medical conditions may support a request for a window tint waiver in Delaware. Photosensitivity is among the most common. This condition causes people to experience severe reactions to sunlight, including burning sensations on the skin, headaches, or eye pain. Some people with photosensitivity cannot tolerate direct sunlight without experiencing symptoms within minutes.

Lupus is an autoimmune disease that affects approximately 1.5 million Americans, according to the Lupus Foundation of America. One of lupus's major symptoms is photosensitivity. People with lupus often experience rashes, joint pain, and flare-ups when exposed to UV rays. Driving in bright sunlight can trigger or worsen these symptoms, making tinted windows medically necessary for some individuals with lupus.

Other conditions that may warrant a waiver include:

• Polymorphous light eruption (a skin condition triggered by sun exposure)
• Severe sunburn-prone skin conditions
• Certain eye conditions such as severe light sensitivity or post-surgical light sensitivity
• Xeroderma pigmentosum (a rare genetic disorder causing extreme sun sensitivity)
• Severe rosacea with sun-triggered flare-ups
• Porphyria cutanea tarda (a metabolic disorder)
• Severe migraines triggered by bright light

Not every person with these conditions will receive a waiver. The severity of the condition and how much it impacts the ability to drive safely matters. A person who has mild symptoms that do not prevent driving may not meet the threshold for a medical waiver. The goal is to balance individual medical needs against public safety and visibility requirements.

It is important to note that personal preference, convenience, or comfort preferences alone do not support a waiver request. The condition must be a documented medical diagnosis with symptoms serious enough to create a genuine medical need for UV protection while driving.

Practical takeaway: Document your specific medical diagnosis and how sunlight exposure affects you during driving. This information will be central to any waiver request, so gather medical records that detail your condition and your doctor's assessment of how it impacts your daily activities.

Obtaining Medical Documentation for Your Waiver Request

Medical documentation is the foundation of a window tint waiver request in Delaware. You cannot request a waiver based solely on your own statement. Instead, you need official medical records from a licensed healthcare provider that confirm your diagnosis and explain how the condition necessitates window tinting.

Start by scheduling an appointment with your primary care physician or a dermatologist, ophthalmologist, or rheumatologist—depending on your condition. During this appointment, discuss how sunlight exposure affects you during driving specifically. Explain the symptoms you experience, when they occur, and how they interfere with your ability to drive safely. The doctor needs to understand that this is a driving-related concern, not just general sun sensitivity.

Request that your doctor provide a written statement that includes:

• Your official medical diagnosis
• A description of your symptoms related to sunlight exposure
• The doctor's assessment of how these symptoms affect driving
• The doctor's recommendation for UV protection or window tinting
• The date of the statement and the doctor's signature
• The doctor's contact information and medical license number

Some healthcare providers have experience with tint waiver requests and may have a standard format they use. Others may need guidance on what information to include. Do not hesitate to ask your doctor's office what they typically include in these statements.

If your condition is rare or complex, your doctor may want to reference medical literature or studies supporting the need for UV protection. Medical statements that are detailed and specific carry more weight than generic statements. For example, "Patient has photosensitivity and benefits from UV protection" is less compelling than "Patient has documented polymorphous light eruption with severe phototoxic reactions within 15 minutes of direct sun exposure, which significantly impairs her ability to drive safely during daylight hours."

Keep copies of all medical documentation. You may need to provide these documents to the Delaware Division of Motor Vehicles, to your tint installer, or to law enforcement if you are stopped. Original signatures and letterhead from the healthcare provider strengthen the credibility of the documentation.

Practical takeaway: Schedule an appointment with your doctor and clearly explain your driving-related symptoms. Request a detailed written statement that connects your medical diagnosis directly to the need for window tinting. Obtain multiple copies of any medical documentation you receive.

As of recent years, Delaware has allowed medical exemptions for window tinting, but the specific application process may vary. It is recommended that you call the Delaware DMV's customer service line to ask about medical tint waivers. The DMV staff can explain what forms are needed, what documentation to submit, and where to send your request. The DMV's main office is located in Dover, but requests can often be submitted by mail or may be available through other methods.

When contacting the DMV, have the following information ready:

• Your vehicle identification number (VIN)
• Your driver's license number
• Your vehicle registration information
• A description of your medical condition (general overview)
• Your contact phone number and mailing address

The DMV will likely request that you submit a formal request along with your medical documentation. Some states use standardized medical waiver forms that must be completed by a healthcare provider. Delaware may have such a form, or it may accept a letter from your doctor. The DMV staff can clarify this when you call.

Submit your waiver request with all supporting medical documentation. Include copies of your driver's license and vehicle registration. Keep a record of when you submit the request and any confirmation numbers or references you receive. Processing times vary, but it may take several weeks for the DMV to review and respond to your request.
