Free Guide to Baltimore Public Records Requests

Understanding Baltimore Public Records Law

Maryland Public Information Act (MPIA) gives residents the right to request and receive copies of public records held by state and local government agencies. Baltimore, as Maryland's largest city, maintains thousands of records that fall under this law. These records include police reports, court documents, property assessments, business licenses, building permits, meeting minutes from city council, budget documents, and employment records of public employees.

The MPIA requires government agencies to respond to record requests within 30 days. If an agency cannot meet this deadline, they must notify you in writing explaining the delay. Agencies may charge reasonable fees for copying and shipping records, though the first 100 pages of copies are often provided at no cost. Some agencies waive fees for research purposes or public interest requests.

Not all government records are public. The MPIA lists specific exemptions, including personnel files with private information, documents protected by attorney-client privilege, records relating to active criminal investigations, trade secrets, and medical or psychological records. Understanding these exemptions helps you make realistic requests and avoid disappointment.

Baltimore City maintains records across multiple departments: the Police Department, Department of Planning, Department of Finance, Department of Recreation and Parks, Housing and Community Development, and many others. Each department may have different procedures, though all must follow the state law's basic requirements.

Practical Takeaway: Before submitting a request, identify which Baltimore city department most likely maintains the records you need. Sending your request to the correct department speeds up processing time significantly.

Where to Submit Requests and Contact Information

Baltimore City does not have a single centralized office for public records requests. Instead, each department manages its own requests. However, the Baltimore City Government website lists contact information for each agency's records custodian or MPIA officer. You can submit requests by mail, email, fax, or in person, depending on the department's procedures.

For City Hall records and general municipal documents, contact the Office of the Mayor or the City Clerk's office. The City Clerk typically handles requests for city council meeting minutes, ordinances, and official proclamations. The Department of Planning maintains records related to zoning, land use, development projects, and building permits. The Police Department handles incident reports and arrest records through their Records and Fingerprint Bureau.

The Baltimore Police Department's Records and Fingerprint Bureau can be reached at 410-396-2300 or by visiting their office at 601 E. Fayette Street. They handle requests for offense reports, case information, and fingerprint records. Response times for police records typically range from 5 to 10 business days, though complex requests may take longer.

Property records, including tax assessments and deed information, are maintained by the Department of Finance and the Baltimore City Register. The Register's office is located at 417 E. Fayette Street and maintains all recorded deeds, mortgages, and land-related documents. These records are also searchable online through the Baltimore City Register website, which may provide faster access than formal requests for common property information.

Court records from Baltimore Circuit Court and District Court are managed by the Maryland Judiciary rather than the city. Requests for court documents should be directed to the appropriate courthouse, not city agencies. The Baltimore Circuit Court is located at 100 N. Calvert Street, and the District Court for Baltimore City is at 5800 Wissahickon Avenue.

Practical Takeaway: Create a contact list for the departments relevant to your needs before submitting requests. Having specific phone numbers, email addresses, and mailing addresses prevents delays from sending requests to the wrong office.

Submitting Your Public Records Request

An effective public records request is specific and clearly written. Vague requests often result in delays or denials because agencies cannot determine what records you actually need. Rather than asking for "all records about a property," specify the address, the type of records (permits, inspections, violations), and the date range if known.

When writing your request, include your name, contact information (phone number and email address), and a clear description of the records you seek. For example: "I request copies of all building permits issued for 1234 Oak Street between January 1, 2020 and December 31, 2022." This specificity helps agency staff locate records quickly and accurately.

You are not required to explain why you need the records. The MPIA does not make public access conditional on stating your purpose. However, if your purpose is research or journalism, mentioning this may result in fee waivers or priority processing at some agencies.

Submit your request in writing through whatever method the agency specifies. Some departments prefer email, while others require mailed requests to a specific office. Many Baltimore agencies now accept requests through email, which creates a timestamped record of your submission. If submitting by mail, use certified mail to document delivery. Request delivery confirmation or a postmark date so you can verify the agency received your request within the 30-day response window.

Keep copies of everything you submit, including the request itself, any cover letters, and proof of delivery. These records help if a dispute arises about whether an agency responded timely or if you need to appeal a denial.

Practical Takeaway: Draft your request by being specific about what records you want, when they were created, and where they are located. Review your request to eliminate vague language before submitting.

Understanding Response Times and Possible Outcomes

Maryland law requires agencies to respond within 30 calendar days of receiving your request. This does not necessarily mean you will have the records in hand within 30 days—it means the agency must communicate with you within that timeframe. The response might be approval, denial, or a notice of delay.

If an agency needs more time to locate or copy records, they must send written notice before the 30-day period ends. This notice should explain why the extension is necessary and state a new date by which you will receive a response. Extensions are common for large requests or when records are stored off-site. Most extensions do not exceed an additional 30 days, but complex requests may receive longer timelines.

When records are approved for release, the agency will notify you of the cost and how to pay. As mentioned, agencies typically do not charge for the first 100 pages of photocopies. Beyond that, costs usually range from 10 to 25 cents per page, plus postage if you request mailing. Many agencies allow you to pick up records in person to avoid shipping costs. Contact the agency to learn about payment methods—some accept payment by check, others by credit card or cash.

If an agency denies your request in whole or in part, they must provide written reasons for the denial. They should cite which exemption in the MPIA applies and explain how the exemption prevents release. If a record contains some public information and some exempt information, the agency should redact the exempt portions and provide the rest.

You have the right to appeal a denial or partial denial. Appeals go to the Maryland Attorney General's Office, Public Records Division. The appeal must be filed within one year of the denial. The Attorney General's office reviews the agency's reasoning and determines whether the exemption was properly applied. Many requests denied initially are approved on appeal.

Practical Takeaway: Mark your calendar 30 days from submission. If you have not heard from the agency by day 30, contact them to confirm receipt of your request and ask about status.

Common Records Available Through Baltimore Agencies

Baltimore City maintains several categories of records that residents frequently request. Property-related records are among the most common requests. These include building permits, certificates of occupancy, inspection records, violation notices, property tax assessments, and deed information. The Department of Planning and the Department of Finance maintain most property records. Online databases allow you to search some property information without filing a formal request, including tax assessment data and deed records through the Baltimore City Register website.

Police and public safety records are also frequently requested. These include incident reports (also called offense reports), arrest records, police blotter information, and crime statistics. The Police Department's Records and Fingerprint Bureau processes these requests. Note that records involving ongoing investigations or juvenile cases may be withheld under state law. Recent incident reports may take longer to process because police must review them to ensure ongoing investigations are not compromised.

Budget and financial records are public documents that show how city tax dollars are spent. These include departmental budgets, expenditure reports,
