Check Your US Visa Status Online Information Guide

Understanding US Visa Status: What This Means and Why It Matters

A US visa status refers to your current immigration condition in the United States. This status determines what you are legally permitted to do while in the country, how long you can stay, and what restrictions apply to your activities. There are many different visa categories, each with its own rules and requirements. Understanding your specific status is important because violating the terms of your visa can result in serious consequences, including deportation and being barred from future entry into the United States.

Your visa status is documented through several official records. The primary document is your visa itself, which is typically stamped or placed in your passport by a US embassy or consulate in your home country. However, the visa itself is different from your status of admission. When you arrive at a US port of entry, an immigration officer reviews your documents and makes a determination about what status to grant you. This status is recorded in the US government's immigration database and on your I-94 arrival/departure record.

Common visa categories include tourist visas (B-1/B-2), work visas (H-1B, L-1, O-1), student visas (F-1, M-1), family-based visas (IR-2, CR-2, F-2A), and many others. Each category has different rules about what you can do, how long you can stay, and what happens if you want to change your status. For example, someone on a B-2 tourist visa cannot legally work, while someone on an H-1B work visa can only work for their sponsoring employer in the position described in their petition.

Practical takeaway: Locate your passport and any documents you received from US immigration. Write down your visa category code (the number-letter combination like B-1, H-1B, or F-1) and the expiration date on your visa. Keep these details handy as you explore online status checking options.

How to Access the USCIS Case Status Tool

The US Citizenship and Immigration Services (USCIS) operates an online tool called "Check Your Case Status" that allows you to track certain immigration applications and petitions. This tool is available on the official USCIS website at www.uscis.gov. To use this tool, you need a receipt number, which is provided when your case is first filed with USCIS. The receipt number begins with three letters (usually EAC, MSC, LIN, or WAC) followed by ten digits, formatted like EAC-21-123-456789.

To access the tool, visit the USCIS website and look for the "Case Status" section in the main navigation. You can enter your receipt number directly into the search box. After you submit the number, the system will display information about your case, including the current status, the type of application or petition, when it was received, and sometimes an estimated processing time. The information displayed updates as your case progresses through different stages of review.

The types of cases you can track through this tool include I-485 applications (adjustment of status to become a permanent resident), I-130 petitions (family-based immigration), I-140 petitions (employment-based immigration), I-765 applications (work authorization), and many others. However, not all immigration matters can be tracked this way. For example, visa status while you are outside the United States, or visa stamping procedures at US consulates abroad, are not tracked through this USCIS tool.

The USCIS system typically shows one of several status updates: "Case was received," "Case is being reviewed," "We took action on your case," or "We need to take action on your case." Each status means something different. "We took action" usually means a decision has been made and documents are in the mail. "We need to take action" often means USCIS is waiting for something from you, such as additional documents or payment of a fee. Processing times vary widely depending on the type of application and your location.

Practical takeaway: Locate your USCIS receipt number (it should be on your Notice of Action form or I-797 receipt notice). Write it down in a safe place. Visit www.uscis.gov and bookmark the Case Status tool for regular checking. Set a reminder to check every 4-6 weeks if you are waiting for a decision.

Using the I-94 Arrival/Departure Record to Check Your Status

The I-94 Arrival/Departure Record is an official US government document that shows when you entered the United States and important details about your current legal status. This form is now created electronically for most travelers arriving at US airports and sea ports. You can view and print your own I-94 record online through the US Customs and Border Protection (CBP) website, which is the agency responsible for monitoring who enters and leaves the country.

To access your I-94 record, go to www.cbp.gov/i94 on the official CBP website. You will need to provide certain personal information, including your passport number, country of citizenship, and date of birth. The system will retrieve your record and display information about your most recent arrival in the United States. The I-94 record shows your admission date, your visa category or admission class, your authorized period of stay, and sometimes your port of entry and the inspection officer's notes.

Your I-94 is particularly important because it shows the official end date of your authorized stay. This is sometimes called your "I-94 expiration date" or "authorized period of stay." This date is different from your visa expiration date. For example, you might have a tourist visa that does not expire until 2027, but your I-94 might show that you are only authorized to stay until June 2024. In this case, you must leave the country by June 2024 or face overstay consequences, even though your visa is still valid.

If you arrived by land at a US-Canada or US-Mexico border, your I-94 may be issued as a paper form that is placed in your passport rather than as an electronic record. In these cases, you should keep the paper I-94 safe and check it yourself for accuracy. You can still view electronic I-94 records through the CBP website if one was created when you entered the country. Being able to verify your I-94 information online is one of the most practical ways to confirm that your current authorized stay period is accurate.

Practical takeaway: Visit www.cbp.gov/i94 and retrieve your I-94 record. Print it and compare the authorized period of stay with your current date. Mark your calendar with the expiration date. If you find errors on your I-94, such as an incorrect spelling of your name or wrong visa class, contact CBP or a USCIS office to request a correction.

Tracking Work Authorization and Employment-Based Visa Status

If you are working in the United States on a visa, you may have received work authorization documentation that shows you are legally permitted to be employed. The most common forms of work authorization include Employment Authorization Documents (EAD), which are issued as I-765 approval notices or physical work permit cards. You can track the status of your work authorization application or card through multiple online systems depending on how your authorization was granted.

If your work authorization is based on an employment-based immigration petition (such as an H-1B, L-1, or O-1 visa), you can track the petition through the USCIS Case Status tool using your receipt number. The petition determines whether your employer can sponsor you to work in the United States. However, the petition is different from the visa itself. The visa is issued by a US consulate or embassy abroad, and the status is then confirmed when you arrive at a US port of entry. The USCIS status tool tracks only the employment petition, not the visa status.

For H-1B visas specifically, you may want to check the status of your petition through USCIS, but the actual visa status depends on your I-94 and passport documents. The H-1B is a specialty occupation visa typically used for professional workers. To confirm your H-1B status, you need to verify: (1) that your I-94 shows H-1B as your admission class, (2) that your authorized period of stay has not expired, and (3) that your passport contains an H-1B visa stamp. You can check items 1 and 2 through the CBP I-94 website.
