Understanding Quitclaim Deeds: What They Are and How They Work

A quitclaim deed is a legal document that transfers property ownership from one person (called the grantor) to another person (called the grantee). The word "quitclaim" comes from the idea of "quitting" or releasing any claims you have to a property. When you sign a quitclaim deed, you are essentially saying that you give up whatever rights or ownership stake you have in that property and transfer those rights to someone else.

Unlike other types of deeds, a quitclaim deed does not guarantee that you actually own the property or that the property is free from debts, liens, or other claims against it. This is a critical distinction. A quitclaim deed simply transfers whatever interest you have—which might be a full ownership stake, a partial stake, or possibly nothing at all if you never actually owned the property. Many people misunderstand this point and assume that receiving a quitclaim deed means they are getting a guaranteed, clear ownership of property. That is not necessarily true.

Quitclaim deeds are commonly used in several situations. Family members often use them to transfer property between relatives without going through a formal sales process. For example, if a parent wants to give property to a child, a quitclaim deed can accomplish this. They are also used when someone inherits property and needs to formalize the transfer. Additionally, quitclaim deeds can be used to clear up title issues—for instance, if an ex-spouse has some claim to property after a divorce, a quitclaim deed can remove that claim.

The process of creating and recording a quitclaim deed varies by state. Most states require the deed to include specific language, the legal description of the property, the names and addresses of both the grantor and grantee, and the signatures of the person transferring the property. Some states require the deed to be notarized, meaning a notary public must witness the signatures and verify the identity of the person signing.

Practical Takeaway: Before using a quitclaim deed, understand that it transfers only the rights the grantor currently has—not a guarantee of full ownership. If you are receiving a quitclaim deed for valuable property, you may want to have a title search performed to discover any existing liens, mortgages, or other claims against the property. This protects you from inheriting unknown debts.

The Differences Between Quitclaim, Warranty, and Grant Deeds

Real estate can be transferred using different types of deeds, and each type offers different levels of protection to the person receiving the property. Understanding these differences is important because they affect your rights and protections as a property owner.

A quitclaim deed provides the least protection to the grantee. When you receive property via quitclaim deed, you are receiving only what the grantor claims to own. If the grantor's ownership is partial, disputed, or nonexistent, that is what you receive. The grantor makes no promises about the condition of the title or whether anyone else might have claims to the property. This makes quitclaim deeds risky when dealing with valuable property or when you do not know the grantor well.

A warranty deed (also called a general warranty deed in some states) offers much stronger protection. When property is transferred by warranty deed, the grantor is making specific legal promises, called covenants of title. These promises typically include: (1) the grantor has the right to transfer the property, (2) the property is free from liens and encumbrances except those disclosed, (3) the grantor will defend the grantee against any claims to the property, and (4) the title extends back in time and is legitimate. If any of these promises are broken, the grantor can be held legally and financially responsible. This is why banks and mortgage lenders almost always require a warranty deed when financing a property purchase.

A grant deed falls somewhere in the middle. It is more protective than a quitclaim deed but less protective than a warranty deed. A grant deed typically includes promises that the grantor owns the property and has not already transferred it to someone else, but it may not include all the protections of a warranty deed. Grant deeds are common in some states, particularly in the West.

The choice of deed type matters most when money is involved. In family transfers where no money changes hands, a quitclaim deed may be acceptable and is often used. However, if you are purchasing property, you should insist on a warranty deed or, at minimum, a grant deed. Understanding these differences protects you from unexpected ownership problems or financial loss later.

Practical Takeaway: When purchasing property, always require a warranty deed rather than accepting a quitclaim deed. The small additional cost of obtaining title insurance and using a warranty deed is far less than the potential cost of dealing with ownership disputes or hidden claims against the property years later.

Step-by-Step Process for Creating and Recording a Quitclaim Deed

Creating a quitclaim deed involves several specific steps, and the exact requirements vary depending on which state the property is located in. However, the basic process is similar across most jurisdictions.

The first step is to obtain the legal description of the property. This is not simply the street address. The legal description is a detailed, precise description that identifies the exact boundaries and location of the property. You can find the legal description on previous deeds, property tax records, or survey documents. Getting this description exactly right is crucial because an incorrect legal description could make the deed invalid or transfer the wrong property.

The second step is to draft the deed document itself. You can find quitclaim deed forms online, purchase them from office supply stores, or have an attorney draft one. The deed must include: the names and addresses of the grantor (person transferring) and grantee (person receiving), the legal description of the property, language showing the intent to transfer the property, the date, and signatures. Many states also require a declaration of consideration, which states whether money changed hands and, if so, how much. Some people leave this blank or state "for love and affection" in family transfers.

The third step is to have the deed notarized if your state requires it. Notarization means taking the unsigned deed to a notary public, proving your identity, and signing it in front of the notary. The notary then stamps and signs the document, certifying that the person who signed was indeed the person identified. Currently, 41 states require quitclaim deeds to be notarized. A few states do not require notarization for quitclaim deeds, though it is still recommended for proof of execution.

The fourth step is to record the deed with the appropriate government office, typically the county recorder, register of deeds, or clerk's office where the property is located. Recording creates an official public record of the transfer. To record a deed, you generally submit the original or a certified copy to the recorder's office, along with any required forms and a recording fee. Recording fees vary widely by county but typically range from $10 to $50. Once recorded, the deed becomes part of the public record, and the grantee's ownership interest is established in the official property records.

Practical Takeaway: Always record the deed in the county where the property is located. Many people make the mistake of signing a quitclaim deed but never recording it. Without recording, the transfer may not be legally effective, and the property may still appear to belong to the grantor in public records. Recording is what finalizes the transfer.

Common Uses of Quitclaim Deeds in Family and Personal Situations

Quitclaim deeds are particularly common in personal and family situations because they are simple, relatively inexpensive, and do not require the same level of legal formality as a warranty deed. Understanding these common uses can help you recognize when a quitclaim deed might be appropriate.

One of the most common uses is transferring property between family members. Parents frequently use quitclaim deeds to transfer property to adult children. For example, if a parent owns a vacation home and wants to give it to their adult daughter, a quitclaim deed accomplishes this transfer without requiring a formal sale. Similarly, when a parent passes away, heirs sometimes use quitclaim deeds to transfer inherited property from one family member's name to another's, especially if the will was not formally probated or if the property needs to be retitled quickly.
