Free Guide to Filing Apartment Complaints in Texas

Understanding Your Rights as a Tenant in Texas

Texas Property Code Chapter 92 establishes minimum standards for rental properties and outlines what landlords must provide. As a tenant, you have the legal right to a habitable living space, which means your apartment must meet certain basic conditions. These requirements include functioning plumbing and water systems, adequate heating and cooling that maintains temperatures between 68 and 78 degrees Fahrenheit, working electrical outlets and lighting, safe structural components free from significant damage, and pest control treatments when necessary.

Your landlord must maintain these conditions throughout your tenancy. If your apartment fails to meet these standards, you have options for recourse. The law recognizes that tenants deserve safe, livable spaces, and it provides mechanisms to enforce this principle. Understanding what constitutes a habitability violation is the first step in addressing problems with your living space.

Texas law also protects tenants from retaliation. If you file a complaint about conditions in your apartment, your landlord cannot legally evict you, raise your rent, or reduce services in response to that complaint within six months. This protection exists specifically to encourage tenants to report problems without fear of negative consequences.

Different types of issues fall under the habitability umbrella. Water damage that creates mold, broken windows that compromise security and temperature control, inadequate locks on doors, non-functioning appliances that came with the unit, and pest infestations all represent potential violations. Cosmetic issues like paint color or minor wear and tear typically do not qualify as habitability problems unless they create safety concerns.

Practical Takeaway: Before filing any complaint, document which specific habitability standards your apartment fails to meet. Make a list of the issues and note how they affect your daily living. This foundation will make your complaint stronger and clearer.

Documenting Problems in Your Apartment

Strong documentation is critical when filing a complaint. Start by taking photographs and videos of every problem you identify. Capture multiple angles and ensure lighting is good enough to clearly see the issue. For water damage, photograph not just the stain but also any peeling paint, discoloration patterns, or soft drywall. For pest problems, photograph droppings, damage to food packaging, or any insects you observe. For heating or cooling issues, take a photo of your thermostat showing the current temperature, and note what outdoor temperature is at that time.

Write detailed notes about each problem, including the date you first noticed it, how it has worsened over time, and how it affects your ability to use your apartment. For example, instead of writing "bathroom leak," write "Water leaks from ceiling in master bathroom during rain. Leak started March 15. Water pools on the floor, creating a slip hazard. Ceiling drywall is soft and may collapse. Mold smell is present." Specific details create a compelling record.

Keep copies of all communication with your landlord. Save text messages, emails, and photos of any written notes you left. If you spoke with your landlord in person, follow up with a text or email summarizing what you discussed. For example: "Following up on our conversation today about the broken kitchen window. You mentioned you would contact a repair person. I have not heard from anyone. Please let me know when repairs will be scheduled."

Create a timeline document showing when you first reported each problem and how many times you have reported it. Include your landlord's responses or lack thereof. This record demonstrates whether your landlord has been given a reasonable opportunity to make repairs. Texas law generally allows landlords 3 to 7 days to address maintenance issues, depending on the severity. If you reported a problem weeks ago and nothing has changed, this timeline proves your landlord has failed to respond appropriately.

Practical Takeaway: Use your phone's camera to document problems on the same day you notice them, or within a few days. Create a folder on your computer labeled "Apartment Issues" and save all photos, texts, and notes there. This organized approach makes filing a complaint much easier.

How to File a Complaint With Your Local Health Department

The local health department investigates complaints about habitability conditions that create health or safety hazards. These include mold growth, pest infestations, water leaks, sewage problems, and issues with drinking water. To file a complaint, contact your city or county health department directly. You can find the phone number or online complaint form by searching "[your city name] health department" or "[your county name] health department."

When you call or complete an online form, provide specific information about the problems. Include your apartment address, the nature of the problem, how long it has existed, and what attempts you have made to get it fixed. Describe how the problem affects your health or safety. For a mold issue, explain if anyone has experienced respiratory problems. For a pest problem, describe what types of pests you have seen and how frequently.

Most health departments will schedule an inspection. The inspector will visit your apartment to verify the conditions you reported. You should be present during this inspection to show the inspector exactly where problems are located and to explain the issues. The inspector will take photographs and document findings. After the inspection, the health department typically issues a report and may order your landlord to correct the problems within a specific timeframe.

Some health departments allow you to file complaints online, while others require a phone call. A few accept written complaints by mail. Having your documentation organized before you contact the health department makes the process faster. The health department will likely ask questions about when the problem started, whether you have reported it to your landlord, and what response you received. Your timeline and notes will help you answer these questions accurately.

Health department complaints carry weight because they involve government oversight and can result in official orders to repair. Landlords take these complaints seriously because violations can result in fines or license penalties. However, the health department process can take weeks or months. If you have an urgent health or safety issue, you may need to pursue other remedies simultaneously.

Practical Takeaway: Call your local health department first thing on a weekday morning when lines are less busy. Have your documentation ready and explain the health or safety impact of the problem, not just the inconvenience.

Filing a Complaint With the Texas Attorney General's Office

The Texas Attorney General's Consumer Protection Division handles complaints against landlords for violations of the Property Code and other consumer protection laws. You can file a complaint through their online portal at texasattorneygeneral.gov. The website has a consumer complaint form that walks you through the process step by step.

To file a complaint with the Attorney General, you will need to provide your name and contact information, your landlord's name and the property address, a description of what happened, copies of any relevant documents like lease agreements or communications with your landlord, and details about what steps you have already taken to resolve the problem. The form asks for dates when problems occurred and when you reported them.

The Attorney General's office does not conduct investigations in every case. Instead, they review complaints to identify patterns. If multiple tenants file complaints against the same landlord, this creates a stronger case for the state to take action. Your individual complaint contributes to this pattern. The office may contact your landlord to ask for their response to your complaint.

This process is slower than a health department inspection because the Attorney General handles a high volume of complaints across all consumer issues, not just rental housing. However, having a formal complaint on file with the state creates an official record. If your landlord faces repeated complaints or fails to respond to the Attorney General, the state may take enforcement action.

The Attorney General's complaint process works best when combined with other approaches. File here if you have already tried contacting your landlord directly and the problem remains unsolved. This shows you have made good-faith efforts to resolve the issue before involving state authorities.

Practical Takeaway: Before filing with the Attorney General, ensure you have a clear record of your attempts to get your landlord to fix the problem. Include at least one written request (text, email, or letter) that your landlord did not adequately address.

Understanding Repair and Deduct Laws in Texas

Texas Property Code Section 92.008 allows tenants to hire repairs themselves and deduct the cost from rent under specific circumstances. This option exists when a landlord has been given notice of a repair need and has failed to complete the repair in a reasonable time. This is a powerful tool, but it must be used correctly to be legal.
