Free Guide to Becoming a Notary in Tennessee

Understanding Tennessee Notary Requirements and Basic Qualifications

Tennessee has specific requirements that individuals must meet before they can become a notary public. Understanding these foundational requirements is the first step in the process. According to Tennessee Code Annotated § 8-16-101, notaries must be at least 18 years old and a resident of Tennessee. You do not need to be a lawyer, accountant, or hold any special professional license to become a notary in this state.

Residency in Tennessee is required, meaning you must maintain a physical address within the state. This residency requirement is important because the notary commission is tied to your location and jurisdiction. If you move out of state during your commission period, you would need to understand how that affects your notary status. Tennessee also requires that you be a U.S. citizen or a permanent resident alien, according to state law.

The state does not require any specific level of education, though you will need to be able to read, write, and understand English. This is a practical requirement because notaries must complete documents accurately and communicate clearly with the public. Many notaries come from various professional backgrounds—real estate agents, bank employees, legal secretaries, and business owners frequently hold notary commissions because the role complements their work.

One important point: Tennessee does not require you to pass a formal examination before becoming a notary, unlike some other states. However, you will need to understand notary laws and ethical responsibilities. Some individuals choose to take preparatory courses or read study materials before submitting their commission application, which can help them understand the role better.

Practical Takeaway: Before proceeding, confirm you meet the basic requirements: you are at least 18 years old, a Tennessee resident, a U.S. citizen or permanent resident, and able to read and write English. If you meet these criteria, you can move forward with learning about the application process.

The primary form is the Notary Public Application, which you can obtain from the Tennessee Secretary of State website or by contacting their office directly. This form asks for basic personal information including your full legal name, current address, date of birth, and social security number. You will also need to list whether you have any criminal convictions. Tennessee law requires disclosure of certain criminal history, as individuals with felony convictions related to dishonesty or fraud may be disqualified.

Required documents typically include:

• A completed application form signed and dated
• A government-issued photo identification (driver's license, passport, or state ID)
• Proof of Tennessee residency, such as a utility bill, lease, or mortgage statement dated within the last 60 days
• Payment for the application fee, which as of recent information was around $50, though you should verify current fees with the Secretary of State
• In some cases, a surety bond or E&O insurance information

The application can typically be submitted by mail to the Tennessee Secretary of State's office or in some cases through their online portal. Processing times vary, but you should expect to wait several weeks for your application to be reviewed and processed. During this time, the Secretary of State's office will verify your information and confirm that you meet the legal requirements.

Some applicants choose to work with the Secretary of State's office directly if they have questions about specific requirements or documentation. You can contact them by phone or through their website to clarify what you need to submit for your particular situation.

Practical Takeaway: Gather all required documents before starting your application. Prepare copies of your ID and proof of residency, complete the application form accurately, and include the appropriate fee. Submit everything together to avoid delays in processing.

Understanding Bonding and Insurance Requirements

Tennessee law requires notaries to obtain a surety bond as part of their commission requirements. A surety bond is a form of financial protection that safeguards the public against notary misconduct or errors. Understanding what this means and how to obtain a bond is important before you proceed.

A surety bond is essentially a contract between three parties: you (the notary), the surety company, and the state of Tennessee. The surety company agrees to compensate clients if you commit fraud, theft, or negligence in your role as a notary. The bond amount in Tennessee is typically $10,000, though this can vary. This means the surety company will cover losses up to that amount if someone brings a valid claim against you.

To obtain a surety bond, you will need to contact surety bond companies that operate in Tennessee. Many of these companies specialize in notary bonds and can issue them quickly. The process is straightforward: you contact a surety company, provide basic information, and they issue a bond certificate. You then submit this certificate along with your application to the Secretary of State. The cost of a bond is typically modest, often ranging from $50 to $150 for the commission term, depending on the surety company and bond amount.

Some individuals also consider obtaining errors and omissions insurance, though this is different from a surety bond. While not always required by Tennessee law, this insurance protects you personally if someone sues you for errors made in your notary work. Professional notary associations and insurance companies offer these policies. The coverage protects your personal assets and can provide legal defense if disputes arise.

When selecting a surety company, look for established companies that have good reputations and that operate in Tennessee. Many online surety companies can issue bonds through remote processes. You will need to provide truthful information about any criminal history or legal issues, as surety companies conduct background checks.

Practical Takeaway: Research surety bond companies before applying for your notary commission. Obtain a quote for a $10,000 surety bond and budget for this cost as part of your application expenses. Consider whether errors and omissions insurance is appropriate for your situation and intended notary activities.

Taking the Oath of Office and Receiving Your Commission

After your application is approved by the Tennessee Secretary of State, you must take an oath of office before you can officially begin work as a notary. This oath is a formal, legal commitment to perform your duties ethically and in accordance with Tennessee law. Understanding this step and what comes after will help you prepare for official activation of your commission.

The oath of office for Tennessee notaries typically involves swearing or affirming that you will faithfully and impartially perform your duties as a notary public. The specific wording comes from Tennessee law and emphasizes your obligation to verify the identity of signers, ensure they are acting of their own free will, and maintain the integrity of notarized documents. Some counties allow you to take this oath before a judge, county clerk, or other authorized official. Other counties may have specific procedures or locations where this must occur.

After the Secretary of State approves your application and you have taken the required oath, you will receive your official commission certificate. This document is your legal authorization to act as a notary public in Tennessee. You should keep this certificate in a safe location and reference it if questions arise about your authority. Your commission is typically valid for four years from the date it is issued, after which you may seek renewal.

Once you receive your commission, you will need to obtain a notary seal and journal. These are essential tools for performing notary duties. The seal is a stamp or embosser that creates an official impression on documents, typically containing your name, the state of Tennessee, and your commission number. The journal is a record book where you document each notary act you perform. Tennessee law requires you to maintain this journal as part of your official records.

You can order a notary seal from various vendors online or through local office supply stores. These are typically inexpensive, ranging from $15 to $50 depending on the type. The journal is also available from similar sources. Some notaries prefer electronic journals or digital records systems, but you should verify that any system you use complies with Tennessee record-keeping requirements.

Practical Takeaway: Once your application is approved, locate where you need to take your oath of office in your county and schedule a time to complete this requirement. Immediately order your notary seal and journal so
