How to Get a Divorce in Illinois Guide

Understanding Illinois Divorce Requirements and Residency Rules

Illinois has specific rules about who can file for divorce in the state and how long you must wait before the process can move forward. Understanding these requirements is the first step in learning how divorce works in Illinois.

To file for divorce in Illinois, at least one spouse must be a resident of the state. Illinois law requires that the person filing for divorce (called the "petitioner") must have lived in Illinois for at least 90 days before filing. This 90-day residency requirement is measured from the date you move to Illinois with the intent to stay. If you have lived in Illinois for less than 90 days, you cannot file for divorce in Illinois courts, even if your spouse lives here.

Additionally, Illinois requires a "waiting period" after filing. Under Illinois law, a divorce cannot be finalized for a minimum of 30 days after the petition is filed, unless both spouses agree to waive this waiting period in writing. This means that even in the smoothest divorces where both parties agree on everything, you cannot have a final divorce order sooner than 30 days from filing. The 30-day waiting period exists to give couples time to reconsider their decision.

Illinois recognizes "no-fault" divorce, which means you do not need to prove that your spouse did something wrong. You simply need to state that there has been an "irretrievable breakdown of the marriage." This is different from some other states that still require fault-based reasons like adultery or cruelty. In Illinois, either spouse can file for divorce regardless of whether the other spouse agrees.

One important note: If you were married in another state or country, your marriage is still valid in Illinois, and Illinois courts can still grant a divorce. However, if your spouse currently lives in another state, there are additional legal considerations about which state's courts have authority to handle the divorce.

Practical Takeaway: Before starting any divorce process, confirm that you have lived in Illinois for at least 90 days. If you have not, you may need to wait or consider filing in another state where you or your spouse lives.

The Different Types of Divorce Processes Available in Illinois

Illinois offers several different paths for divorcing couples, depending on whether both spouses agree on the major issues and whether the situation is straightforward or complex. Knowing which path matches your situation can affect how long the process takes and how much it costs.

The most straightforward process is called an "uncontested divorce" or "joint petition divorce." This occurs when both spouses agree on all major issues, including property division, spousal support (also called maintenance or alimony), child custody, and child support if there are children. In an uncontested divorce, couples can file jointly using a simplified process. Both spouses sign the divorce petition together, and they submit agreed-upon documents to the court. In Illinois, uncontested divorces can sometimes be finalized in 30 to 60 days, though the exact timeline depends on the court's schedule and whether all paperwork is completed correctly.

A "contested divorce" occurs when spouses do not agree on one or more major issues. Common disagreements include how to divide property and debts, child custody arrangements, child support amounts, or whether one spouse should pay maintenance to the other. In contested divorces, the process typically takes much longer—often 6 months to over a year—because the court must resolve the disagreements through negotiation, mediation, or a trial.

Illinois also has a "simplified dissolution" process for couples who meet specific requirements. To use simplified dissolution, you must have been married for fewer than 8 years, have no minor children, have limited property and debt, and both agree to the divorce. Simplified dissolution is faster and less expensive because it requires less paperwork and court involvement. Some couples complete a simplified dissolution in just a few weeks.

Many divorcing couples also use "mediation" as part of their divorce process. In mediation, a neutral third party (the mediator) helps the spouses discuss their disagreements and reach agreements on contested issues. Mediation is often faster and less expensive than going to trial because it avoids lengthy court battles. Illinois courts frequently encourage mediation for divorces involving children or significant property disputes.

Practical Takeaway: Evaluate whether you and your spouse can agree on major issues like property division and custody. If you can agree, an uncontested or simplified process may save you considerable time and money. If you cannot agree, budget for a longer process and consider whether mediation might help reduce costs.

Step-by-Step Process for Filing for Divorce in Illinois

Filing for divorce in Illinois involves several steps, each with specific forms and requirements. Understanding the sequence helps you navigate the process more effectively.

The first step is to complete the necessary divorce forms. The main document is called the "Petition for Dissolution of Marriage." This form states basic information about you, your spouse, your marriage, and your children (if any). You must include details such as the date and location of your marriage, when you separated (if applicable), and what you are requesting regarding property division, custody, and support. Illinois provides forms that you can obtain from the court clerk's office or from the Illinois courts website. If you have children, you will also need to complete additional forms about parenting time and child support.

The second step is filing your petition with the circuit court in the county where you live. You must pay a filing fee, which varies by county but typically ranges from $200 to $500. Some people with limited income may request a fee waiver. To file, you go to the circuit court clerk's office in your county, submit your petition and any other required forms, pay the filing fee, and receive a case number.

The third step is "serving" your spouse with the divorce papers. This means your spouse must be formally notified of the divorce filing according to Illinois law. You cannot simply hand them the papers yourself. Instead, you must use one of these methods: hire a process server to deliver the papers, have the sheriff's office deliver them, or if your spouse agrees, have them served through their attorney. Service must be completed and proof of service must be filed with the court before most other steps can happen.

If your divorce is uncontested and both spouses agree, the next step is filing your agreed-upon settlement documents with the court. These documents outline exactly how you and your spouse are dividing property, handling custody, and addressing support issues. Once these are filed and the 30-day waiting period has passed, you can request a final divorce order from the judge.

If your divorce is contested, after your spouse is served with papers, you and your spouse will have specific deadlines for filing responses and exchanging information (called "discovery"). You may then attempt mediation or proceed toward a trial where a judge decides the contested issues.

Practical Takeaway: Start by obtaining the correct forms from your county circuit court clerk or the Illinois courts website. Have these forms completed accurately and completely before filing, as errors can delay your case. Be prepared to pay a filing fee and to properly serve your spouse according to Illinois law.

Dividing Property, Debt, and Marital Assets in Illinois

Illinois uses "equitable distribution" when dividing property in a divorce. This does not necessarily mean a 50/50 split, but rather a division that the court considers fair based on various factors. Learning how Illinois courts approach property division can help you understand what to expect.

Under Illinois law, courts distinguish between "marital property" and "non-marital property." Marital property is property acquired during the marriage and is subject to division. Non-marital property belongs to one spouse and is not divided. Non-marital property includes assets owned before the marriage, inheritances received by one spouse, gifts given specifically to one spouse, and property that spouses specifically agree is non-marital. This distinction is important because it determines what is and is not divided in the divorce.

When dividing marital property and debt, Illinois courts consider multiple factors, including: how long the marriage lasted, the age and health of each spouse, each spouse's earning capacity and income, each spouse's contribution to acquiring marital property (including homemaking and child-rearing), the value of each spouse's non-marital property, and whether one spouse is responsible for caring for a child with special needs. Courts also consider the desirability of allowing the custodial parent to remain in the marital home.

Common marital assets subject to division include: the family home, vehicles, bank accounts and savings, investments and
