How To File a Work Grievance Guide

Understanding Workplace Grievances and When to File

A workplace grievance is a formal complaint an employee makes when they believe their employer has treated them unfairly, violated workplace rules, or broken an agreement. Grievances differ from informal concerns. When you have an informal concern, you might mention an issue to your supervisor or manager in conversation. A grievance is different—it's a documented, official complaint that starts a formal process.

Common reasons employees file grievances include: being passed over for promotions they believe they deserved, receiving discipline they feel was unfair, experiencing harassment or discrimination, not receiving promised pay or benefits, being assigned unsafe working conditions, having their hours reduced without explanation, or facing retaliation for reporting safety violations. Some grievances relate to contract violations when an employment agreement exists. Others concern violations of company policies written in employee handbooks.

Not every workplace problem requires a formal grievance. Minor disagreements with coworkers, occasional scheduling conflicts that get resolved, or one-time instances of unclear instructions typically don't warrant formal grievances. However, patterns of behavior—such as repeated unfair treatment or ongoing discrimination—do warrant grievance filings. Similarly, serious violations like safety hazards, wage theft, or discrimination should be addressed through formal channels.

Understanding the difference between what requires a grievance and what doesn't matters because filing a grievance starts a formal process that takes time and energy. Many workplaces have specific procedures outlined in their employee handbook. Some industries, like transportation or manufacturing with union representation, have detailed grievance procedures established by union contracts.

Timing matters when considering a grievance. Most workplaces have time limits—often 30 to 60 days from when the problem occurred—for filing a grievance. If you wait too long, the employer may refuse to process your complaint, saying the time limit has passed. Understanding your workplace's specific rules about time limits is important before proceeding.

Practical Takeaway: Review your employee handbook or ask your HR department about your workplace's definition of grievances and time limits for filing. Document the specific date, time, and details of any workplace issue you're considering filing a grievance about, since you'll need this information later.

Reviewing Your Workplace Policies and Procedures

Every workplace has its own grievance procedures. Some are simple and informal. Others are detailed, multi-step processes. Before filing a grievance, you need to understand your specific workplace's procedures because following the correct steps matters significantly.

Your employee handbook is the primary source for this information. Most handbooks contain a section titled "Grievance Procedure," "Employee Complaints," or "Dispute Resolution." This section explains the steps you must follow, who to contact, what forms to use, and what timelines apply. If you don't have a copy of your employee handbook, request one from your HR department. Many employers now provide digital copies during onboarding or make them available on employee portals.

Key details to look for in your workplace procedures include: whether informal resolution attempts are required before filing formal grievances, which manager or department receives grievances, what forms or formats you must use, what timeline you have for filing after an incident occurs, how many appeal steps exist if you're not satisfied with the initial response, and whether the process is different for different types of complaints. Some workplaces require you to first discuss the issue with your direct supervisor before escalating to HR. Others allow you to skip this step if you're uncomfortable speaking with your supervisor—for example, if your supervisor is the person you're complaining about.

Union workplaces typically have more formal, detailed grievance procedures established through collective bargaining agreements. These procedures often include specific language about how grievances must be written, strict timelines for each step, and detailed information about who handles grievances at each level. If you work in a unionized position, your union representative can provide copies of these procedures and explain them to you.

Some workplaces distinguish between different types of grievances. Complaints about wage issues might follow one procedure. Complaints about safety might follow another. Complaints about discrimination might go to a different department entirely. Understanding these distinctions in your workplace prevents your grievance from being misdirected or dismissed for following the wrong procedure.

Pay particular attention to any statements about retaliation protections. Most workplaces include language stating that employees will not face retaliation for filing good-faith grievances. Understanding what protections exist in your workplace is important if you're concerned about potential negative consequences after filing.

Practical Takeaway: Obtain a copy of your workplace's grievance procedure and read it carefully. Write down the specific steps, timelines, and contact information. If anything is unclear, contact HR and ask questions before filing your grievance.

Gathering Documentation and Evidence

Documentation is the foundation of a strong grievance. Without evidence supporting your complaint, your employer may dismiss it or claim they don't remember the incident. Written records, dates, witnesses, and other documentation transform a "he said, she said" situation into a factual account that's harder to dispute.

Start by writing down everything you remember about the incident or incidents that prompted your grievance. Include the date (or approximate date if you're not certain), the time if relevant, the specific location, exactly what happened, what was said, who was present, and how it affected you. For example, instead of writing "My boss treated me unfairly," write "On March 15, 2024, at approximately 2 p.m., my supervisor told me in front of my coworkers that my work quality was unacceptable and said 'You're the worst performer on this team.' No previous warning or discussion about my performance had occurred. Three months earlier, I received a satisfactory performance review."

Gather any written evidence related to your grievance. This might include email exchanges, text messages from your supervisor or coworkers, performance reviews, pay stubs showing wage discrepancies, photographs of unsafe conditions, accident reports, calendar invitations, or any written communication mentioning the issue. Save copies of these documents and organize them chronologically. If emails are relevant, print them or take screenshots that clearly show the date, sender, recipient, and content.

Identify witnesses who observed the incident. Write down their names, positions, and a brief description of what they witnessed. Later, you may ask whether they're willing to support your grievance, but at this stage, simply note that they were present and observed the situation. Witness statements can substantially strengthen a grievance, as they provide independent corroboration of your account.

For ongoing issues rather than single incidents, create a timeline documenting each occurrence. For example, if you're grieving repeated instances of harassment, list each incident separately with dates and details. This pattern documentation demonstrates that the problem is systematic rather than a single misunderstanding.

Keep records going forward. If additional incidents occur after you decide to file a grievance, document them the same way. Don't alter or backdate documents—employers can often tell if records were created after the fact, and falsified documentation damages your credibility.

Be cautious about confidentiality. In most cases, what you document for your own records is yours to keep. However, once you file a grievance, the employer may request to see all documentation you've gathered. Assume anything you create may eventually be reviewed by your employer or potentially by an outside investigator.

Practical Takeaway: Before filing your grievance, gather all relevant documents, create a detailed written account of what happened, list witnesses, and organize everything chronologically. Keep this documentation in a safe location—consider maintaining copies at home in case questions arise later.

Preparing Your Written Grievance

Most workplaces require grievances to be submitted in writing rather than verbally. A written grievance creates an official record, prevents misunderstandings about what you complained about, and documents when you filed the complaint. Writing your grievance clearly and professionally increases the likelihood that your employer will take it seriously.

Start by using your workplace's official grievance form if one exists. This ensures you include all required information and follow the format your employer expects. If no form exists, write a formal letter or email. Include a clear subject line: "Formal Grievance" or "Workplace Grievance Submission" followed by a brief description of the issue.

Your grievance should include several key sections. First, clearly state the nature of your complaint in one or two sentences. For example: "I am filing this grievance regarding unfair discipline. On March 15, 2024, I received a written warning for attendance, despite having only one
