Free Guide to Delaware E-ZPass Violation Payments

Understanding Delaware E-ZPass Violations

Delaware's E-ZPass system is an electronic toll collection method that allows drivers to pay tolls automatically as they pass through toll plazas on Delaware highways and bridges. The system uses a small transponder mounted on a vehicle's windshield that communicates with toll collection equipment. When a vehicle passes through a toll plaza, the transponder sends a signal, and the toll charge is deducted from the account associated with that transponder.

E-ZPass violations occur when there is a problem with the toll transaction. Common situations that lead to violations include: a transponder that is not properly mounted or activated, a transponder that has insufficient funds in the linked account, a transponder that malfunctions or fails to communicate with the toll equipment, or a vehicle passing through a toll plaza without an active transponder. When a violation occurs, the toll plaza's cameras capture images of the vehicle's license plate, and a violation notice is issued to the vehicle's registered owner.

The Delaware Department of Transportation oversees E-ZPass operations and violation processing in the state. Understanding how violations are created helps drivers take steps to prevent them. Common reasons violations happen include account holders not monitoring their account balance, transponders becoming damaged or knocked loose from the windshield, and drivers switching vehicles without transferring their transponder to the new vehicle. Some violations also occur when a driver borrows a vehicle that does not have a working transponder.

A violation notice will typically arrive by mail at the address associated with the vehicle's registration. The notice includes information about the toll violation, the date and time of the incident, the location where it occurred, and the amount owed. The notice also contains instructions for paying the violation and information about how to dispute the violation if the account holder believes an error was made.

Practical Takeaway: Learn how E-ZPass works and what causes violations so you can take steps to maintain your account and transponder in good working order. Regularly check your account balance and the condition of your transponder to reduce the chances of violations.

What Happens When You Receive a Violation Notice

When a driver receives an E-ZPass violation notice in Delaware, the document will contain specific details about the incident. The notice typically includes the violation date, the toll plaza location, the license plate number, and the amount owed. The amount shown on the violation notice will include the unpaid toll charge plus a violation fee. Understanding what each part of the notice means helps drivers make informed decisions about how to respond.

Delaware violation notices are sent to the registered owner of the vehicle, not necessarily the person who was driving the vehicle at the time. This means that if someone else was driving the vehicle when the violation occurred, the registered owner is still responsible for the violation. The notice will have a payment due date, which is typically several weeks from the date the notice was issued. During this time, the account holder has the option to pay the violation, dispute it, or request additional information.

The violation fee in Delaware is separate from the unpaid toll charge. While the toll charge is typically between $1.50 and $6.00 depending on the location, the violation fee can be $25 or more. This means that a single missed toll can result in a bill for $30 to $35 or more. Multiple violations can accumulate quickly if not addressed. The notice will clearly show the total amount due, broken down into the toll charge and the violation fee.

If a violation notice is ignored and payment is not made by the due date, additional consequences may follow. The state may send a second notice with increased penalties. Failure to pay can eventually result in vehicle registration suspension, making it illegal to drive the vehicle on public roads. In some cases, the state may pursue collection through other means. These escalating consequences make it important to respond to a violation notice within the timeframe provided.

Practical Takeaway: When you receive a violation notice, review all the details carefully, note the payment due date, and decide whether you will pay, dispute, or request more information. Do not ignore the notice, as doing so can lead to increased penalties and potential registration suspension.

How to Pay Delaware E-ZPass Violations

Delaware provides several methods for paying E-ZPass violations. Understanding the available payment options helps account holders choose the method that works best for their situation. The most common payment method is online through the official Delaware E-ZPass website or toll collection portal. This method allows drivers to pay 24 hours a day from any computer or mobile device with internet access. To pay online, the driver will need the violation notice number or the license plate number from the vehicle that received the violation.

Drivers can also pay E-ZPass violations by mail. To pay by mail, the violation notice itself contains payment instructions and a mailing address. Payments sent by mail should include the violation notice number and be sent to the address listed on the notice. When paying by mail, it is important to allow several weeks for the payment to be processed and received. Some account holders prefer mailing a check because it provides a paper record of payment, and they can track when the check clears their bank account.

Telephone payment is another option for some E-ZPass violation notices. The violation notice will indicate if this method is available and will provide a phone number to call. When paying by phone, drivers should have the violation notice number and a valid payment method ready. Phone payments are typically processed using a credit or debit card. A small convenience fee may apply to telephone payments, so it is worth checking if this fee will be charged before confirming the payment.

Payment in person may be possible at certain locations in Delaware. Some Delaware Department of Transportation offices accept in-person payments for E-ZPass violations. Drivers should call ahead to confirm where payments can be made and what hours the office is open. Paying in person allows for immediate processing and provides a receipt that can be kept as proof of payment. If paying in person, bring the original violation notice or have the violation notice number available.

Regardless of which payment method is chosen, it is important to keep a record of the payment. If paying online or by phone, save any confirmation numbers provided. If paying by mail, keep a copy of the check and the mailing envelope. If paying in person, request and keep the receipt. These records help prove that the violation was paid if any questions or disputes arise later.

Practical Takeaway: Choose a payment method that is convenient for you, make sure to have the violation notice number available, and always keep proof of your payment in case questions come up later.

Disputing an E-ZPass Violation in Delaware

If an account holder believes that a violation notice was issued in error, Delaware law provides a process for disputing the violation. Common reasons for disputes include: the transponder was properly mounted and functional at the time of the violation, the account had sufficient funds, the vehicle's registration does not match the plate shown in the violation, or the account holder believes the violation was issued to the wrong vehicle. Understanding how to file a dispute can help resolve situations where an error may have occurred.

The violation notice will contain information about how to dispute the violation. Most notices include a deadline for filing a dispute, which is typically 30 days from the date the notice was issued. To dispute a violation, the account holder must submit a written dispute to the address or online portal indicated on the notice. The dispute should explain clearly why the account holder believes the violation was issued in error and should include any supporting evidence, such as photographs of the transponder, bank statements showing account funds were available, or documentation of vehicle ownership changes.

When submitting a dispute, include specific information such as the violation notice number, the date of the alleged violation, and the toll plaza location. Provide a clear explanation of the error. For example, if the transponder was malfunctioning, explain when it was discovered to be broken and when it was replaced. If the account had sufficient funds, provide a copy of the account statement from the date in question showing the account balance. If the wrong vehicle is listed, provide evidence of when the vehicle's registration was updated or transferred.

After a dispute is filed, the Delaware Department of Transportation will review the information provided. This review process may take several weeks. During this time, the account holder is not required to pay the violation while the dispute is being reviewed. However, if the dispute is denied and the violation is confirmed as valid, payment will then be due. It is important to keep records of all correspondence related to the dispute, including confirmation that the dispute was received.

In some cases, if a dispute involves a transponder malfunction or account error, the account holder may be able to show that the violation was not their responsibility. For
