Free Guide to Illinois Car Title Transfer Process

Understanding Illinois Car Title Transfer Basics

A car title is an official document that proves who owns a vehicle. In Illinois, the Secretary of State issues titles for all motor vehicles. When you buy, sell, inherit, or receive a car as a gift, the title must be transferred to reflect the new owner's name. This transfer is a legal requirement under Illinois Vehicle Code Section 3-202.

The title document itself contains specific information: the vehicle identification number (VIN), the owner's name and address, the lienholder's name (if someone financed the car), the odometer reading, and the vehicle's description. Illinois issues titles in the owner's name, and anyone whose name appears on the title is considered a legal owner.

Illinois recognizes several types of ownership structures on titles. You can hold a title in one person's name, two or more names with "and" between them (meaning both must sign to transfer), or two or more names with "or" between them (meaning either owner can transfer). Understanding which structure applies to your situation matters when you need to transfer the title later.

The state has specific rules about when a transfer must occur. According to Illinois law, a transfer application must be submitted within 30 days of the sale or transfer of ownership. The Secretary of State's office processes thousands of title transfers each month. Knowing the correct process prevents delays and potential penalties.

Practical takeaway: Before starting a title transfer, locate your current title document and check whose names appear on it and how they are connected. This determines what steps you must follow and whose signatures are necessary.

Documents You Will Need for a Title Transfer

Completing a title transfer in Illinois requires gathering several specific documents. The most important is the current title certificate itself. If you cannot locate the original title, you can request a duplicate from the Secretary of State's office for a fee, but having the original makes the process more straightforward.

You will need a completed Application for Illinois Title (Form VSD 190). This is the official form that tells the state about the ownership change. The form requires information about the vehicle, the current owner, and the new owner. You can obtain this form from the Secretary of State's website, at any Secretary of State Driver Services facility, or through some currency exchange businesses and private automobile transactions services.

Both the buyer and seller (or current owner and new owner) must sign documents related to the transfer. The seller must sign the back of the title certificate or a separate assignment form if the title is new enough to have an assignment box. The buyer must sign the Application for Illinois Title. Both signatures must be original, not photocopied or electronic. Some situations may require notarization of signatures, particularly if owners are transferring titles between family members or if the vehicle has a lien.

Proof of ownership is sometimes required. If you are the new owner, you typically need a bill of sale or purchase agreement showing the transaction details and purchase price. If the car is a gift, you need a document stating it was given without payment. If you inherited the vehicle, you need a copy of the death certificate and documents showing your relationship to the deceased owner or proof that you are named in their will or estate.

If the vehicle has an outstanding loan, the lienholder's information must appear on the title. In some cases, the lender will need to sign off on the transfer or release their lien interest. You will need written permission or a lien release document from the lender showing the loan has been paid and they authorize the transfer.

Practical takeaway: Create a checklist of documents before visiting a Secretary of State facility. Common missing items are the signed title, completed application form, and proof of purchase. Having everything prepared prevents multiple trips.

Step-by-Step Title Transfer Process in Illinois

The Illinois title transfer process follows a specific sequence. Start by obtaining and completing the Application for Illinois Title (Form VSD 190). Fill in all required fields accurately, including the vehicle's VIN, make, model, year, and odometer reading. The form asks for both the current owner's information and the new owner's information. Pay close attention to spelling names exactly as they appear on the current title.

Next, ensure the current title is properly signed. The person or people listed as the owner on the existing title must sign the assignment section on the back of the certificate. This signature transfers ownership from the current owner to the new owner. If there are multiple owners with "and" between their names, all must sign. If the title has "or" between names, only one needs to sign, but it is cleaner if both do.

Once the title is signed and the application is completed, gather all supporting documents. These might include a bill of sale, gift letter, or inheritance documentation, depending on how the vehicle changed hands. If the title carries a lien, ensure you have the lender's release or permission to transfer.

You then submit all materials to the Secretary of State. In Illinois, you can do this in person at any Driver Services facility throughout the state. You can also mail documents to the Secretary of State's office in Springfield. Mail processing typically takes longer than in-person submission. A few private businesses are authorized to handle title transfers on behalf of the Secretary of State; these include some currency exchanges, certain check-cashing services, and private vehicle transaction companies. These services charge additional fees beyond the state's transfer fee.

When submitting in person, bring your identification and payment. Illinois charges a title transfer fee, which was $150 as of 2024 (fees can change, so verify the current amount). If you are transferring a title for a vehicle with a lien, the fee structure may be different. The Secretary of State accepts cash, check, debit card, and credit card at most facilities.

After submission, the Secretary of State processes your transfer application. Standard processing takes several weeks. You will receive a new title in the mail with the new owner's name. During this waiting period, the vehicle registration may need to be updated separately if the new owner plans to drive it on public roads.

Practical takeaway: Submit your title transfer documents within 30 days of the vehicle's sale or transfer. Delays in submission can result in penalties and may complicate the process if the vehicle is sold or transferred again.

Special Circumstances and Unique Transfer Situations

Some title transfers involve situations beyond a simple buyer-seller transaction. Inheritance transfers occur when a vehicle owner passes away and their heirs gain ownership. In these cases, you need the death certificate, proof of your relationship to the deceased (such as a birth certificate), and often a copy of the will or trust documentation showing who should receive the vehicle. If the estate goes through probate, you may need an affidavit from the probate court showing you have authority to transfer the title.

Gift transfers happen frequently within families. When someone gives a vehicle to a family member without payment, Illinois still requires a title transfer. You need a gift affidavit or a signed statement from the giver saying the vehicle is a gift with no money exchanged. Some notaries provide gift affidavits, or you can create a simple written statement on plain paper with the giver's signature. Illinois does not charge sales tax on gift transfers, unlike purchases, so this documentation is important.

Transfers involving liens present additional steps. If you are buying a vehicle that still has an outstanding loan, the seller cannot transfer full ownership until the lender releases the lien. Most commonly, the buyer's lender will pay off the seller's loan at closing, and the title transfers free and clear. If you are assuming a loan from the previous owner (less common), the lender must approve the transfer and may provide a special lien assignment document.

Joint ownership transfers require attention to how names are connected on the current title. If the title shows names with "and," both owners must sign any transfer documents. If it shows "or," either owner can typically authorize a transfer, though it is better practice to get both signatures when possible. If owners disagree about transferring a vehicle titled jointly, the situation becomes complicated and may require legal assistance.

Transfers from businesses to individuals occur when a sole proprietor is registering a business vehicle under personal ownership or when a business is closing and selling its fleet. These require additional documentation like a business dissolution notice or a copy of the business license.

Transfers involving vehicles with salvage or rebuilt titles follow the same process but may have additional restrictions. Illinois issues salvage titles for vehicles declared total losses by insurers and rebuilt titles for salvage vehicles that are repaired and pass inspection. The Secretary of State tracks these designations carefully to prevent fraud.
