Understanding What a Notary Public Is and Does

A notary public is an official appointed by a state government to serve as an impartial witness to the signing of important documents. Notaries do not provide legal advice or create legal documents—their role is specifically to verify the identity of people signing documents and confirm that they are doing so willingly and knowingly. This verification adds a layer of trust to documents that may be used in legal, financial, or official transactions.

When you work with a notary, they perform several key functions. First, they check a valid form of identification to confirm that the person signing is who they claim to be. Second, they watch the person actually sign the document in their presence. Third, they record details about the transaction in a notary journal or log. Finally, they place their official seal or stamp on the document and sign it themselves. This official mark indicates that a notary witnessed the signing and verified the signer's identity.

Notaries serve an important purpose in protecting against fraud and forgery. Because notaries are trained to spot forged documents and verify that people are not signing under pressure or coercion, their involvement can prevent scams and protect people's legal and financial interests. Many documents require notarization by law—such as property deeds, powers of attorney, and certain affidavits. Other documents may be notarized at a person's request to add credibility and verification.

It is important to understand that notaries have limits to what they can do. Notaries cannot give you information about whether a document is legally correct, advise you on whether to sign something, translate documents, or fill in blanks on forms. They serve only to witness and verify. If you need legal guidance about a document, you should consult with an attorney.

Practical Takeaway: Before visiting a notary, gather all the documents you need notarized and bring a valid government-issued photo ID. Know that the notary's role is limited to witnessing your signature and verifying your identity—they cannot offer legal guidance about the documents themselves.

Common Types of Documents That Require Notarization

Many everyday documents benefit from or require notarization depending on state law and the situation. Understanding which documents typically need notarization can help you prepare before visiting a notary. Some of the most common documents include real estate deeds and mortgage documents. When you buy or sell property, the deed transferring ownership usually must be notarized. This protects both the buyer and seller by confirming that the person signing the deed is truly authorized to transfer the property.

Powers of attorney documents are another frequent reason people seek notary services. A power of attorney is a legal document that allows one person to authorize another person to act on their behalf—for example, to manage bank accounts, make healthcare decisions, or handle financial affairs. Because these documents give significant authority to another person, they almost always require notarization to ensure the document is legitimate and that the person signing understood what they were authorizing.

Affidavits are sworn statements made under oath before a notary. These are commonly used in legal proceedings, divorce cases, small claims court, and other situations where someone needs to make a formal statement that certain facts are true. The notary's role in an affidavit is to confirm the person's identity and ensure they understand they are making a statement under penalty of perjury. Other frequently notarized documents include vehicle title transfers, loan documents, adoption papers, passport applications, and certain healthcare directives.

Some documents may not be legally required to be notarized but are notarized anyway to add formality and credibility. For example, a parent might notarize a letter stating they grant permission for their child to travel with another adult. Notarizing a document like this does not make it legally binding, but it does provide third parties with assurance that the document is genuine and was signed by the person whose name appears on it.

Practical Takeaway: Check your specific document or situation to determine whether notarization is required or recommended. Many states have laws specifying which documents must be notarized, and financial institutions or government agencies may have their own requirements. When in doubt, ask the person or organization requesting the notarization.

How to Search for Notaries in Your Community

Finding a notary in your area involves several practical approaches, and most people can locate one nearby within a short time. One of the simplest methods is to ask at businesses commonly staffed by notaries. Banks and credit unions frequently employ notaries who provide the service to customers at no cost or for a small fee. Call your bank's main branch or visit in person to ask if they offer notary services and whether you need to be a customer to use them. Many banks have notaries available during business hours, and this can be a quick solution if you already bank there.

Real estate offices and title companies almost always have notaries on staff because they handle many real estate transactions. If your document relates to property or real estate, a title company is an excellent resource. These businesses are accustomed to working with notarized documents and understand the specific requirements. Law offices also employ notaries, though they may charge higher fees and may primarily serve their own clients. You can contact local law offices to ask whether they offer notary services to the general public.

Many states offer online searchable directories of notaries. You can often find these through your state's Secretary of State website or your state's notary commission office. These directories typically allow you to search by county or city and may provide names, phone numbers, addresses, and whether the notary is available for mobile services (traveling to your location). Some notaries operate mobile services and will travel to your home, office, or another location to notarize documents, which can be convenient if you have scheduling challenges or mobility issues.

Other reliable sources include UPS stores, FedEx offices, pharmacies, and shipping services, many of which employ notaries. Libraries and post offices sometimes offer notary services as well, though not all do. Asking friends, family members, or colleagues for recommendations can also be useful—people who have recently used a notary's services can often provide honest feedback about their experience. You can also perform a general internet search for "notary public near me" to find local options with addresses, phone numbers, hours, and customer reviews.

Practical Takeaway: Start your search by checking with your bank or credit union, as they often provide notary services at low or no cost to customers. If that is not an option, visit your state's official website to find a notary directory, or search online for notaries near your address to compare options and hours.

What to Bring and How to Prepare for Your Notary Appointment

Preparing for a notary appointment involves gathering the right materials and understanding what the notary will need from you. The most critical item is a valid, government-issued photo identification. Acceptable forms of ID include a driver's license, state ID card, passport, or military ID. The ID must be current and not expired—notaries cannot notarize documents for someone with an expired ID in most cases. The name on your ID must match the name on the document you are signing. If your name has recently changed due to marriage, divorce, or other reasons, bring documentation showing the name change along with your current ID.

Bring all documents that need to be notarized. Make sure the documents are complete and that any blank lines or spaces where signatures are required are clearly marked. Some notaries will work with unsigned documents and watch you sign them in their presence, while others prefer documents to be completely unsigned when you arrive. Ask when scheduling your appointment which approach the notary prefers. If you are uncertain about anything on the document or have questions about how it should be completed, address these before meeting with the notary, as they cannot provide guidance about the document's content or legal implications.

Know the names and contact information of any other parties involved in the transaction, if applicable. In some cases, notaries may need to contact other signatories or verify information about the transaction. Bring any additional paperwork that might be relevant—for example, if the document mentions a loan number or account number, having that information readily available helps the notary complete their journal entry accurately. If you are having multiple documents notarized, bring all of them to one appointment when possible to save time and money.

Before your appointment, call ahead to confirm the notary is available, ask about fees, and confirm their hours and location. Most notaries charge between $5 and $15 per signature or document, though fees vary by state and location. Some notaries may charge additional fees for mobile services, multiple signers, or certified copies. Knowing the
