Understanding Baltimore County Marriage License Requirements

A marriage license in Baltimore County is an official document issued by the Maryland Department of Health that gives you legal permission to get married. Before you can have a wedding ceremony—whether at a church, courthouse, or other venue—both people planning to marry must obtain this license together. The license serves as proof that you meet Maryland's requirements for marriage and that you've provided accurate information to the government.

Baltimore County has specific requirements that differ from other Maryland counties in some ways. The state of Maryland sets basic marriage rules, but each county's circuit court handles the actual issuance of licenses. In Baltimore County, the Register of Wills office processes these licenses. Understanding what documents you'll need, what information you must provide, and how the process works can help you move through it smoothly without unexpected delays or surprises.

Maryland law requires that both people getting married must appear in person at the Register of Wills office to apply for the license. You cannot send someone else to do this for you, and you cannot complete the process online or by mail. This in-person requirement exists partly as a verification step and partly to ensure both parties genuinely consent to the marriage.

The cost of a marriage license in Baltimore County is $50. This fee must be paid when you apply, and payment methods typically include cash, check, or credit/debit card, though you should confirm current payment options by contacting the office directly. The fee does not change based on how quickly you need the license or any other factors.

Practical Takeaway: Plan to visit Baltimore County's Register of Wills office together during regular business hours. Bring the required documents listed in this guide and be prepared to pay the $50 fee at that time.

Required Documents and Information You'll Need to Provide

When you go to the Register of Wills office in Baltimore County to obtain a marriage license, you'll need to bring specific documents that prove your identity, age, and other key information. Having these documents ready before your visit will prevent delays and help the process move faster. Both people getting married must bring their own required documents.

For identification, you'll need a valid, government-issued photo ID. Examples include a driver's license, passport, state ID card, or military ID. The ID must not be expired. If you've recently changed your name through marriage, divorce, or court order, you may need to bring additional documentation showing that name change, such as a divorce decree or court order. The staff can tell you specifically what you need if your current ID doesn't match the name you want on the marriage license.

You must also provide proof of your date of birth. Usually, your photo ID serves this purpose. However, if your ID is missing birth date information or is questionable, you may need to bring a birth certificate as well. A certified copy of your birth certificate is best, though an uncertified copy may work in some cases. If you were born outside the United States, you may need your passport or other immigration documents showing your birth date and citizenship status.

Maryland law requires that you disclose whether either person getting married has been married before. If you have been divorced, you'll need to provide the date your divorce was finalized. If your previous spouse passed away, you'll need the date of death. If you do not have exact dates, bring whatever documentation you have—divorce decrees, death certificates, or court papers. The Register of Wills staff can help you locate missing information if needed.

You'll also need to provide your full legal name, current address, date of birth, place of birth (state or country), and your parents' full names and places of birth. Having this information written down before you visit can speed up the application. If you don't know your parents' places of birth, bring whatever information you do have; the office may still be able to process your license.

Practical Takeaway: Create a checklist including valid photo ID, proof of birth date, any divorce decrees or death certificates if previously married, and written information about your parents. Bring copies of everything, as the Register of Wills office may need to keep some documents or may require certified copies.

How Long the Marriage License Process Takes

Once you submit your marriage license application at Baltimore County's Register of Wills office, you'll receive your actual marriage license the same day. Maryland does not have a waiting period between when you apply and when you receive the license, which is different from some other states. This means you can apply for your license and walk out with it immediately after submitting your application and paying the $50 fee.

However, you should plan to spend about 30 minutes to an hour at the Register of Wills office for the actual application visit. The time can vary depending on how busy the office is that day and whether all your documents are complete and correct. If you go early in the morning or on a slower day, you may be finished more quickly. If you go during peak times, such as Friday afternoons or Saturdays when the office is open, you might wait longer.

After you receive your marriage license, it is valid for 6 months in Maryland. This means the person who performs your ceremony (a judge, minister, rabbi, or other authorized officiant) must sign and return the license within 6 months of the date you receive it. If your wedding is more than 6 months away, you'll need to apply for the license again closer to your wedding date. Applying twice isn't a problem—you simply apply again when you're within the 6-month window before your ceremony.

If you need your marriage license for a ceremony taking place soon, you can apply anytime during regular business hours and receive it the same day. There is no rush fee or expedited process in Baltimore County because all licenses are issued the same day. If your ceremony is tomorrow, you can still apply today and receive your license immediately.

One thing to note: if you apply for a license and then decide you want to postpone your wedding, you do not need to "cancel" the license. It will simply expire after 6 months if it's never used. The money you paid does not roll over or transfer if you reapply; you'll pay the $50 fee again when you apply for a new license.

Practical Takeaway: Plan your license application for within 6 months before your wedding date. Apply during a time when you won't feel rushed, and budget about an hour for the office visit, though it may be shorter. Remember that the license is issued the same day you apply.
