Free Guide to Cell Phone Driving Laws by State

Overview of Cell Phone Driving Laws Across the United States

Cell phone use while driving has become one of the most common distractions on American roads. According to the National Highway Traffic Safety Administration (NHTSA), distracted driving claimed 3,308 lives in 2022 alone. Each state has responded to this public safety concern by creating its own set of rules about how and when drivers can use phones behind the wheel.

The landscape of cell phone driving laws varies significantly from state to state. Some states have strict bans on all handheld phone use, while others allow certain types of phone activity. A few states have minimal restrictions. This patchwork of regulations reflects different approaches to balancing driver safety with personal freedom and practical communication needs.

Understanding these laws matters for several reasons. First, violating a cell phone law can result in fines, points on your driving record, and increased insurance rates. Second, knowing the rules helps you stay safe and avoid putting yourself and others at risk. Third, if you travel between states or live near state borders, you may encounter different rules depending on where you are driving.

This guide provides information about cell phone driving restrictions across all 50 states. It explains the different types of laws, what activities are banned, what exceptions exist, and what penalties states impose. Whether you drive regularly or occasionally, learning about these laws helps you understand what is legal where you live and in places you visit.

Practical Takeaway: Cell phone driving laws differ by state. Before driving in a new state, research that state's specific rules to avoid unintentional violations and stay informed about safety regulations.

Types of Cell Phone Driving Laws and What They Restrict

States use several different approaches to regulate cell phone use while driving. The most common restriction is a ban on handheld device use. This means drivers cannot hold a phone in their hands while the vehicle is moving. A handheld ban typically applies to texting, calling, and browsing, though some states make exceptions for emergency calls or navigation.

A second type of law bans texting specifically while driving. Texting bans are the most common type of cell phone law in the United States. As of 2024, 48 states plus Washington D.C. ban texting while driving. However, some states that ban texting still allow other handheld phone activities like making calls or using maps. The reasoning behind texting bans is that typing on a phone requires both visual and manual attention, making it particularly dangerous.

A third category includes laws that restrict cell phone use for specific groups of drivers, most commonly teenage drivers and school bus drivers. Many states impose stricter rules on drivers under 18 or under 21 than they do on adult drivers. These age-based restrictions recognize that inexperienced drivers face additional challenges managing both the vehicle and potential distractions.

Some states also distinguish between handheld and hands-free phone use. Hands-free use, where a driver speaks into a phone using Bluetooth or a speaker system without holding the device, faces fewer restrictions in most states. However, several states limit all phone use, whether handheld or hands-free, for certain age groups or in certain situations.

It is important to note that even where hands-free calling is allowed, the act of having a conversation can be mentally distracting. Research shows that cognitive distraction from conversations affects driving ability, but hands-free use is generally considered safer than handheld use because drivers keep both hands on the wheel and maintain better visual attention to the road.

Practical Takeaway: Understand the difference between handheld bans, texting bans, and age-based restrictions in your state. Hands-free use is usually allowed but may still pose safety risks, so use caution even when it is legal.

States with Strict Handheld Bans and Their Penalties

Twenty-four states plus Washington D.C. have enacted comprehensive handheld bans that prohibit drivers from holding or using a mobile device for any reason while driving, with limited exceptions. These states take the strongest approach to limiting cell phone distraction. The states with full handheld bans include California, Connecticut, Delaware, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kentucky, Louisiana, Maine, Maryland, Michigan, Minnesota, Mississippi, Missouri, Nevada, New Hampshire, New Jersey, New Mexico, New York, Ohio, Pennsylvania, Rhode Island, Tennessee, Vermont, Washington, West Virginia, and Wyoming, plus Washington D.C.

The penalties for violating handheld bans vary by state but generally increase with repeated violations. In California, a first offense handheld ban violation costs $161. In New York, the fine ranges from $50 to $450 depending on the violation and driver age. Florida imposes fines of $30 to $60 for a first offense. Many states also add points to a driver's license record—typically one or two points per violation. These points can lead to increased insurance premiums, license suspension if enough points accumulate, and other consequences.

Some states impose harsher penalties for repeat offenses or for causing accidents while using a phone. For example, if a driver causes a crash while violating the handheld ban, penalties increase substantially. A few states treat distracted driving accidents as criminal matters rather than simple traffic violations, potentially resulting in criminal charges in serious cases.

Most handheld ban states include specific exceptions. Emergency calls to 911 are almost always permitted. Some states allow handheld use if the driver is parked on the side of the road. Many states exempt commercial drivers operating under federal regulations, though federal rules may be stricter. Some states make exceptions for GPS or navigation systems if they are mounted on the dashboard or windshield rather than handheld.

The strength of these bans reflects state-level decisions that driver safety outweighs the convenience of handheld phone use. Enforcement levels vary significantly between states and even between different jurisdictions within states, so while violations carry the risk of fines and points, not all violations result in tickets.

Practical Takeaway: If you drive in a state with a handheld ban, keep your phone in a mounted device or use hands-free options. First offense fines typically range from $30 to $450, and violations add points to your driving record that may increase insurance costs.

States with Texting Bans Only and Texting-While-Driving Laws

Forty-eight states, plus Washington D.C., have laws that specifically ban texting while driving. This is the most widespread type of cell phone driving law in the United States. However, in states with texting-only bans—those without full handheld bans—drivers are generally allowed to make calls using handheld devices, use phone-based navigation, or hold a phone for other reasons. The ban applies specifically to sending, reading, or composing text messages, emails, or social media posts while driving.

States with texting-only bans include Alabama, Alaska, Arizona, Arkansas, Colorado, Indiana, Kansas, Louisiana, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, and Wyoming.

Penalties for texting while driving range from $50 to $500 depending on the state and whether it is a first or repeat offense. In Texas, for example, a first offense texting violation in a school zone costs at least $100, while a violation outside a school zone costs at least $25. In North Carolina, the fine is $100 for a first offense. Like handheld bans, texting violations typically add points to a driver's record.

Importantly, two states—Missouri and Montana—do not have statewide texting bans, though some local jurisdictions within these states have enacted their own restrictions. This creates an unusual situation where the rule depends on which specific city or county you are driving in. Drivers should research local ordinances if they live in or travel to these states.

Most texting ban states include exceptions similar to handheld ban states: emergency calls, navigation systems, and hands-free communication. Some states also make exceptions for drivers who are parked. A few states exempt certain types of drivers or vehicles, such as those operating under commercial regulations.

The distinction between texting bans and handheld bans matters practically because it determines what phone
